CALL MEETING TO ORDER Board Member Richard Anderson called the meeting to order . City Manager Jullie stated notice of this meeting had been properly published in the Eden Prairie News ; notice of the meeting was also included with each valuation notice sent to homeowners . Jullie said the purpose of this meeting was to allow any taxpayer to come before the Board of Review to request that the Board act to amend the classification or property valuation which the City Assessor and his Staff determined to be appropriate to that property. Jullie said that the Board of Review will reconvene at a later date to hear any appeals continued from tonight 's meeting . I I . ORDER OF BUSINESS A. Personal Appeals I . CECIL MA14TIN - 6585 Eden Prairie Road - #04-116-22 23 Ui050 tir . Martin asked for clarification of the City ' s appeal process . City Manager Jullie described the process to him. Mr . Martin said he thought it was unfair that he Board of Review 2 April 27, 1989 was being assessed this year for double the amount of the lot . He said only 1-112 acres is usable while the assessors said it was two acres. Pidcock asked about the value of the land. Flartin replied that it was $32, 000 last year and that it increased to $64, 000 this year . He said he would accept a $40,000 value on the land, but not $64, 000 . Tenpas asked how the property was configured. Martin said it was an old farmstead with swampland, County Rd . " 4 and Rainbow Drive and another residence around him. Martin said he had always paid a little larger amount on the land because it is somewhat larger . R City Assessor Sinell said the property is a 4. 7 acne site improved with a house. He said the total value of i the property is *84, 000, including land and buildings . The 1988 value was $65, 300. He said he would like to have this referred back to staff for further evaluation. Martin noted that most of the property is floodplain. MOTION: Harris moved, seconded by Pidcock, to refer the Martin property, PID 04-116-22 23 0050, to staff for further review. Motion carried unanimously. i 2. ROBERT DUNCAN - 9134 Fox Run Circle - #24-116-22 31 0104 Mr. Duncan was not present . MOTION: Pidcock moved, seconded by Harris, to refer the Duncan property, PID 24-116-22 31 0104, to staff for further review. Motion carried unanimously. 3. ROBERT HENDRICKSON - 17355 Pioneer. Trail - #20-116-22 33 0007 l #29-116-22 22 0004 Mr . Hendrickson was not present . DONALD ATKIt4S - 9580 Eden Prairie Road - #29-116-22 12 OOU6 Mr . Atkins said this .residence was on green acres for five year prior to this but they were taken off this year . He said they do farm 650 acres altogether . tie said his taxes will increase about $3, 000 this year. Board of Review 3 April 27, 1989 Sinell said they will be working with the County Assessor ' s office on reviewing green acres applications and would like to have it referred back to staff. MOTION : Pidcock moved, seconded by Harris, to refer the Atkins property, PID 29-116-22 12 0006, to staff for further review. Motion carried unanimously. 5. MICHAEL MCNAMARA - 10260-10270 Tarn Circle - #24-116-22 43 0038 Mr. . McNamara said he had discussed 1989 valuations with three realtor.. s in the last month and they said valuations went up in Eden Prairie about 17%. He said he thought the valuation should be the same as last year . Pidcock asked if this was a twin home. McNamara said it was a townhouse that backs up to Anderson Lakes Parkway and that he has been unable to sell it for some time . Harris asked what the valuation was last year. . McNamara said it was about $169, 000. Sinell said the value assigned was $174, 000 which, upon appeal, was reduced by the Local Board to $167, 000. On further appeal to the County Board, it was reduced to $158,000. He said the 1989 trended valuation was $163, 300. MOTION: Pidcock moved, seconded by Harris, to refer. the McNamara property, PID 24-116-22 43 0038, to staff for further_ review. Motion carried unanimously . 