Redpath, Councilmen Nesbitt, Cosmano and McCul 1 och and Councilwoman Joan Meyers. Al so present was Village Manager, Robert P. Heinrich, Village Attorney, W. Harlan Perbix, Clerk, Edna M. Holmgren, Finance Director,, John D. Franc, Assessor, Kenneth W. Chambers and Engineering Asst., Eugene Schuman. I. TRUNK SEWER AND TRUNK WATER ASSESSMENT HEARING The Mayor opened the hearing, then the Village Manager reviewed and presented language and graphics for both the sewer and water trunks. He presented trunk system costs and expected revenue, also rates and charges contained in Resolution No. 425 and Resolution No. 568 amending No. 425. He then reviewed the resolution on policy position on financing sewer and water utilities. The Mayor then asked for questions and/or cements from the floor. Dave Osterholt, former mayor asked for a reason for changing policy on trunk charges, the omission from the original policy of a provision for defered payments to owners of property assessed only for trunk benefit. He stated that the Council had adopted this policy a year ago and they felt it was a good policy. The Mayor replied that the staff recommended the amenchents as the only feasible means of financing the system. Mr. Osterholt added that he was still concerned about the burden on elderly residents who live on a fixed income. The Village Manager replied that a state law prevents deferral of payments for the elderly. Mr. Osterholt then stated that he felt that there are alternate ways to finance trunk sewers and thought that the Council should consider other plans. Mr. Loren Irvine stated that he felt the residents were subsidizing future developer's projects by providing a deferral of assessment on tracts that developers plan to plat, subdivide or connect to the system at a later date, up to 1977. Mr. Jerry Miller, Larry Hanson and Howard Kaerwer, all in Topview Acres felt that the amendment was not fair to the owner of five to eight acres of land. Mr. Miller charged that the amendment could force people to develop their land, also added thatZ6artment dwellers should have to pay the full REC charge. The Village Manager expressed the Council's concern for the owner of several acres who cane to the Village in hopes of having land around them and did not plan to subdivide. He further stated that because of development and land costs the Village has no real alternative but to assess on possible eventual use. He stressed that the policy actually shifts the burden from the single REC to future development. Kucher, 16817 West 62nd Street, Eden Prairie who is the (water of parcel 02400 and #3220 in Section 5. She stated that she felt no determination of benefit to these properties had been mode and that tre it should be eliminated from the asses t a his time. The Mayor stated that he felt she was making an unwise bit that the Council would take into consideration at the time of futt r ci ii on. Finance Director, John Frane stated that there were many wa y s of financing, system access char g es was one but that any of them were risky other than assessment. He stated that he felt that the Villa g e was taking the middle course. Road stated Mrs. Russell Lawrence, Sunnybrook/that she felt the Villa g e was doing a good j ob of planning , not like the surroundin g suburbs have grown hodge 1 podge. She stated that population g rowth was movin g towards Eden Prairie ,so .• 1 and that there were few areas left that could plan as tiny ne„ tossr rnworm. On roll call, all voted a y e. Motion carried. III. LATERALSEWER AND WATER ASSESSMENT - THE COVE. Resolution No. 583. Project SAN 70-1-19. The Mana g er reviewed and presented the lateral sewer and water assessment pro j ect in The Cove. on, President of Edenvale Corp. stated that the home owners vwector• lubsidizing the multiple dallin g and that the developers would ••nnrnidin g all trunk charges. There being no further comments from the floor, Mr. Cosmano made a motion to continue the hearin g on trunk sewer and water assessment until October 10th Council meeting. Mr. Nesbitt seconded. All voted the re g ular a ye. Motion carried. II. LATERAL SEWER WATER ASSESSMENT - PARADISE VALLEY. Resolution No. Protect SAN 71-145 and VTR 71-2-25. The Manager reviewed and presented the lateral sewer and water k project Council Meeting September 25, 1972 Page Three There being no questions and/or comments, Mr. Cosmano made a motion to close the hearing and adopt Resolution No. 583 approving assessments in The Cove as follows: Developed Lot Undeveloped Lot Lateral Sewer 1,224 1,633 Mr. Nesbitt seconded. On roll call, all voted aye. Motion carried. IV. LATERAL SEWER AND WATER ASSESSMENT - TOPV1EW ACRES. Resolution No. 584. project SAN 71-1-24 and WTR 71-2-24. The Manager reviewed and presented the lateral sewer and water assessment project in Topview Acres. A resident from this area