The request is for rezoning in conformance with the Preserve PUD 70-4
to RM 6 .5 and approval of the preliminary plat for the 30 units.
B. Fogelson/Hirsch-Request ,approval of 203-unit Patio-home (quad),
Townhouse Project south of Neil Lake Drive and north of Olympic
Hills Golf Course in the Preserve. The request for rezoning to
RM 6 .5 and approval of the development stage.

INVOCATION - PLEDGE OF ALLEGIANCE - ROLL CALL
Members present were: Chairman Norma Schee, Chairman Pro-Tem
Herb Fosnocht, Secretary Wayne Brown, Roger Boerger, Ralph
Nesbitt, Don Sorenson, Patrick Casey. Also present were: Dick
Putnam, Planner.
I. TOUR OF FOGELSON/HIRSCH TOWNHOUSE SITE AND JONATH,' N
, HOUSING CORPORATION TOWNHOUSE SITE .IN THE PRESERVE
BEGAN AT 6:3 0 P.M. AT THE VILLAGE HALL.
Schee, Brown, Boerger, Sorenson, Casey and Putnam attended
the tour.
Commission members visited the proposed bventy-five acre site
for the Fogelson/Hirsch townhouses in the first phase of the
Preserve adjacent to Neil Lake just south of Preferred Developers
on North Olympic Hills Golf Course. The extreme rolling terrain
• in the great vistas over the golf course in Neil Lake were noted
by all members of the Commission. Second site visited was the
five acre parcel on the west edge of the Preserve adjacent to
the Village Center just north of Neil Lake and south of the
parkway. This is the site for the Jonathan Housing Corporation
proposal for thirty townhouse units. It was noted that the site
was flat with an oak tree line on the eastern edge and the
sewer easement which runs through the site on the eastern or
western side. 'Those two factors can strain the development into
that area approximately two hundred to two hundred and fifty
feet in width. The Commission observed the marshy land to the
west which will remain open, and the close proximity to Neil
Lake on the south which has large pedestrian open spaces there.
The Commission then moved to Jonathan, the new town in Chaska,
to take a tour of the proposed units by the Jonathan Housing
Corporation. The units were under construction and we observed
the two bedroom units which are located on the ends of the four
unit buildings and the three bedroom units in the middle. The
units are planned in such a fashion that one side would be the
garage entry side. Two bedroom units would have one car garages
and the three bedroom units would have two car garages. The
• living areas all front to one side of the unit and include small
pation areas iprith excellent views from that side.' The three
bedroom unit has three bedrooms upstairs and a bath and one
half, two story vaulted living room space and dining room space,
kitchen, and bath downstairs. The two bedroom unit has a great
flexibility in that it has a large living, dining area that opens to
the front side of the units and upstairs is an enlargement space

for second bedroom or study that is approximately 15 x 15 feet
with a vaulted ceiling. These units are selling from $25-29,000
and the price is expected to be nearly the same in the Preserve,
or approximately $1,000 more per unit.
II. MINUTES OF AUGUST 1 , 1972 PLANNING COMMISSION MEETING.
Moved by Casey and seconded by Boerger that the minutes be
approved with the corrections that Mr. <Forenson will be giving
to the staff. Motion carried.
PETITIONS, REOUESTS AND COMMUNICATIONS.
A. Jonathan Housing Corporation Request Approval of 30-Unit
Townhouse Complex South of the East-West Parkway and Adjacent
to Neil Lake in the Preserve. Jonathan Housing Corporation is
requesting rezoning to RM 6 .5 and preliminary plat approval for
the 30 units.
• Mr. Bonner from the Preserve gave a brief description for those
in the audience and Planning Commission members that were not
on the tour of where the site was located in the Preserve. He
also gave a slide presentation of- the units that are being built
in Jonathan, which are two and three bedroom townhouse units
with two and one car garages. An important element of this
proposal is the lineal spine nature of the circulation system,
which runs south to north on the east-west parkway. The
street will be one that is very tight in bet ,7een the units -
approximately 32 feet which has garages butting up directly to
it. There are additional parking spaces provided along this
spine street. All of the living spaces of the units front out
away from the street to the oak grove on the east and the marsh
on the west.
Commission members asked some questions relating to :the width
between units where the garages have fronted back to back,
being thirty-two feet, if that was sufficient to provide the
turning movements necessary. They asked that the staff and the
developers investigate this thoroughly before the next meeting.
Also, . the total number of parking spots, if that was sufficient
for the project,and also if recreational vehicle storage was pro-
vided, and if so, where? An additional area of concern was
the adequate turning space for any emergency vehicles into this
spot. Mr. Bonner noted that there was a. possibility of connecting
the street system to the adjacent project to the east by way of
a small drive at the south end of the project. This was felt
to be less desirable since it may increase traffic through the
project. A better solution would be a large turn around space