6. MICHAEL & LISA RYAN - 16792 Whittington Walk- #05-116-22 12 0029 Mr. . Ryan said he felt the assessment was too high as he has had considerable construction damage to trees on his property. He said the trees were valued at $31, 000 and he will have to take them down . He said a consulting arborist valued the trees at that amount . Tenpas asked if the value was based on replacement with identical trees . Ryan said that was true . Tenpas asked what the assessed value was in 1988. Sinell said it was $188, 500. Sinell said he would like this referred back to staff. MOTION: Pidcock moved, seconded by Harris, to refer the Ryan property, PID 05-116-22 12 0029. to staff for further review. Motion carried unanimously. Board of Review 4 April 27 , 1989 A Anderson asked Sinell if the presence of oak and p elm trees affected the valuation of property . Sinell said they have not been able to measure a difference in market value if some of the trees on a wooded lot die even though there was considerable expense to the owner to remove the trees. 7 . & RAYMOND STODOLA - 6625 Eden Prairie Rd . - 8. #05-116-22 41 0004 and #05-116-22 41 0068 Mr. . Stodola showed an illustration of his property . Lie said the valuation of the second parcel went from $5, 300 to $20, 000 and he was protesting that valua- tion since it is primarily floodplain. He said he purchased the land in 1960 for $22, 500 and this year the valuation has jumped $46, 600 in only one year . Sinell asked if he was dropping his appeal on the parcel with the house on it . Stodola said he would if he got the other. one .reduced. Tenpas asked what last year ' s valuation on the homestead property was . Sineli said it was $80, 400. f / MOTION: Tenpas moved, seconded by Pidcock, to adjust the valuation on the Stodola property, PID 05-116-22 41 0004, to $7, 000. Motion carried unanimously. MOTIO14: Harris moved, seconded by Tenpas, to sustain the Assessor ' s estimated market value on the Stodola property, PID 05-116-22 41 0068. Motion carried unanimously. 9. JOHN & ELLEN KERBER - 18424 Twilight Trail - #07-116-22 31 0042 Mr. . Kerber said this was assessed at $181 , 700 a year ago. He had an appraisal on his home for some refinancing and was told that his home would sell for $175, 000. He said this year ' s value went up to $194, 200. Another independent appraisal was done in the last week which showed the value of the property staying the same or actually going down from last year ' s value . He said he was protesting the use of new construction to determine resale values. Sinell said he would disagree that single family homes are going down or staying the same. He said he would like to have the property referred to staff and would like to see Mr. . Kerber 's most recent appraisal of the property. I b Board of Review 5 April 27, 1989 r Anderson asked if the valuations for loans have a bearing . Sinell said the appraisal is only as good as the date of the appraisal. fie said they would look at sales for. 1989 and compare it with his current appraisal . MOTION: Tenpas moved, seconded by Pidcock, to adjust the valuation on the Kerber property, PID 07-116-22 31 0042, to $181, 7UO. Motion carried z unanimously. i 10. FREDERICK & CATHLEEN KING - 9766 Archer Lane - 0 25-116-22 14 0060 Mrs. King said they paid $127, 000 {$130, 000 with- out points ) for their house in December. of 1987. She said the house needs a lot of work . She said last year ' s notice must have gone to the pr. iar owner as she would not have agreed with the $136, 500 valuation last year either. She said the 1989 value is $141, 000 . She said similar properties in the neighborhood are taxed less and she thought the house could be sold for. only $133, 000 at this time. ( Sinell asked if any of the repairs have been made . King said the house* is not in as good condition as others in the neighborhood and they have not done any repairs as yet . MOTION: Harris moved, seconded by Pidcock, to refer. the King property, PID 25-116-22 14 OD60, to staff for further review. Motion carried unanimously. 