The Planner informed the Commission since the Sept. 10th meeting at which a
the developer agreed to pursue residential multiple upon the southern 1i �
of the 5th Addition, the beveleper met with City Staff and has revised the

development plan back to all industrial lots as t is believed some of the

The Planner then reviewed the revised staff report dated Sept. 21 , 1979
summarizing the recommendations as follows: no variances be allowed, screening

Mr. Bentley rated that the 2nd ponding area was not delineated as an outlot
upon the preliminary plat and that the road right-of-way conflicts with the
building setback.
Mr. Richard Anderson, developer, stated he old meet all screening requirements I

residential from the industrial park. Mr. Anderson voiced his oppostion to
elimination of the joint parkins'loading areas proposed as the 2 lots will be
under one cwpr.-.•rship. lie requested the commissivrt approve the Joint parkins/
loading areas for lots 1 a 2, 3rd addition, and lots 3 of the 2nd b 3rd additions,
as they will be under the same owner.

C-evittinquired why the multiple residential use Was withdrawn and what impact
industrial uses will have on Rembrandt's residential, The Planner
responded the staff deternlined that the road systems and industrial uses pro-
posed will work and any adverse visual impact the industrial• ray have upon the
residential will be carefully evaluated in the landscape and grading plans.
Greg, Demonceau, architect for Rembrandt, stated his preference for multiple
residential use upon the southern hof the 5th addition as it will assist in
buffering and will contribute to the cost of the southern access road.
Bentley noted that the revised staff report states all lots within the 3rd
and 5th Addition neet the minimun lot size of the I-5 District., but that the
revised plats depict lots of 3 and 4 acres in size. The Planner responded that
the revised staff report is based on the previous plats and that the revised
plats, 9/18/79, contain.lots meeting or exceeding the I-2 District.
Motion
Bentley moved, Retterath seconded, to close the public hearing on Shady Oak
Industrial Park 3rd b 5th Additions Motion carried 6-0.

the finding of No Significant impact in the Shady- Oak Industrial Park EAW dated

Bentley roved, Retterath seconded, to recommend to the City Council approval of
the rezoning from Rural to I-2 Park as per the plans dated 9/18/79 and the staff
report of 9/21/79. Mut ion Carried 6-0.
Notion 4
Bentley moveo, Retterath seconded, to recommend to the City Council approval of
the preliminary plats of the 3rd b 5th Addition dated 9/11/79 with additional
recomwndationsas follows:

lot 3 of Addition 2. * combined for the purpose of
combining entrance to these new lots via a single driveway
because of single ownership.
Further recommend that easements f%-.r right-of-way on the
southwest corner and southeast corner cf the 5th Addition
be included complete with proper setbacks, and that the
southern storm drainage pond (jointly shared with 1.eP_,rc)
be set aside as an outlot,

The Planner reviewed the staff report on the PULE request noting that access ,,
grading, unit type, number of unity, and an EAw will all receive close evalua-
tions at time cf project rezoning.

the staff report and will work with the City staff and adjacent landowner's to
develop access. I
Mr. Bentley inquired if public transit is available to the site, The Planner
replied negative.
Mr Levitt asked how the Shoreland Management Ordinance would effect this
proposal . The Planner replied the project proposed at time of rezoning would
be evaluated according to all ordinance requirements.

the Michelangelo Gardens PUD Concept based upon the 8-3149 plan and the staff
report dated 9-20-79. Motion carried 6-0.

The Planner reported the revised PUD Concept plan responds to the staff's and t
commission' s previous concer s in that the concentration of smaller lots has
been divided into two areas , a mini-totlot has peen added, and the nark area t
has been enlarged. He stated that the staff -is reconnending the sou-thern most r
area of small lots (72 x 125) be approved with ga maes ; and the proponent desires
approval of that area with medium sized lots (82 x 165) without garages instead ,
The Planner then reviewed the revised road system suggested by the staff which 1�
attempts to preclude through traffic from TH 101 to Dell Road but would facilitate
movement of traffic within the neighborhood. The road is recommended as 60 foot
right-of-way with a sidewalk along one side.
The Planner then stated the increase in size of the neighborhood nark allows
additional frontage on a public street, and that if the developer grades and

Mr Don Ness, site planner on the project, estimated the mini-park size at
1 .14 acres not the 1 .78 referred to on the plan and in the staff report, �.
and stated the 10 acre -neighborhood park size is also an estimation and subject •
to revision during development phase application, i
• Mr. Levitt •inquired how the proponent has responded to the Highway Department
letter regarding TH 101 . The Planner replied that.with the Highway Departments
of: Hennepin County, State of Minnesota, Eden Prairie, Minnetonka , Chanhassen, �
and Shorewoed, all involved in the road design, speed and geometries , that
it is difficult to speculate what the final outcome maybe.
Chairman Bearman asked if anyone in the audience had questions or comments. i

Levitt asked the developer why no garages are being requested for some of the =
lots. Mr. Steve Ryan, Zachman Homes , replied the reduction in overall purchase i
price A down payment for the home allows approximately 15% more of the buyers '
to qualify for purchase. (i .e. , home/lot selling for $61 ,000 requires down
payment of $1 ,600; the addition of a garage increase the selling price to
approximately $66,200 which requires a down payment of $2,600. i
Bearman inquired what the monthly payment is for an approximate mortgage of

$60,000 at 10%, Mr. Zac�man replied $600/month.
Levitt asked what size of homes Mr. Zachma n will be constructing. UcKman
repponded the basic plans are 864 6 960 square feet. +
Steve Ryan stated that although the request is for the possibility of some homes =
to be constructed without garages, the buyers still have ` the option to purchase ;
a garage with a home.

Mr. Dick Feerick spoke in favor of the proposal and the request to allow some
homes to be built without garages as it will fill a void in the housing market ;
which is between $70,000-100,000 today. I ,

Bentley asked if the Minnesota Dept. of Transportation' letter of 9-10-79# the _ j

Levitt stated the lotting concept is acceptable, but bel i eves the ordnance require-
ment of oarages reflects the community's desire to have homes constructed with
garages. -

Dan Johnson, Suburban Engineering, Presentee the request. He outl iiied the project's
location, proposed berming, access circulation, location cf utilities , and stated some
of the trees along the north and northwest sides of the lot will be retained.
Mr. Bob Schulz, Crown Auto Stores, Inc. . reported that the building
constrictionwould be similar to stores constructed in Wisconsin having face brick on

The Planner reviewed the staff report which recommend& approval but no variance from
City ordinances , and added that the staff was unable to evaluate a pedestrian circu-
lation system as the surrounding uses are unknown. }