This proposal is a true clustering of units, due to the confined
space by the oak ridge on the east and sewer easement on the
,west. This requires that the units be grouped into tight clusters,
leaving open space on the outsides of the units.
_Action Taken
Recommend a public hearing date for the first Council meeting
in September, September 12, and refer the proposal to the staff
for recommendations.
B. Fogelson/Hirsch Proposal of 203 Patio Homes in the Preserve
Was Not Presented This Evening Pending Further Design Work on
the Project.
iV. REPORTS AND RECOMMENDATIONS
A. Windslope. Commission action on a staff report dated
July 30, 1972 , about the MAIA's non-profit housing corporation's
• 236 rental apartment project in the Preserve for 168 units.
Planner noted that he had talked with Deputy Attorney General
John Keneflick regarding the attorney general's option on the
tax question surrounding 236 projects for Eden Prairie. Mr.
Putnam noted that there were three major areas that are being
discussed and that the report will be available later this week.
The areas are covered under 17B which puts Eden Prairie into
the category of under 10,000 and that a 5% tax of full and true
value on subsidized projects does apply. w econdly, that no
special census may be taken to determine when the population is
over 10,000;.and that the 15 year term of the 5% assessment
would be valid even though the law was repealed or the community
was over 10, 000 population,and thirdly that the developer could
enter into a contract with the Village for the difference in cost
between the 20% assessment and the 5% assessment for the period
of time either the length of the mortgage or the 15 years. The
repayment mentioned could take various forms, some of which
could possibly be through assessment policy through the Village
or an agreement with the developer. Since the attorney general's
ruling has been written and its contents known, it was felt that
the Commission could make a recommendation at this time
• on the Windslope project. As you remember, the Shelter 236
project in Edenvale is before the Council, and the hearing has
been continued pending the attorney general's opinion.

The planner noted that the staff report on the MAIA's project
dealt primarily with non-physical concerns , such as social
considerations, types of families, capabilities of the developers,
objectives, and political considerations. The site planning,
design of the unit, etc. was felt to be excellent, as it should
be by the developers group, the American Institute of Architects,
the Minneapolis Chapter.
Mr. Putnam asked that special consideration be given to recom-
mendation three, stating that the Village encouraged the MAIA/
Eberhardt joint partnership to consider the inclusion of market
rate units and rent supplement units in the YTindslope project.
He felt that this item deserved discussion and consideration
by the Commission since the project as proposed would not
include rent supplement units. He also referred the Commission
members to the discussion at the last Council meeting of the
Windslope project. This was a public hearing, and Mr. Putnam
• noted the concern by various Council members that rent supplement
was not being included. There was very little discussion of
this issue.
Action Taken.
Sorenson moved and Brown seconded that the Planning Commission
recommend to the Council the outlined in the staff
report dated July 30, 1972 .
1. The Windslope project for moderate income housing in
the Preserve be approved as an excellent multiple family
residential environment.
2 . A development plan be approved and the 10. 8 acre site
be rezoned RM1 2 .5 based upon the site plan and the 168 units
proposed are the MAIA/Eberhardt joint partnership.
3. The Planning Commission recommends deletion of item
three in the staff report, stating that the Village encourages
the. MAIA/Eberhardt joint partnership to consider the inclusion
of market rate units and rent supplement units in the "Windslope
project. The Commission did not feel that this was appropriate.
• 4. That the "Windslope 236 project include adequate interior
common space for the residents with adjustment to unit mix if
necessary to preserve the concept of the project. That the review
and approval of the ' interior common space be given by the Planning
Commission or Council prior to issuance of a building permit.