11 . JAMES BROWN - 11551 Riverview Road - #35-116-22 14 0001 Mr. . Brown said the estimated market value on his property went up 70% this year . He said the assessor told him it was the land value that went up. fie said he bought the property for less than $1, 000 in 1955. He said last year 's valuation was $118, 5O0 and this year 's is $201, 500. Harris asked how much land he has Brown said it is approximately 1. 3 acres. MOTION: Harris moved to refer the Brown property to staff for further review. Motion died for lack of a second . MOTION: Tenpas moved, seconded by Pidcock, to adjust the valuation on the Brown property, PID 35-116-22 14 U0O1, to $125,000. 13oard of Review 6 April 27, 1989 Sinell said properties in superior locations in Eden Prairie have seen dramatic rises in market value. He said reducing this property in this manner would mean it was comparable to homes in other areas that do not have such superior loca- tions . VOTE ON THE MOTION: Pidcock and Tenpas voted "aye, " Anderson voted "nay, " and Harris abstained. 14otion failed. Anderson said he opposed the. motion because values of the properties along the bluffs would have to be opened if the motion were to pass . Harris said she abstained because she did not have enough information to put a value on this property. Tenpas said the increases in property taxes have become ridiculous and the values along the bluffs are all inflated. He said people who have lived in this area for a long time suffer from a tax struc- ture based on the state level. ( Pidcock said the high values on the bluffs is just hearsay in her estimation as she has no concrete evidence of such high values. MOTION: Pidcock moved, seconded by Harris , to refer the Brown property. PID 35-116-22 14 0001 , to staff for further review. Motion carried unanimously . Pidcock said she would suggest that staff, in their review, keep in mind the sentiments expressed at the meeting tonight . 12 . WILLIAM QUIRK - 14308 Charing Cross - #03-116-22 32 0051 Mr. Quirk said he thought the valuation of his property should be $112, 100, based on a 6% increase in value from the 1988 value of $97,600 and improvements to the prop-erty for which he paid $8, 625. A Sinell said they have started a market comparison and would like it to be referred back to complete that comparison. MOTION: Pidcock moved, seconded by Harris, to .refer the Quirk property, PID 03-116-22 32 0051, to staff for (Y further. review. Motion carried unanimously . 13 . DONALD POUPARD - 6251 Beach Road - #03-116-22 11 0001 and 003-116-12 11 0002 Board of Review 7 April 27, 1989 Mr . Poupard was not present. MOTION: Harris moved, seconded by Pidcock, to refer the Poupard property, PZDs 03-116-22 11 0001 and 03-116-22 11 0002, to staff for further review. Motion carried unanimously . 14. DAVID & JEAN KELLEY - 10260 Summer. Place - a. #35-1.16-22 12 0012 Mr . Kelley said he objected to any increase in value to his home. He said he lives in a small development off Homeward Hills Road and is faced with the threat of expansion of Flying Cloud Airport and the continu- ing problem with the landfill . He said there are five homes in the development that are for sale and some have been on the market for almost a year. He said the value, at best, has stayed the same. Sineil said the property was purchased in 1987 for $419, 000. He said the home has 4240 square feet and has an attached three-car garage . He asked that it be referred back . MOTION: Pidcock moved, seconded by Harris, to refer the Kelley property, PID 35-116-22 12 0012, to staff for further. review. Motion carried unanimously. 15. LEONARD KODET - 6536 Eden Prairie Road #04-116-22 23 0039 Mr. . Kodet was not present . JEFFREY & PENNY TAYLOR - 9489 Abbott Court - #26-116-22 12 0020 The Taylors were not present. ANTHONY HIRT - 6533 Kurtz Lane - 'r04-liG-22 24 0049 Mr . Hirt said he questioned what constitutes lakeshore as his property was reclassified as lakeshore. He showed photographs of the area that was classified as a lake. k Board of Review £3 April 27, 1989 Sinell said this property classification hasn ' t been used before this year. , but the County Assessor insists that we now use the classification so he can measure whether properties that have a lake influence are treated the same as properties that don ' t have such an influence. He said the tax is calculated the same on both classifications . He said they checked with the Parks Department to see what bodies of water in the City would be classified as lakes . F Tenpas asked what the valuation was in 1988. Sinell said it was $86, 300 and this year it is $91, 500. MOTION: Pidcock moved, seconded by Harris, to refer the dirt property, PID 04-116-22 24 0049, to staff for further review. Motion carried unanimously. 