RE: 1977 Community Development Program DATE: January 4, 1977 At the Parks, Recreation and Natural Resources Commission Meeting on January 3, 1977, the following projects were recommended: 1. Development of the Edenvale and Preserve Neighborhood Play- grounds like that which occurred at Prairie View this fall. 2. Any remainder to be used for Right-of-Way acquisition and increased construction costs on the County Road 4 Trail. 3. That the $19,000 from the 1975 year program be reallocated for the County Road 4 Trail. Attached is a copy of the memo the Commission used in their consideration of this matter. Eligible activities include: 1. Acquisition of land for nearly any public purpose. 2. Construction of facilities including parks, walkways, neighborhood facilities, historic properties, and senior centers. 3. Non-Federal share to match other grant-in-aid programs. Urban Hennepin County communities have funded the following kinds of Park and Recreation activities in the past: , 1. Park site studies • ( 2. Parkland acquisition 3. Park development 4. Trail/Bikeway Development 5. Landscaping (Dutch Elm Disease Replacement) 6. Historic site acquisition and development 7. Senior Citizen Center development Potential projects in Eden Prairie for the 1977 Funding include: 1. Acquisition of parkland--Kucher, Deaver, Raze, Bren, Cedar Hills, Hidden Ponds, Topview, Purgatory. 2. Development of park facilities--Edenvale, Preserve. 3. Trail Development--Co. Road 4 and Valley View Road Right-of-Way Acquisition and increased development costs. • 4. Landscaping--Forest Hills, Prairie View, Round Lake Park, Anderson Lakes (Dutch Elm Disease Replacement). S. Historic Site development--equipping the Historical 8 Cultural Center. 6. Misc.--rough fish cleanup in Staring Lake or a larger portion of Purgatory Creek. 3?09 MEMO • TO: Mayor Penzel and Members of the City Council THROUGH: Roger Ulsted, City Manager FROM: Carl Jullie, City Engineer DATE: 1/7/77 SUBJECT: Continued Public Hearing Heritage Road Sewer and Water Improvements I.C. 51-290 Pursuant to Council direction on December 7, 1976, we'have contacted Mr. R. D. Miller of the Minnesota Pollution Control Agency regarding his letter of July 16, 1976. Mr. Miller said that his letter was mis- interpreted and that he will be sending a followup letter to clarify his findings and recommendations in this matter. He said that the sample was taken in the front yard of 7640 Heritage Road and that the sample could have been affected by animal wastes. Other samples were ' taken in the back yard area of water seeping out of the ground, but there was no indication of sewage pollution in these samples. Our inspections department has taken dye tests during the past week and we will report the results to the Council on Tuesday evening. CJJ:kh &c' JAtN E 97 7 • January 3, 1977 TO THE MAYOR AND MEMBERS OF THE CITY COUNCIL: The following are concerns and questions of the residents presently living on Heritage Road regarding the proposed City Sewer, Water and Street Project (51-290): 1. It was noted at the hearing that the water main would be a 12" line. Are the assessment figures for the parcels based on the cost of a 12" line, when it would not take this size water line for the few parcels involved? 2. The builder agreed at the time the Council approved the plat for Round Lake Estates that he would be responsible for water and sewer. Why are the residents to the west of Heritage Road included in the assessment? 3. All water and sewer systems, as far as the residents are aware, are functioning properly; therefore, there is no need for City water and City sewer at this time. 4. Cost of present systems are reflected in the cost of each home which are in and paid for. New systems would be ad- ditional costs to property owners. 5. On the Preliminary Assessment Roll received from the City, it indicates that there will be a $1,000 credit to the builder. The residents question who will pay the $1,000. • 6. Due to what has transpired, for example: a) the involvement of the Metro Sewer Board in reference to Lot 10; and b) the petition in Park Circle generated by the builder, the residents feel that the methods of the builder are questionable. 7. The Parks, Recreation and . Natural Resources Commission recommends that the application be approved with the construction of the following facilities: beach improvements, boat launch and ramp parking area, trails, fishing pier, four tennis courts with lights and community playfields for use in adult sports activity including four fields for youth baseball and soccer, four fields . for adult softball, and one regulation size baseball field. The Preliminary Application was for a $200,0O0 project which included lights for 2 of the softball fields and the regulation baseball field, plus sanitary facility improvements (water for concessions and irrigation). CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 77-2 RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN APPLICATION FOR GRANTS TO DEVELOP RECREATIONAL LANDS AND OPEN SPACE UNDER THE PROVISION OF THE FEDERAL LAND AND WATER CONSERVATION FUND ACT AND THE STATE NATURAL RESOURCES FUND ACT WHEREAS, the Eden Prairie City Council is in agreement with grants for acquisition and development of open space under the provision of the Federal Land and Water Conservation Fund Act and the State Natural Resources Fund Act; and WHEREAS, the Eden Prairie City Council is in agreement with the provisions of the form for such application, now therefore, BE IT RESOLVED, that the City Manager be authorized and instructed to • make application for grants under these programs. Penzel, Mayor • ATTEST: SEAL • • • 37i9 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 77-3 RESOLUTION AUTHORIZING THE FILING OF APPLICATION FOR GRANTS TO DEVELOP RECREATIONAL LAND AND OPEN SPACE UNDER THE PROVISION OF THE FEDERAL LAND AND WATER CONSERVATION FUND ACT AND THE STATE NATURAL RESOURCES FUND ACT WHEREAS, The Land and Water Fund Act and the State Natural Resources Fund Act provides for the making of grants to assist local public bodies in the acquisition and development of outdoor recreation projects; and WHEREAS, the City of Eden Prairie desires to develop certain parklands known as Round Lake Park, which land is to be held and used for permanent open space and recreation; and WHEREAS, Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and the regulations promulgated pursuant to such act by the Secretary of Interior and contained in (43 C.F.R. 17) effectuating that title provides that no person shall be discriminated against because of race, color or national origin in the use of said land and facilities acquired and developed; now therefore, • BE IT RESOLVED, by the Council of the City of Eden Prairie: 1. That an application be made to the Office of Local and Urban Affairs of the Minnesota State Planning Agency for a grant from the Federal Land and Water Conservation Fund in the estimated amount of $67,000 and a grant from the State of Minnesota Natural Resources Fund in the estimated amount of $33,500. 