You will notice that in the resolution that the land is being conveyed to ' the City on the condition that it be maintained for passive recreation, wildlife management, and trails. I have spoken with Mr. Perbix, and he indicated that it would be possible to have adoption of this resolution considered at the December 28, 1976 City Council meeting. The Kaerwers would appreciate it if you could schedule this resolution for consideration at that meeting so that the City can formally accept the gift before the first of the new year. Sincerely, iisan Haigh - Law Clerk SH:mbd Enclosure cc: Howard and Barbara Kaerwer 3 631 RESOLUTION NO. 1231 CITY OF EDEN PRAIRIE RESOLUTION WHEREAS, the City of Eden Prairie intends to permanently maintain the property along the Nine Mile Creek Floodplain as an environmental area for passive recreation, wildlife management, and trails; and WHEREAS, Mr. and Mrs. Howard and Barbara Kaerwer . . have donated land along the Nine Mile Creek Floodplain for the aforementioned purposes; BE IT RESOLVED THAT the City of Eden Prairie does hereby accept from Mir. and Mrs. Howard and Barbara Kaerwer the approximate 1.3 acres of land located along the Nine Mile Creek Watershed In the TOpview Acres 3rd Addition of Eden. The issuance of the license was held up by the City Council because of the delinquency of real estate texts on the Golf Course. The clubhouse is situated on a 31 acre parcel including several of Edenvale's fairways and greens and the driving range. Edenvale, Inc. is delinquent in payment of real estate taxes on this and other portions of our property not by choice but because of the unavailability of funds to pay these at this time. We have been bringing parcels current as we sell and funds become available to pay these delinquencies. The revenues derived by the Golf Course have been subsidizing our overall operating budget for the last two years. We hope to pay a portion of these delinquent taxes out of operating income from the course next summer if possible. In the event a 3.2 beer license is not issued, it will seriously jeopardize our golfing and restaurant operation, not because the beer generates a substantial profit but because it is a desired service to our customers. We operate the restaurant at a loss from October through May as a service to our customers and to the people in Eden Prairie. The cross country ski operation also operates at a loss, but is provided as a desireable service to Eden Prairie. This service is also donated at no charge to the Eden Prairie public school system. The high school has been using the trails and clubhouse for the last 3 years at no charge.
