J. ! • • • • • - • . ; I Staff Report-Ziegler Inc PUD -4a- Sept. 3, 1976 The Smetana Lake Study approved by the City Council in 1974 recommended a slight modification of the 1968 Guide Plan taking Into account many changing conditions since the '68 plan. The land use for the western half of the Ziegler property was indicated to be residential or a capatible use with the existing terrain of woods , knolls and lowlands. The eastern half of the site was shown as industrial or highway commercial uses adjac&it to the Co. Rd. 18/ Shady Oak interchange. Significant realignment of the major roads serving the Smetana Lake Arcs was envisioned. A relocation of Valley View Road between the Major Center Area and Shady Oak was recommended. Also closing of the present Washington Avenue access to Shady Oak in the future would facilitate safer and better traffic movement. The city and county have proceeded with public improvements necessary to implemcnt the Smetana Plan through extension of sewer and water as well as construction of the Valley View interchange. Smetana Plan TransTortation System • Figures X and Y illustrate the Ziegle r I n c o r p o r a t e d s i t e a n d the impact of the road systems on the d i v i s i o n o f t h e p r o p e r t y . Figure X shows the major road system f o r t h e t o t a l 1 , 0 0 0 a c r e Smetana Lake Sector and the alternate l o c a t i b n s f o r t h e V a l l e y View Road and Co. Rd. 61 intersection . Location A is the Ziegler proposed road alignment, whereas A re p r e s e n t s t h e m o s t d i r e c t connection. Figure Y illustrates the impact of alt e r n a t e s A and B on the Ziegler Inc. Plan at a l a r g e r s c a l e . The city objective is to provide the r i g h t - o f - w a y f o r f u t u r e new roads ( Co. Rd. 61 & Valley View R o a d ) , i n t h e S m e t a n a Sector. The city expects to work wi t h e a c h l a n d o w n e r i n resolving conflicts created by public r o a d n e e d s a n d t h e l a n d - owner's development plans. Ziegler's development plan is an example of such a compromise solution t o m e e t b o t h p u b l i c a n d private requirements. Valley View Road location B ( Figures X a n d Y ) , w o u l d b e t h e preferred city alignment , whereas A i s t h e a l i g n m e n t p r e f e r r e d by Ziegler. There is no question B is m o r e direct and requires less right-of-way , however, Ziegler does n o t b e l i e v e A m e e t s their site design requirements, hence A l t e r n a t e A . Based upon Ziegler's dedication of th e n e c e s s a r y r i g h t - o f - w a y both A and A will provide a reasonabl e c o n n e c t i o n f o r n e w Valley View Road. If the city were to purchase the righ t - o f - way , then B would be the preferred a l i g n m e n t b e c a u s e i t i s a more direct route with less right-of-w a y . Staff Report-Ziegler Inc Pud -5- Sept. 3, 1976 4. City of Edina Edina's property east of Washington Avenue is almost completely developed with industrial and office uses. Edina will require access to Shady Oak Road and Co. Rd. 18 . Edina, at this time, does not wish to connect the residential areas east of Co. Rd. 18 to Valley View Road at the Valley View Road / Co. Rd. 18 interchange. At a future date such a connection may be desirable and might be made to allow western Edina residents access to the employment and commercial areas around the MCA in Eden Prairie. S. Adiacent Owners Mason/Astleford/Carter The property, approximately 150 acres, lies west and north of the Ziegler site. The property owners are aware of Ziegler's proposal and are in favor of the development. The owners are interested in the location of Shady Oak Road as it affects their property and the access provided to the residential areas from the relocated Valley View Road on the Ziegler plat. The owners envision future residential development in the morraine and /owl and areas and industrial development after mining is completed along Shady Oak load. Hello The staff has had conversations with engineers representing Mr. Helle relative to concerns about the adequacy of Valley View/Shady Oak Road alignment. The Norseman Industrial Park is developing and the industrial property west would be available for development in the near future. The Balfanz property is being marketed for multiple family residential development . at this time. Wilson Learning/other Peveloped Industrial Uses The adjacent industrial users have not communicated any comments to the city regarding the Ziegler plan. The staff would recommend the planned unit development be apprc,ved based upon the proposed land uses' and road systems. That the 57 1 acre PUP include a mixture of future residential, office and industrial land uses generally described in figure land explained as follows: site a. The 14. acri. site be used for 1-5 Industrial