16. WILLIAM BECKFELD - 6631 Kingston Drive - #03-116-22 32 0021 Mr . Beckfeld said his house is 32 years old and the valuation has gone up 21% in the last two years . He said the houses around them are valued at around $100, 000 and are larger in size than his. He asked Ir if someone come out and take a look at the house. f He said he would just like to have it valued equally l to the houses around him. MOTION: Tenpas moved, seconded by Pidcock, to refer the Beckfeld property, PID 03-116-22 32 0021, to staff for further review. Motion ce -ried unanimously. 19. PHILIP BLY 6 BRENDA URKE - 10720 Cty. Rd. #18 - #36-116-22 41 0010 Ms Ur.ke said their property was valued at $6, 500 in 1988 and is now valued at $27, 500 . She said it is under a conservation easement, thus they cannot do anything with the property other than pay taxes on it . Sinell said this property adjoins their homestead property and is in the floodplain area off Riverview Road. He said they have reviewed properties that are in the floodplain and would recommend that this valuation be reduced to $10, 000. Tenpas askew what happened to increase it from $6, 500 to $10, 000. Sinell said those properties were all in the revaluation area. In looking back to what the U.N. R. was willing to pay for floodplain when they had money available, they arrived at a value of 52, 000 per acre for the floodplain properties . Board of Review 9 April 27, 1989 r Harris asked if the land is developable. Sinell said it is not developable because of its location in the fluodplain ; however, it is a positive amenity and is usable by the owners of the property. MOTION: Tenpas moved, seconded by Harris, to adjust the valuation on the Bly & Urke property, PID 36-116-22 41 0010, to $6, 500. Motion carried unanimously. a 20. JOHN & LINDA HOFFER - 8711 Meadowvale Dr . - #21-116-22 22 0031 Mr. . Hoffer said paid $23,900 for his lot and in the past year, two lots nearby have sold for only a little more than that . Ile said there is no sewer and water in the neighborhood now but it will be coming. He said their property has been valued at $30, 000 which is the same as lots near his property that are much more desirable . He said he thought the value should be in the $25, 000 range. Sinell said this is a new home that was built and its value is $152,300 this year for both land and building. He asked that it be referred to staff for review. MOTION: Harris moved, seconded by Pidcock, to refer the Hoffer property, PID 21-l16-22 22 0031, to staff for further review of the lot valuation. Motion carried unanimously. 21 . & VIRGIL SEIFERT - 8390 Hiawatha Ave . - #16-116-22 43 22. 0002 and #21-116-22 11 0020 Mr. Seifert was not present . MOTION: Pidcock moved, seconded by Harris, to refer the Siefert properties, PIDs 16-116-22 43 0002 and 21-116-22 11 0020, to staff for further review. Motion carried unanimously . 23. W. J. LASESKI - 12155 Riverview Road - #35-116-22 24 0002 Mrs . Laseski said she is questioning the valuation of the lot that increased from $87, 000 to $152, 000 this year . She said it is about 325 feet wide, with a 150-foot easement for the NSP power lines going through the center of it . Tenpas asked how long they had lived in the house. Laseski replied ten years. Board of Review 10 April 27 , 1989 CSinell asked if this was the secondary parcel, not the parcel with the house . Laseski said it was. Sinell said this is a 17. 