It appears that the control of set—up* is now set forth by
Minnesota Statutes Annotated, 340.14, Subdivision 3, which in general
provides certain hours for the operations of clubs and places permitting
set—gape, and ;betting s permit from the Liquor Central Cosmaissioner for a
period of one year to expire on July lot of each year upon the paymnt of
$100.00. In addition, the governing body at each village may inpose art
additional fee not exceeding 6300.00 per year. Apparently until this
section of the statute was adopted in 1961 there wars, xw rules regarding

The village council of Eden Prairie met in room 308 in the Eden
Prairie High School March 27, 1963 at 8 o'clock P.M.
Present Were:
Donald Rogers, Mayor Rolf Haugen, Treasurer
Al Bruce, Trustee Elmer E. Clark, Clerk
Alvin Bren, Trustee W. Harlan Perbix, Attorney
Kenneth Anderson, Trustee Archie Carter, Engineer
Many Visitors
ORDER OF BUSINESS:
The meeting was called to order by Mayor, Rogers Who called for the
reading of the minutes of the last meeting, also Zoning Board meeting.
No action was taken on recommendations of the Zoning Board by the village
council.
A notion Was made by Al Bruce that the special use permit requested by
Alexander Construction Co. to operate an asphalt or bituminous mix plant
y on the Sam Glen property on Baker Road and recommended for approval by the
Zoning Board be denied b the village council for the following f .r i''i8 y g wing reasons•
1. That the adjoining area residents and property owners have registered
a strong and concerted protest, 5
2. The lack of substantial benefit to the Village of Eden Prairie as a
Whole,
3. The wording of Section 5.1, part B, Section 5.2, Part B, and
Section 10, part 3 of the Eden Prairie Village Ordinance #8 which
leaves a considerable doubt as to the validity of this special use
permit as requested.
f.. The motion died for lack of seconding.
PETITION
A motion was duly made and seconded that the council accept the petition
of Alexander Construction Co. for a permit to use a bituminous mixing plant
in Sam Glen Estate Gravel Pit and the clerk was instructed to file same
pending further investigation when in operation. There were four (4) yeas
and one (1) nay.
Motion carried.
A motion was made by Alvin Bren and seconded by Kenneth Anderson that
the council accept the petition of 143 property owners and the clerk be
instructed to place same on file.
Notion carried.
PFiESTON-HAG�COa
The Sill-Park Industrial area planners presented aerial photos of the
Miller-Schmidt property zoned industrial. Their presentation and willingness
to cooperate With the council, the Planning Commission and Village Rngiaeer
was very gratifying to the council and the mayor complimented Mr. McQueen and
Mr. Haglin for their interest in our industrial area, it being the first Pro-
motion of the area.

MINUTES FOR CITIZENS ,LEAS
A motion was made that the village clerk send Mrs. Blacklock, secretary
of the Citizens League a ropy of the minutes of the council meetings.
Motion carried.
PADON DOWNS WATER
The water problem at Padon Downs Addition was referred to Engineer,
Carter to prepare a map of the area.
STATE PLUMHTXG ORDINANCE
A motion was made by Kenneth Anderson and seconded by Al Bruce that the
village council adopt the State Plumbing Code with a few minor changes.
Motion carried.
GRADER TIRE RE-CAP
A motion was duly made and seconded that Road Commissioner Ray Stodola
be authorized to have the tires on the village grader re-capped.
Motion carried.
MALT IQUOR
A motion was duly made and seconded that the village council adopt
ordinance #33 pertaining to malt liquor licenses and set-up change. Legal
opinion in clerk*s minutes.

�°- NOTICE gE_RE-24NING
A motion was duly made and seconded that the Planning Contission give
notice to all adjoining property owners of property being re-soned before
hearing.
Motion carried.
RECREATION
A motion was duly made and seconded that the village council authorise
the payment of $675.00 for a recreational director for a period of nine weeks.

WAGE INCREASE
A notion was made by Al Bruce and seconded by Kenneth Anderson that
street employees' wages be increased effective April 1. 1963 as follows:
Road Commissioner $475.00 Per Month
Other 425.00 n
Day Labor 2.25 Per Hour
Motion carried.
PLUMBING INSPECTOR
The Plumbing Inspector is to notify Property owners of culverts
necessary.
BLACK TOP SERVICE CO.
A motion was made and seconded that the clsrk be authorised to pay
Black Top Service Co. $3,740.00 village gravel claim and Semrad escrow
claim for $2.499.10 at once on account of being long past due.
Motion carried,

The date for viewing village roads was set for Saturday March 30, 1963,
council to meet at the village garage at 10 o'clock A. M.

ESCROW INTEREST TRANSFIJRR
A motion was duly made and seconded that Treasurer, Haugen be author-
ized to transfer escrow interest from the Escrow Fund to the General Fund.
Motion carried.
Meeting adjourned at 12:30 P.M.
