RE: Pautz vs. City of Eden Prairie, et al.
Judge Douglas K. Amdahl has dismissed the above entitled matter at the
end of plaintiff's case. I have already transmitted to you copies of the
Findings of Fact, Conclusions of Law and Order together with the supporting
Memorandum in this matter. Judge Amdahl has supported the action of the
Council in rejecting the application of February 11, 1975. In so doing, he
has indicated that there was concept approval in 1970 for a multiple
dwelling development on this property but further recognized the fact that
the multiple development should be consistent with the concepts proposed at
the time of the application in 1970. This basically would require if a
multiple dwelling approval is granted the phasing and construction would be
consistent with the ability of the City of Eden Prairie to provide adequate
and safe roads and services for the contemplated development. As you know,
we have been instructed to proceed forthwith to consider the application
of March 19, 1976. It is my understanding the application to be filed with
. us which will be considered by the City of Eden Prairie will be an application
that is a modification of the March 19, 1976 application. It is my under-
standing that the new application will be for the construction of town-
houses, none of which will be rental units. It would call for phased con-
struction over a three year period with approximately 70 units constructed
per year and would have some other features that might make it more palatable
to the adjacent homeowners.

Once that application is filed it should be handled through normal
processes each time at the earliest feasible hearing dates so that we will,
have complied with the Court's Order to proceed forthwith with consideration
of the application.
Since Judge Amdahl has taken the position that there has been a basic •
concept approval of a plan for development of that property on a multiple •

dwelling basis that would result in no greater density than single family
dwelling development would have provided and has recognized the ownership •
aspect as a necessary transitional buffer, it would appear to be incumbent
upon the City to give very careful consideration to the new application that
is filed. If the new application meets many of the objections raised as a
basis for the denial of the February 11, 1975 application, the Council must
have other compelling reasons from a public health, safety and welfare
point of view to justify denying the modified application. It is obvious •
that safety considerations in connection with traffic on Duck Lake Trail
carried a great deal of weight with the Court. Potential development of
the north/south parkway as the highway access to and from this development
if feasible, might become a key requir ent to avoid the safety hazard
problem on Duck Lake Trail. /