33 acre site that does have the the power line going through it. Fie said he would recommend the value be reduced to $122, 900 to take into consideration the reduction in value of the floodplain land to $2, 000 an acre. He said they would also recommend that the two other Laseski properties be reduced by $200 and $10, 600 (0011 and 0001 ) . Tenpas asked what the total increase from 1988 to 1989. Sinell said 90011 went from $46, 800 to $92, 300 and V0001 went from $214, 500 to $299, 500. He said the total increase was $195, 100 or 56%. MOTION: Tenpas moved , seconded by Pidcock, to refer the Laseski property, PID 35-116-22 24 0002, to staff for further review. Motion carried unanimously. 24 .& BOYD & JEAN JONES - 9416 & 9424 Clubhouse Road - 25 . #25-116-22 21 OU18 and #25-116-22 21 0019 Mr. Jones said he has his home for sale and has had no showings as yet. He said they pay almost double what the properties close to them pay. He said the resale value of doubles has gone down consider- ably since the tax adjustatents made them less attrac- tive . Tenpas asked if his property was on the golf course . Jones said it was but that several of the others he was talking about were also on the golf course. Tenpas then asked what the 1988 valuation was . Jones said it was $178, 000 and $133, 000. Tenpas asked if the units were identical. Jones said the $178, 000 property is nicer_ than the other one. Harris asked for clarification on the valuation figures . Sinell said 9416 Clubhouse had an estimated market value for. 1989 and 1988 of $171, 400. He said the smaller unit had a 1989 valuation of $158, 400 and was the same in 1988. Sinell saidd they have sold comparables and would dike the opportunity to complete a market review. DELAVAN & FRANCES DYE - 14405 Fairway Drive - #U9-116-22 41 0092 i Mr. . Dye said he happens to live on the floodplain in Fairway Woods where many residents had to pay for repairs from the flood in 1987 . He said some of the property is selling for $55, 000 today. He said he had asked for a .relief culvert under Mitchell Road in 1955 which was never. done. He said their property has depreciated in value because of the floodplain. Anderson asked if he was requesting a reduction in his valuation. Dye said he was . T1iOMAS & JACQUELINE SKELLEY - 6832 Charis Court. - #06-116-22 33 0074 Mr . Skelley said he was concerned that he had barely purchased the property before it was valued at $7, 000 to $8,000 more than he paid for it . He referred to an appraisal he got at the time he bought it . Tenpas asked if he had bought the home in June of 1988 with a purchase price of $164, 500. Skelley said that was correct . Sinell said this was a new construction appraisal in 1988 and stays the same as 1989. He said a market comparison done in 1988 after Mr. . Skelley filed a request for review of value with the county supported a value in excess of $172, 700. He asked that they be allowed to update the market comparison. MOT IOth Tenpas moved, seconded by Pidcock, to adjust the valuation on the Skelley property, PID 06-116-22 33 0074, to $164, 500. Motion carried unanimously . 28. JEFFREY ERICKSOC,i 10117 Phaeton Drive - ( #26-116-22 44 0018 Sinell said Mr. . Erickson notified the appraiser before the meeting that he would accept a reduction from Board of Review 12 April 27, 1989 $362, 300 to $337, 800. MOTION: Harris moved, seconded by Pidcock, to accept the staff recommendation to adjust the valuation on the Erickson property, PID 26-116-22 44 0018, to $337, 800. Motion carried unanimously. 29. MRS . HELEN F014L.ER - 10315 Riverview Road - 136-116-22 43 0003 Mrs . Fowler was not present . Sinell said he would recommend a reduction on this property to $311, 300 because it has a substantial portion in floodplan. MOTIO14 : Harris moved, seconded by Pidcock, to refer. the Fowler. property, PID 36-116-22 43 0003, to staff for. further review. Motion carried unanimously . 30. MARK & MARY JO KIMITC - 11961 Pendleton Court - #35-116-22 12 0071 1 Mr. Kimitch said that the location of his property near the dump, the airport and the power lines has adversely affected the value. He said they had an [ appraisal done last fall after they had finished their basement which determined they could realis- tically expect between $122, 000-$125, 000. Sinell said this neighborhood was revalued in 1989. lie said they would like this returned to staff for. review . Tenpas asked what the 1988 value for 1988. Sinell replied that it was $104, 700. MOTION: Tenpas moved, seconded by Pidcock, to adjust the valuation on the Kimitch property, PID 35-116-22 12 0071, to $114, 000. Motion carried unanimously. 