questioned how the cost is computed when the job is not completed. The Finance Director, stated that he felt that all costs had been taken into consideration and that if the assessment were delayed it would cause an increase in cost to the property owner because of additional interest expense for another year. Councilmen Nesbitt asked why the REC's were not the same for sewer and water, Mr. Franc replied that some of them were hooked directly into the trunks. There being no further comments and/or question, Mrs. Meyers made a motion to adept Resolution No. 984 approving lateral sewer and water assessments in Topview Acres as follows: Developed Lot Undeveloped Lot Lateral Water 551 734 Lateral Sewer IA& lani 1,835 2;446 Mr. McCulloch seconded. On roll call, all voted aye. Motion carried. V. LATERAL SEWER AND WATER ASSESSMENT - EDENVIEW 2ND. Resolution No. 585. Project SAN 71-1-16 and VTR 71.2-16. The Manager reviewed and presented the lateral sewer and water assessment project in Edenview II. A resident from the area asked if all of the pipe was installed for the water. The Village Engineer replied that it was but that the easement for the Age to carry the water was some ways away. A resident on Eden Prairie/in the area of two homes not being served at this time asked when utilities would be available. The Manager stated that no plans were being made at this time for installation. There being no further question and/or comments, Mr. Nesbitt made a motion to close the hearing and adopt Resolution No. 585 approving lateral sewer and water assessments in Eden View II as follows: Developed Lot Undeveloped Lot Lateral Water 547 729 Lateral Sewer 1 40 2, Mr. Cosmano seconded. Project SAN 72-1-10 and WTR 72-2-10. The Manager reviewed and presented the lateral sewer and water assessment project in Nottingham Forest. There being no questiors or comments, Mr. Cosmano made a motion to close the hearing and adopt Resolution No. 586 approving lateral sewer and water assessments in Nottingham Forest as follows: Developed Lot Lateral Water 695 Lateral Sewer ILL ,59 Mr. McCulloch seconded. On roll call, all voted aye. VII. LATERAL SEWER AND WATER ASSESSMENT - EDEN SCHOOL. Resolution No. $87. Project SAN 71-1-18 and WIN 71-2-18. The Manager reviewed and presented the lateral sewer and water assessment project in the Eden School area. A resident on Eden Court questioned whether the school and property owners on Wallace Road were paying their share of the assessments. The Manager replied that they were. There being no further questions or comment, Mrs. Meyers made a motion to adopt Resolution No. 587 approving lateral sewer and water assessment project in the Eden School Addition,as follows: Developed Lot Undeveloped Lot Lateral Water 688 917 Lateral Sewer 1,980 2, Mr. Nesbitt seconded. On roll call, all voted aye. Motion carried. VIII. LATERAL SEWER AND WATER ASSESSMENT - ALPINE, HILLCREST, COENWOOD, ESTHERHILLS ETAL. Resolution No. 588. Project SAN 71-1-20 and WTR 71-2-20. The Manager reviewed and presented the lateral sewer and water assessment project in the Alpine, Hillcrest, Edenwood and Estherhills areas. A resident living on Alpine Trail questioned why there were 1/3 REC's included in their project. The Manager replied that there were som double bungalow type housing in this area assessed at I 1/3 REC's, some to trunk sewer and some to trunk water. There being no further questions or comment, Mr. Nesbitt made a motion a..4 adopt Resolution No. 588 approving lateral sewer and water assessment project in the Alpine, Hillcrest, etal area as follows: Developed Lot Undeveloped Lot Lateral Water 5 116 728 Lateral Sewer laigi 1 tms , 33 Mr. McCulloch seconded. LATERAL SEWER AND WATER ASSESSMENT - KING'S FOREST, FOREST KNOLLS. Resolution No. 589. Project SAN The Manager reviewed and prpsented the lateral sewer and water assessment project in the King's Foree-Forest Knolls area. There being no questions or cornment, a motion was made to close the hearing and adopt Resolution No. 589 approving lateral sewer and water assessment project in the King's Forest-Forest Knolls area as follows: Developed Lot Undeveloped Lot Lateral Water 665 887 Lateral Sewer _J_0__I 84 2 406 —a--- 2,1469 3,293 Mrs. Meyers seconded. On roll call, all voted aye. Motion carried. X. LATERAL SEWER AND WATER ASSESSMENT - DUCK LAKE AREA. Resolution No. 590. Aroject SAN The Manager reviewed and presented the lateral sewer and water assessment project in the Duck Lake area. The Manager read a letter received from Mrs. Arthur Rogers requesting deletion of her mother's property. Mr. McCulloch asked what this deletion would do to the cost of the project. The Village Engineering Assistant stated that they would have to construct a force main. John Franc cemented that by excluding this portion would add $10 more per R.E.C. A representative of the King