MINUTES
EDEN PRAIRIE VILLAGE COUNCIL
Tuesday, October 14, 1969 7:30 P.M. Village Hall
Members present were, Mayor Osterholt, Councilmen, Haugen, Nesbitt, Redpath
and Lien. Also present was Village Attorney, N. Harlan Perbix.
I. MINUTES OF SEPTEMBER 23 and OCTOBER Z, 190
Add on minutes of Saoteml_)er 23rd:
C-Receipt of pet s ti cn in re: Kings Court 2nd Addition which was received
and placed on file. Mr. Redpath moved, Mr. Haugen seconded, that the
minutes of t;ie Septe+er 23rd meting as corrected be approved. Motion
carried.
Mr. Redpath moved, Mr. Haugen seconded, that the minutes of October 7, 1969
be approved as publ i shed. 14ot i an carried.
II. PRESENTATIONS
Mayor Osterholt presented a certificate to Sheriff Jack backing for achievement
at the Northwestern Traffic Institute. Present were Sheriff Don Omodt and
Captain Dave Mahr of the Sheriff's office.
III. ORDINANCES - NO. 135 and NO. _118
A - In re Ordinance Flo. 135, Mr. Lieb moved, Mr. Nesbitt seconded, that Sub.
17.4 of said Ordinance be changed to read as fol 1 ows: f
That notice shall be published at least 10 days before t;-e day of the hearing
and s:,walr be mailed to the next two adjacent owners of property to which the t
variance relates. This motion was carried unanimously.
Mr. Haugen moved, Mr. RedpatN seconded, that Sub. 19.4 of said Ordinance be
amended by changing the third sentence to read - 1111hen an amendanent involves
changes in district boundaries, a notice shall be mailed at least 10 days before
the day of the hearing to each property owner of affected property and property
situated whol ly or partly within 500 feet of the property to which the amend-
ment relates". The motion was carried unanimously.
Mr. Lieb moved, Mr. Haugen seconded, that Section 21, second paragraph be
changed by substituting - Planned Study District for Rural District. The
motion carried unani:rausl y.
Mr. Redpath moved, Mr. Liab sec.�nded, that all areas placed in the Planned Study
Di stri ct steal 1 revert, i f no change f s mad$, at the expi ration of the pres-
cribed Planned Study period to ton zone most closely resembling the zone
previously given to the property under Ordinance No. 8 and amendments thereto
and as more specificaily set forth in Appendix A which is made a part of
Ordinance Wo. 135. Thp moti oi) was carried unanimously.
After further discus% ;or time tihe Mayor asked for comments from the
audience, Mr. Redpath mc-.•e.d, Mr. Nesbitt seconded, that the rules that require
reading in full of Ordinance Wo. 135 be suspended. The motion was carried
unanimously.
Mr. Redpath moved, Mr. Nesbitt seconded, that Ordinance No. 135 be adopted at
the second reading and ordered published. On roll tali vote, ali members of
the Council voted Yes.
Mr. Nesbitt moved, Mr. Lieb seconded, that Ordinance No. 138 be approved for a
first reading. M,)tion carried.

IV. PETITIONS, REQUESTS AND COMMUNICATIONS
A. Re: Change of Name of Shady Oak Road
Leonard Uherka Appeared and spoke against the change. After discussion,
Mr. Nesbitt move5l, Mr. Redpath seconded, that the request be referred to the
Planning Co}nmissfon for study. Motion carried.
S. Don Anderson
Don Anderson appeared on behalf of his application for a Mining Permit. Mr.
Redpat:i moved, Mr. Nesbitt seconded, that Anderson's request be referred to
the Village Manager for study and report.
C. Carter and Gertz,_ Inc.
Mr. Redpath moved, Mr. Haugen seconded, that the request of Carter S Gertz
for On and Off-Sale liquor license be placed in the file.
0. Hennepin County Board
The Mayor indicated that the Village had been in receipt of a proposed
Hennepin County Hospital budget.
V. RECOMMENDATIONS AND REPORTS
A. 1970 Lawcon Application
Mr. Redpath moved, Mr. H ua gen seconded, that Resolutions No. 287 and 288
relative to Lawcon application be adopted. Motion carried.
S. Trebelhorn Property Division. Co. Rd. 4 South of Lake Shore Drive
Mr. Lieb moved, Mr. Redpath seconded, that Trebel horn"s division as recoimne+ded
by the Planning Commission be approved. Motion carried.
C. Hemerickson Property Division. Co. Rd. 1 !,lest of Cedar Forest
Mr. Zedpath moved, Mr.. Haugen'seconded, that the Hendrickson division as
recommended by the Planning Commission be approved. Motion carried.
0. Eden Prairie Body_. Building Permit Application
Application of Eden Prairie Body Shop was continued to a Spacial Meeting of
the Council to be held on October 21st.
E. Recreation Study
Mr. Lieb presented a study prepared for the Recreation Coemmission.
F. Meeting Schedule.
A meeting was set up for October 21st to review building bids and receive
utility studies.
VI. FINANCES
A. Audit of Claims
It was moved and seconded that Vouchers No. 6693-6794 be approved. Upon
a roll cast vote, all voted Aye.
B. Audit of Cash and Investment Reports Dated September 30 and 0�: 4, 1962
Tile Council reviewed the submitted reports. No action taken.
V11 . APPOINTMENTS
A. Human Rights Commission
MayorrOsterholt appointed Rev. Arthur Towne and Councilman Paul Redpath to
serve on the Human Rights Commission. Mr. Haugen moved, Mr. Nesbitt seconded,
that the Council confirm the above appointments. Motion carried.
B. Industrial Commission

Mayor Osterhol t appointed Donald Sorenson and Councilman Rolf Haugen to serve
on the Industrial Commission. Mr. Redpath moved and Mr. Lieb seconded to approve
the above appointments. Motion carried. i