31. JOHN & KIMBERLY POLLOCK III - 9563 Woodridge Dr . - #26-116-22 22 0063 Mr . Pollock said his property is adjacent to County Rd . 1 and a cemetery and he did not think the value should be increased the same as those around him. Eie said his house has been on the market for six weeks and has had only one offer at $100,000 . Sinell said the appraiser inspected the property today and would like to have time to complete the appraisal . { board of Review 13 April 27, 1989 MOTION: Pidcock moved, seconded by Harris, to refer. the Pollock property, PID 26-116-22 22 OOG3, to staff for further. review. Motion carried with Tenpas opposed. 32. EDGAR RAJEK - 6253 Har. bor.ough Ct . - #05-116-22 12 002G & #05-116-22 21 0042 Mr. . Rajek said they are the oldest residents of Chat- ham Wood. He said there is a freeway planned for this area . They also suffered a house fire in October 1986 � which required $100, 000 in repairs. Fie said they will have to disclose that repair work because of the dis- closure laws. He said the 1985 appraisal was $210, 000 and an $18, 000 increase this year was outrageous He said he believes the house is worth $210,000 at this time . Tenpas asked how many square feet were in Rajek ' s house. Rajek said it was 2650. Sinell said it was 2570 and that they have not been able to document through resales of property that the proposed freeway has lessened the values . j Tenpas asked what the 1988 valuation was . Rajek said it was $201, 100 on the major parcel . Pidcock asked if he thought $204, 000 would be fair . Rajek said he did. MOTION: Teripas moved, seconded by Pidcock, to adjust the valuation on the Rejak properties, PIDs 05-116-22 12 0026 & 05-116-22 21 0042, to a total of $210, 000 for the two parcels. Motion carried unanimously. 33. ROBERT VUJOVICH - 9697 Brigliton Lane - #25-116-22 11 0112 Mr. Vujovich said his property is a zero-lot line twin home. He said he objected to the adjustment for func- tional utility. He handed out a list of comparables for reference. Sinell said the appraiser had started a review of the property and they would like to complete that . Sinell asked him about his definition of functional value. Vujovich said he was looking for a value range. MOTION: Pidcock moved, seconded by Harris, to refer the Vujovich property, PID 25-116-22 11 0112, to staff for further review. Motion carried unanimously. 34. KENr MOLDE - 7040 6iillow Creek Road - 102-116-22 44 0016 0oard of Review 14 April 27, 1989 1 Mr. . Molde said he felt they are paying a penalty be- cause of an unusual design feature of their house. He said they have a concrete-block rumpus room that extends for two stories inside the house. He said their house is valued $40, 000 to $50, 000 higher than houses on Bryant Lake. He said his valuation is currently $327, 000 while most of the lakefront is in the $230, 000 to $270, 000 range . MOTION: Pidcock moved, seconded by Harris, to refer the Molde property, PID 02-116-22 44 0016, to staff for further. review. Motion carried unanimously. 35. CLIFFORD THOMPSON - 6559 Kurtz Lane - #04-llb-22 24 0050 I.9r. . Thompson said his problem was the same as Mr. . Hir. t 's in that his property valuation increased $13, 000. He said the assessor told hire the property was raised because it was lakeshore property. Fie said he 'has a 14-foot easement between his property and the lakeshor.e. MOTION: Pidcock moved, seconded by Harris to refer the Thompson property, PID 04-116-22 24 0050, to staff for further. review. Motion carried unanimously. 36. MARLOWE ANDERSON - 6254 Harbor.ough Court - 05-116-22 21 0040 Air. Anderson said they had just finished building the house. He said the square footage is an issue--the builder says it is 2143 but the house specs say it is 2300 to 2400 square feet. He said he thought there were errors in the evaluation of the property.