and is the location of the Ziegler office/industrial site. Site a would have modified setback requirements and provision of screened outside storage limited to lift trucks and commercial vehicles would be permitted. These vari- ances are appropriate due to the new road locations for Shady Oak and Valley View , and the commitment by Ziegler to dedicate the right-of-way to Hennepin County and/or the City of Eden Prairie at the time of platting. site h. The outlot of 12. acres is zoned and used for industrial development under the provisions of the 1-5 District . Depending upon relocation of Washington Avenue, possible rezoning to Highway Commercial , or 1-2 Park District might be anticipated to accommodate the modified road locations and parcel size. Setback variances from those of Ordinance 335 may be appropriate depending upon road relocations and future platting. site c. The out lot defined by the sewer easement and new Valley View Road would beappropriate for Office combined with limited industrial and would make use of the wooded knoll on the south property line. The industrial office use would be appropriate if it can be designed to work with the hill and existing wooded areas. VrA V7-7. y/r J. 1:•1 \ Staff Report-Ziegler Inc BUD -10- Sept. 3, 1976 The planned unit development for the Ziegler site is based upon new road systems to be built through the Ziegler property. Ziegler's plans accommodate new, Shady Oak Road, ( a. county arterial street ) requiring 80-100 feet of right-of-way and new Valley View Road ( a county jurisdication collector), requiring 80 feet of right-of-way with flared intersection at new Shady Oak Road accommodating turning lanes. An access road west from new Valley View Road will provide access to the residential areas , sife e, figure 1. The planning staff shows a proposed align- ment for Washington Avenue north of new Shady Oak Road . Such an alignmcnt would allow development of a service commercial parcel between Co. Rd. 18 and the providing an excellent connection for existing Washington Avenue. The exact alignment of a connection through the Ziegler property is not known at this point, but is illustrated as an alternative for consideration when Shady Oak Road is extended and the land use on parcel b is determined. If Washington Avenue is dead-ended north of Shady Oak, a connection with new Shady Oak will be made north of Wilson Learning and south of the Mork Building ( Figure 2 ). The staff would recommend Ziegler provide the right-of-way dedica- tion for new Shady Oak Road and new Valley View Road at the time of platting, not to exceed one year from the date of PUO approval. The staff would further recommend that the assessment for road construction would take into account the existing city policy regarding M.S.A. or major streets, whereby the assessment for the normal industrial or residential street would apply to the adjacent properties and that the extra costs of the road would be made up through county or state aids. Additional credits for grading and right-of-way preparation would also be considered at the time of assessment: FIRST PHASE ZIEGLER SITE DEVELOPMENT Staff Recommendations The 144. acre site will provide Ziegler the necessary space for their first phase development and limited expansion capabilities. Because of the nature of the business, screening and landscaping of any parking and/or storage areas for lift trucks and over the road trailer / tractor units should be adequately buffered from adjacent uses. To accomplish the screening, earth forms fencing and landscaping may be necessary. Staff Report-Ziegler Inc PIM Sept. 3, 1976 The proposed plan provides only 20 feet for screening and buffering between existing Valley View Road and the parking manuvering area, and 20 feet along the proposed new Valley • View Road. To accomplish the 10 foot earth berms anticipated would require a 1:1 slope without extending to the curb line of Valley View Road. The staff believes that specific detail design work with Ziegler's architect and landscape architect will be necessary to accomplish the desired screening landscaping of the proposed site plan. The staff believes some modifications to the site plan are needed to accomplish the objectives of 'the 'city and Ziegler. . The location of the storage,testing , cleaning building adjacent to existing Valley View Road, only 30 feet from the property line, is in the staff's opinion, very tight and might create problems relative to noise for the residential homes west and south of the site. The location of this structure, as was originally proposed to the north along Valley View, would also provide the site with a little more breathing room around the main buildiligs. Also, the building plan submitted indicates garage doors needed on three sides of the structure which could not be accommodated at the present location. The grading for tile first phase operation is basically consis- tent with that of the approved mining application and will lower the site approixmately 13 feet. The 144 acre first phase site should be smbjest to the normal park cash in lieu of land fees for only that portion to be developed . SUMMARY: RECOMMENDATIONS l. The staff would recommend approval of the planned unit development for the approximately 57 acres • of Ziegler's site consistent with the recommenda- tions of this staff report. 