HomeMy WebLinkAboutResolution - 91-16 - Procedure for Appointing Council Members - 01/08/1991 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 91-16 RESOLUTION RELATING TO PROCEDURES FOR APPOINTING A PERSON TO FILL THE VACANT COUNCIL POSITION FORMERLY HELD BY DOUGLAS TENPAS WHEREAS, Minnesota Statutes 9412 .02, Subd. 2a which authorizes the appointment of a person to fill a vacancy in the office of council member does not specify the procedures appli- cable to the making of such an appointment or specify when a "tie vote in the council" shall occur in the process . NOW, THEREFORE, BE IT RESOLVED BY THE EDEN PRAIRIE CITY COUNCIL: That the following procedures are hereby adopted for the appointment of a person to fill the vacancy in the office of council member formerly held by Douglas Tenpas pursuant to Minnesota Statutes §412.02, Subd. 2a. 1 . The Mayor and each council member may nominate two persons for the office. 2. The nominee who receives a majority vote of those voting . (three if four votes are cast) shall be the person appointed to fill the vacancy. 3 . Voting by the council to fill the vacancy shall be limited to the casting of a maximum of five votes (i.e. five rounds of voting) . 4. If no nominee receives a majority of the votes cast after five rounds of voting, it shall be deemed a "tie vote in the council" as those terms are used in Minnesota Statutes 5412 .02, Subd. 2a and thereafter the Mayor shall make the appointment of whomever person he chooses . RESOLVED FURTHER, that any rule or rules of procedure adopted by or applicable to the proceedings of this Council which are, or may be inconsistent herewith are hereby suspended and superseded by the procedures hereby adopted.
