RESOLUTION NO. 9 4 — 2 0 2
VACATION OF RIGHT-OF-WAY FOR PART
OF OLD SHADY OAK ROAD
LOCATED IN SECTION 2
WHEREAS, the City of Eden Prairie has certain right-of-way described as follows:
SEE EXHIBIT A
WHEREAS, a public hearing was held on December 6, 1994 after due notice was published and
posted as required by law;
WHEREAS, it has been determined that the said right-of-way is not necessary and has no
interest to the public, therefore, should be vacated; and
WHEREAS, public and private utilities have been installed and are presently operated and
maintained within the right-of-way, an easement allowing governmental and utility company
personnel and equipment to enter upon the vacated right-of-way to maintain or construct
additional facilities needs to be retained.
NOW, THEREFORE, BE IT RESOLVED by the Eden Prairie City Council as follows:
1. Said right-of-way as above described is hereby vacated, subject to a permanent
drainage and utility easement being retained over the entire parcel and a
temporary easement over a portion of the vacated right-of-way as described in
Exhibit B.
2. The City Clerk shall prepare a notice of completion of proceedings in accordance
with M.S.A. 412.851

That part of Shady Oak Road (presently known as Old Shady Oak Road) located within the
following described property:
That part of the Northeast Quarter of the Northeast Quarter of Section 2, Township 116, Range
22, Hennepin County, Minnesota described as follows:
Beginning at the Northwest corner of said Northeast Quarter of the Northeast Quarter,
thence South to the Southwest corner thereof, thence East a distance of 456.08 feet along
the South line thereof, thence North a distance of 50 feet parallel with the West line
thereof, thence East parallel with the South line thereof to the centerline of Shady Oak
Road, thence South along said centerline to the South line of said Northeast Quarter of
the Northeast Quarter, thence East along said South line to a point 425.75 feet West from
the Southeast corner of said Northeast Quarter of the Northeast Quarter, thence North
parallel with the East line thereof to the North line of the South 657.6 feet of said
Northeast Quarter of the Northeast Quarter, thence West along said North line to the East
line of the West 406.5 feet of said Northeast Quarter of the Northeast Quarter, thence
North along said East line to the North line thereof, thence West to the point of
beginning.
Except therefrom the following described tract:
Commencing at the Southeast corner of the Northeast Quarter of the Northeast Quarter
of Section 2, Township 116, Range 22,Hennepin County, Minnesota; thence West along
the South line of the Northeast Quarter of the Northeast Quarter of said section on an
assumed bearing of South 88 degrees 35 minutes 02 seconds West a distance of 425.75
feet to the point of beginning of said described tract; thence South 88 degrees 35 minutes
02 seconds West a distance of 146.92 feet to the centerline of existing Old Shady Road;
thence North 00 degrees 41 minutes 15 seconds West a distance of 50.00 feet; thence
South 88 degrees 35 minutes 02 seconds West a distance of 10.27 feet; thence
northeasterly a distance of 180.27 feet along a non-tangential curve concave to the
Southeast having a central angle of 41 degrees 51 minutes 04 seconds, a radius of 246.80
feet and a chord bearing of North 45 degrees 29 minutes 45 seconds East; thence North
66 degrees 25 minutes 17 seconds East a distance of 24.23 feet; thence South 03 degrees
07 minutes 46 seconds East a distance of 179.65 feet, to the point of beginning.

October 1, 1995 as described:
Commencing at the Southeast corner of the Northeast Quarter of the Northeast Quarter
of said Section 2, thence West along the South line of said Northeast Quarter of the
Northeast Quarter, on an assumed bearing of South 88 degrees 35 minutes 02 seconds
West a distance of 425.75 feet; thence orth 3 degrees 07 minutes 46 seconds West a
distance of 179.65 feet to the point of beginning of said temporary easement; thence
South 66 degrees 25 minutes 17 seconds West a distance of 24.23 feet; thence
Southwesterly a distance of 180.27 feet along a tangential curve to the left having a
radius of 246.89 feet and a central angle of 41 degrees 51 minutes 04 seconds; thence
South 88 degrees 35 minutes 02 seconds West a distance of 18.01 feet; thence North 01
degrees 24 minutes 58 seconds West a distance of 79.94 feet; thence North 88 degrees
35 minutes 02 seconds East a distance of 57.74 feet; thence Northeasterly a distance of
100.13 feet along a non-tangential curve concave to the Southeast having a central angle
of 21 degrees 54 minutes 51 seconds, a radius of 261.80 feet and a chord bearing of