2. That the City Manager is hereby authorized and directed to • execute and to file such application with the State of Minnesota Office of Local and Urban Affairs of the State Planning Agency, to provide additional information, and to furnish such documents as may be required by said agency to execute 'such contracts as are required by said agency and to act as the authorized correspondent of the applicant. • 3. That the proposed development is in accordance with plans for the allocation of land for open space and recreational uses • and that should said grant be made the applicant will develop • and retain said land for use designated in said application and approved by the Office of Local and Urban Affairs and the Bureau of Outdoor Recreation. • • • • • 37aa Resolution No. 77-3 4. Penzel, Mayor ATTEST: • Rebecca Quernemoen, Deputy Clerk SEAL 313I CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA POLICY STATEMENT • Regarding Power and Utility Construction For any Outdoor Recreation project receiving financial assistance under the Land and Water Conservation Fund Act of 1965, the City Council of the City of Eden Prairie agrees to the following policy statement: "It is recognized that electrical power and communication services are an essential requirement for the economical and efficient operation and main- tenance of public service facilities in state, county, and municipal Outdoor Recreation Areas. Communication lines are necessary in the interest of public safety. It is our policy in planning for these services to arrange • and provide them with a minimum of intrusion on the natural features of the area. In order to accomplish this, the following factors must be given every consideration: 1. Only those utilities necessary for the public accommodations, maintenance and operation of an Outdoor Recreation Area shall be permitted within the Area's limits. Utility lines extending through Area properties • to private properties beyond shall be avoided and eliminated wherever possible. 2. Every effort shall be made to provide underground-type services for all utilities where practical. 3. Where underground construction of electric power lines is impossible and pole structures are necessary, they shall be located so as to be thoroughly screened from Recreation Area roads and/or foot trails. "Wherever possible, overhead communication lines shall be combined with overhead structures to minimize the amount of clearing necessary to provide • these overhead utilities. In those instances where such overhead lines cannot be screened from the roadway right of way, they shall be so placed that they will blend with the background--that is, they will run along the tree-line where their intrusion would not be readily observable. In open prairie areas where overhead construction cannot be avoided, there will be every attempt made to utilize topographical features to minimize the intru- sion of transmission line and pole structures." • "In all concentrated use areas, that is, picnic grounds, campgrounds, child- ren's camps, beach and boating areas, all electric power service under 2,300 volts and all communication cables shall be underground between points of service. • Dated Applicant-Recipient City Manager City of Eden Prairie, 8950 Eden Prairie Road Eden Prairie, Minnesota 55343 332 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA The City of Eden Prairie (hereinafter called "Applicant-Recipient") HEREBY AGREES THAT IT will comply with Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and all requirements imposed by or pursuant to the Department of the Interior Regulation (43 CFR 17) issued pursuant to that title, to the end that, in accordance with Title VI of that Act and the Regulation, no person in the United States shall, on the ground of race, color, or national origin be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which the Applicant-Recipient receives financial assistance from Bureau of Outdoor Recreation and Hereby Gives Assurance That It will immediately take any measures to effectuate this agreement. If any real property or structure thereon is provided or improved with the aid of Federal financial assistance extended to the Applicant-Recipient by Bureau of Outdoor Recreation, This assurance obligates the Applicant-Recipient, or in the case of any transfer of such property, any transferee for the.period during which the real property or structure is used for a purpose involving the provision of similar services or benefits. If any personal property is so provided, this assurance obligates the Applicant-Recipient for the period during which it retains ownership or possession of the property. In all cases, this assurance obligates the Applicant-Recipient for the period during which the Federal financial assistance is extended to it by Bureau of Outdoor Recreation. • THIS ASSURANCE is given in consideration of and for the purpose of obtaining any and all Federal grants, loans, contracts, property discounts or other Federal financial assistance extended after the date hereof to the Applicant-Recipient by the bureau or office, including installment payments after such date on account of arrangements for Federal financial assistance which were approved before such date. The Applicant-Recipient recognizes and agrees that such Federal financial assistance will be extended in reliance on the representations and agreements made in this assurance, and that the United States shall reserve the right to seek judicial enforcement of this assurance. This assurance is finding on the Applicant-Recipient, its successors, transferees, and assignees, and the person or persons whose signature appear below are authorized to sign this assurance on behalf of the Applicant-Recipient.
