POST OFFICE - EDEN PRAIRIE BRANCH WHEREAS, the U. S. Postal Service has applied for site plan approval of a branch post office for Eden Prairie on 5.4 acres, on property located at the west of Highway #169, east of the Columbine Road/Garden Lane intersection, to be zoned Office by Ordinance #26-90 adopted by the City Council on September 18, 1990; and, WHEREAS, the Planning Commission reviewed said application at a public hearing at its June 25, and September 10, 1990, Planning Commission meetings and recommended approval of said site plan; and, WHEREAS, the City Council has reviewed said application at a public hearing at its July 17,. and September 18, 1990 meetings; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF &DEN PRAIRIE, that site plan approval be granted to the U. S. Postal Service for construction of a branch post office facility, subject to the terms and conditions of that certain Developer's Agreement between the U. S. Postal Service and the City of Eden Prairie, dated September 18, 1990, for said branch post office facility. Frane, City Clerk • CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA • RESOLUTION#90-238 A RESOLUTION GRANTING SITE PLAN APPROVAL FOR U.S. POSTAL SERVICE FOR A LOCAL POSTAL FACILITY WHEREAS, the U. S. Postal Service has applied for site plan approval on 5.4 acres for construction of a local postal facility to be constructed on land located west of Highway #169, east of the intersection of Garden Lane and Columbine Road, legally described in Exhibit A, attached hereto, and made a part hereof, hereinafter referreed to as "the Property," and zoned Office by Ordinance #26-90; and, WHEREAS, the Planning Commission reviewed said application at a public hearing at its June 25 and September 10, 1990, Planning Commission meetings and recommends approval of said site plan; and, WHEREAS, the City Council has reviewed said application at a public hearing at its July 17, 1990, meeting; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE, that site plan approval be granted to the U. S. Postal Service for construction of local postal facility, based on plans dated September 13, 1990, attached hereto as Exhibit B, and made a part hereof, and subject to the following conditions: 1. Developer shall develop the Property in conformance with the materials revised and dated • September 13, 1990, reviewed and approved by the City Council on September 18, 1990, and attached hereto as Exhibit B, subject to such changes and modifications as provided herein. 2. Developer agrees to the performance and observance by Developer at such times and in such manner as provided therein of all of the terms, covenants, agreements, and conditions set forth in Exhibit C, attached hereto and made a part hereof. 3. Prior to release by the City of any final plat for the Property, Developer agrees to submit to the City Engineer, and obtain the City Engineer's approval of plans for streets, sanitary sewer, water, interim irrigation systems, storm sewer, and erosion control for the Property. Such storm sewer and erosion control plans shall also be submitted to the Watershed District for review. Upon approval by the City Engineer and Watershed District, Developer shall construct, or cause to be constructed, those improvements listed above in said plans, as approved by the City Engineer and Watershed District, in accordance with Chapter 12 of the City Code. 4. Prior to release by the City of any final plat for the Property, Developer agrees to submit to the Director of Planning, and to obtain the Director's approval of cross-access easement documents between the Property and the land to the south. Developer agrees to file said cross-access easement documents on the land to the south and on the Property with Hennepin County, and to provide proof of filing to the City, prior to City • issuance of any building permit on the Property. 5. Prior to release by the City of any final plat for the Property, Developer shall pay to the City the cost of the first three (3) years' street lighting on the public streets (including installation costs, if any, as determined by electrical power provider). 6. Prior to any construction or development on the Property, Developer agrees to apply to the City • Engineer, and obtain the City Engineer's approval of a land alteration permit for the Property. 7. Prior to issuance of any permit for grading on the Property, Developer agrees to submit to the Director of Planning, and to obtain the Director's approval of revised plans which reflect the following: A. Revisions to the landscape plan which include tree sizes according to City Code requirements in accordance with Chapter 11, Section 11.03, Subd., 3.G,. Such revisions shall provide for a maximum of 15-feet between the six-, eight, and ten-foot evergreens to be located along the north Property line. Developer acknowledges that the main concentration of evergreen trees shall be adjacent to the employee parking area, as depicted in Exhibit B, attached hereto. B. Revisions to the landscape plan which provide for plant materials adjacent to the fence to aid in reduction of the mass and length of the fence to be located on the Property, as depicted in Exhibit B, attached hereto. C. Revisions to the detailed fencing plan which reflect two-inch by six-inch materials for such fence construction and which reflect jogs in such fence designed to accommodate plant materials as discussed in item B., above. Upon approval by the Director of Planning, Developer agrees to construct and implement, or • cause to be constructed and implemented, such plans, as approved by the Director of Planning, in accordance with the terms and conditions of Chapter 11 of the City Code. 8. Prior to release of any building permit for the Property, Developer agrees to submit detailed watermain, fire protection, and emergency vehicle access plans to the Fire Marshall for review and approval. Developer agrees to follow all the recommendations of the Fire Marshall. 9. Developer has submitted to the City, and obtained City's approval of a plan for screening of mechanical equipment on the Property, as depicted in Exhibit B, attached hereto. Such plan does not include any rooftop mechanical units. In the event that Developer wants to add rooftop mechanical equipment to the Property, Developer agrees to screen such equipment in accordance with the terms and conditions of Chapter 11 of the City Code. 10. Developer has submitted plans for exterior lighting on the Property. Developer agrees that all such lighting shall be designed with cut-off, down-cast luminars and that no lighting shall be allowed off-site. Upon approval by the Director of Planning, Developer agrees to implement, or cause to be implemented, such exterior lighting plan, as approved by the Director of Planning, in accordance with the terms and conditions of Chapter 11 of the City Code. oil. Developer has not submitted any plans for signs to be implemented on the Property. Prior to issuance by City of any sign permit for the Property, Developer agrees to submit a sign plan to the City, and to obtain City's approval of said sign plan, prior to implementation of any sign on the Property. Developer acknowledges that such sign plan shall include details including colors, type of • materials, exact locations, sizes, method of attachment or mounting of signs, lighting methods, etc. 12. Developer and City acknowledge that it is Developer's intention to expand the use on the Property at some time in the future. At such time as Developer wants to expand such use, Developer agrees to submit to the City Planning Commission and City Council for review, and obtain the approval of the City Council for such expansion plans. Developer agrees to submit to the City such plans as may be required for City to perform such review, in accordance with accepted procedure in effect at that time. 13. Developer has obtained from the City Board of Appeals and Adjustments, a variance for front yard setback to parking along the Highway#169 frontage of the Property from the required 17.5 feet to allow for a 10 foot front yard setback to parking along such frontage. Developer acknowledges that mitigation actions for such variance includes construction of the fence referred to in item A, above, along with jogs in such fencing and implementation of plant materials as discussed in item A, above.