2. The staff would recommend that the first phase of approixmately 11 acres be granted a building permit subject to changes in the preliminary site plan as discussed in the staff report. 3. That Ziegler submit a preliminary plat and final plat for the pud within 1 year from the date of pod approval . The plat to dedicate road right- of-way for Co. Rd. 61 and new Valley View Road as shown on their brochure to the City of Eden Prairie with sufficient right-of-way to accommodate channeli:ed intersection at the Valley View/Co. Rd. 61 intersection. MINUTES EDEN PRAIRIE PLANNING COMMISSION Monday, August 23, 1976 IV. PETITIONS .AND REQUESTS A. Ziegler Incorporated, preliminary discussion on Ziegler's proposed pud of approximately !,8 acres of industrial and commercial uses. The site is located in the northwest quadrant of Washington Avenue and Valley View Road. The planner outlined the location of the proposed 38 acre pud and road alignments within the Smetana Lake Sector. He reported utilities are in and available. The planner then reviewed the processes Ziegler could follow: I. Zoning variance request before Board of Appeals and Adjustments with appeal possible to the Council. 2. POD request before Planning Commission and Council with possible zoning to 1.44.flern1 ( Mr. Bettis, Vice President Ziegler, stated they would like to present the proposal to the commission, receive their suggestions on which process to follow, and then return in two weeks for the next commission meeting. He stated the initial building phase would be a 50,000-60,000 square foot building for the sale and support of catepillar products, and would not look like their property at 94th Street and 35W. It is expected that 90% of the equipment storage will be inside, but it is possible to have 1-3 trucks stored outside at one time. He said they intend to be good neighbors,. display the machinery in an, attractive manner and screen and fence the necessary areas. He reported they have had meetings with Hennepin County in relation to the roads and the county has basically accepted their plan. Lynch questioned if the testing of the equipment would present a noise problem. Mr. Bettis replied they will be using industrial silencers . Pauly inquired if the acoustics of the building would also alleviate noise. Mr. Cording, architect for the project, stated the heavy concrete or block type building they intend to build serves in itself as a sound barrier. Mr. Cording then distributed photos of buildings of similar construction that Ziegler has throughout the country. Mr. Beat man asked if Ziegler presently owns the 58 acres. Mr. Bettis stated the porchase is contingent on rezoning and approval of the pud. Sorenson asked if Ziegler would be using the 17 acres to the west . Mr. Bettis replied negstive. Sundstrom asked how many trailors would be parked in the southwest corner of the site. Mr. Bettis replied 9W,. of the tractors coming in for service come without trailers, hut it is possible to have 3-4 traitors On the lot at one time. Unapproved 7:30 PM City Hall September 14, 197 6 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 1187 RESOLUTION APPROVING 1976 SPECIAL ASSESSMENTS WHEREAS, pursuant to proper notice duly given as required by law, the City council has met and heard and passed upon all objections to the proposed assessments for the following improvements, to wit: (See Exhibit A attached) NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE: 1. Such proposed assessments are hereby accepted and shall constitute the special assessment against the lands in the final assessment rolls, and each tract of land therein inc luded is hereby found to be benefitted by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments ex- tending over a period of years as shown on Exhibit A, the first of the installments to be payable on or before the first Monday in January, 1977. Subsequent installments shall bear interest at the rate of 8 percent per annum. No interest shall be charged if the entire assessment is paid on or before November 10, 1975. 3. Resolution No. 1176 is herein amended to include the assessment data of this Resolution No. 1187. 4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the proper tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