5. The approval of this project is contingent upon obtaining
an enforceable legal contract for the developers to pay the
Village the difference in the tax revenue that would be derived
from 20% of assessed valuation verses 5% of assessed valuation.
The amended staff report was approved unanimously by the
Commission.
B. Perkl-Arndt Baywood's Single Family Preliminary Plat and
Rezoning RI 13 .5 Adjacent to Duck Lake and County Road 4
The planner briefly discussed the staff report and indicated
the areas of concern that the Commission expressed at its
last meeting. The access to County Road 4 was checked by
the County Highway Department and was found acceptable.
Secondly, Bay'�,,rood Terrace, a dead end street, be revised into
a c,-l-de-sac or bubble so as not to interfere with Mr. Stodola's
property to the north. The legal agreements, easements, or
homeowner's association be established before a final plat approval
• be granted in dealing with the common spaces and outlots in
this proposal.
The Commission asked about the problem of drainage to Duck
Lake and that if this project would adversely affect the level
of the lake , raising it and causing flooding in some basements.
Mr. Hanson, an enginesr from Schoell and Madson, did not
feel that this would be a problem.
Action Taken
Fosnocht moved, Nesbitt seconded to recommend to the Council
that the preliminary plat be approved and rezoning to R 1 ' 13 .5
in conformance vrith the Baywood single family plat to be revised
be approved %tilith the parameters of 'the staff report dated August
15 , 1972 with these additions. Change item five to read, the
revision of the dead end street, Baywood Terrace, be modified
to provide access to lot one in conformance with the Village
subdivision ordinances. Additional point number ten that the
Village Engineer establish the drainage from the Baywood project
and its influence upon Duck Lake so that it will not affect the
existing area residence detrimentally. The motion was passed
unanimously.
• C . Edenborough Proposed by l',emrich, Inc. Single Family Plat .
North of Duct; Lake Trail and Adjacent to the Bellhurst Addition.
Planner briefly reviewed the elements of this project and noted
that it is a very straight forward single family project. 'it had
been reviewed by the Park and Recreation Commission with their
full approval as to the dedication of the northerly low land area

to park area. The only addition that might be proposed would
be some form of steps or hard surface walkway that would be
installed along the storm sewer easement running to the north
from the proposed street to provide access for the residents
to the proposed park: in the future.
The letter addressed to Mrs. Marks explaining the options available
to her and the impact of this project upon her land was reviewed,
and the planner noted that she had thanked the Commission for
their concern; but at the present time she did not wish to develop
and had no disagreements with the I4emrich proposal. The
Commission asked that the staff obtain a letter from Mrs. Marks
stating that she did receive the letter dated August 10, 1972,
and that she was aware of the points in it.
Action Taken.
Sorenson moved, seconded by Schee, to recommend to the
Council rezoning R1 13.5 and preliminary plat approval in -
conformance •3it'a the plan Edenborough by Kemrich with the
parameters outlined in the staff report dated August 11, 1972,
• with the following exception. Delete item t vo, ancl, item three
changed to read, recommend that the pathJaay/steps etc. along
the storm se*�ver easement running to the park be installed by
the developer at a inridth to be determined and approved by
the Village staff. The motion passed unanimously.
D. Elliason Construction Company Request PUD Concept Approval
and Rezoning of the Property for a Single Family 13 .5 Subdivision
of Approximately 50 Acres Located North of Highway 5 and South
and "Nest of Round .Lake. Mr. Olson from Caswell and Associates
presented a colored graphic indicating the proposal and the
additions suggested by the Planning Commission at its last
meeting. Also, he noted that the proposal is being resubmitted
as a PUD and asked for comments relating to the project.
The revised material was not provided to the Village until Friday
at noon and there was not sufficient time for staff review and
recommendation. The Round Lake Estates Proposal would have
a public hearing the next council meeting, Pugust 22nd.
Action Taken.
Casey moved, Boerger seconded, to recommend to the Council
• that a public hearing shall be held as scheduled and that the
Council action Mould be withheld until the staff recommendation
and the Planning Commission recommendation have been completed.
Motion passed unanimously.

E. Valley Knolls Addition - Bru-Mar Construction_Compann
Requests Rezoning R1 13.5 and Preliminary Plat Approval.
The planner briefly discussed the staff report and used aerial
photos to show the character of the site 'which is flat, primarily,
with a steep slope to the north. The planner. indicated the
advantages of the cul-de-cas streets and the four acre park
dedication to Arith which ties into the proposed park golf course
area.
Mr. Casey asked that the Village Staff investigate the drainage
impact on Duck Lake from this project.
The inclusion of concret pathways was discussed along Duck
Lake Trail and Duck Lake Road because of the "thru" street
traffic. Mr. Marve nnderson was agreeable to that suggestion
at Isis cost. The Valley Knolls single family plat is an appropriate
addition to the Duck Lake area.
• Action Taken
Casey moved and Sorenson seconded to recommend to the Council
approval of the Valley Knolls addition based upon the criteria of
the staff report dated August 15, 1972, ;jvlith two additions.
1. Add "concrete" before walkway in recommendation.
2. Add a fourth recommendation that the Village engineer
establish the drainage from the project so that it ,mill
not adversely affect existing area residents.
F. Set the Next Planning Commission Meeting for August 29,
1972 , 7:30 P. M. , Eden Prairie Village Hall.
The meeting was adjourned at 11:45 P.M.