of Glory Lutheran Church on Duck Lake Trail questioned how many R.E.C.'s were assigned to this property. Ken Chambers, replied that there were two. Dave Jensen, residing in Coachlight Manor asked when he could connect. The Manager replied that it would be sometime the middle of Noverber this year. Dave Husby, Rieke Carroll & Muller Associates was asked what the estimated cost difference would be in putting in a lift station on West 168th Avenue by deleting Mrs. Julia Kutecher's property in Section 5. He felt that this could be assessed in the trunk lateral. A resident in Sterling Field questioned when the streets would be blacktopped, when a resident could hook up on Duck Lake Trail and whether the pipe was large enough on Duck Lake Trail to handle the new developments that are being proposed. Mr. Husby replied that the first mat would be completed this fall, they could hook up on Duck Lake Trail by Novanber 15th and that the 10" pipe was large enough to accomodate the Duck Lake area. Another resident questioned why the cost was more in the Duck Lake area, he was told that it is a very difficult area to serve plus less R.E.C.'s. Don Rogers, Duck Lake Trail questioned why the streets were not al 1 blacktopped when the utility work was finished. The Manager stated that the policy was set to restore to the original condition of the streets. Mrs. Meyers asked what difference there would be in the plans if the Kutcher property were deleted and what maintenance cost there would be. Mr. Husby stated that there would have to be a lift station to push to Duck Lake Trail and that only pump service would be required. The proposed rate of assessment per R.E.C. I urge you to consider separating Kings Forest and Forest Knolls for special assessment purposes in the interest of equity and as continua- tion of the original approval basis. On June 27 the council approved the addition of upper Rosemary Road to the 1972 sewer and water project. This addition seemed attractive to the residents based on the cost of $2247.92 quoted in the meeting notice. The residents supported the project at that cost. Now a recent mailing indicates the wet to be $2741. In the space of three months, the cost appears to have gone up 22%. As you can imagine, those figures were a shock! Investigation reveals that a mistake has been made and the cost will now be $2474, which still is 10% above the basis on which the project was sold and approved by the council. Now I'm told that the council will consider, based on your recommendation, Kings Forest and Forest Knolls as one project for assessing the costa. This to me does not make sense considering that the projects are physically quite different in nature (See the cost estimate below.) and were done independently of each other. They are probably no more alike than say the Topview and Duck Lake areas which you plan to treat separately. It is true, I believe, that all nine areas in the village to be assessed at the September 25 meeting are covered by the same basic construction contract, but costs have been subdivided to look at separate geographic areas because of significant differences. Kings Forest and Forest Knolls are also different and should be separately assessed. Let's analyse the projects separately, based on the facts given at the hearings approving the projects. TRUNK SEWER AND TRUNK WATER APPEESMENT HEARING The Mayor opened the hearing, then the Village Manager reviewed and presented language and graphics for both the sewer and water trunks. He presented trunk system costs and expected revenue, also rates and charges contained in Resolution No. 425 and Resolution No. 568 amending No. 425. He then reviewed the resolution on policy position on financing sewer and water utilities. The Mayor then asked for questions and/or comments from the floor. Dave Osterholt, former mayor,asked for a reason for changing policy on trunk charges, the omission from the original policy of a provision for deferred payments to owners of property assessed only for trunk benefit. He stated that the Council had adopted this policy a year ago and they felt it was a good policy. The Mayor replied that the staff recommended the amendments as the only feasible means of financing the system. Mr. Osterholt added that he was still concerned about the burden on elderly residents ,Yho live on a fixed income. The Village Manager replied that a state law prevents deferral of payments for the elderly. Mr. Osterholt then stated that he felt that there are alternate ways to finance trunk sewers and thought that the Council should consider other plans. Mr. Loren Irvine stated that he felt the residents were subsidizing future developer's projects by providing a deferral of assessment on tracts that developers plan to plat, subdivide or connect to the system at a later date, up to 1977. Mr. Jerry Miller, Larry Hanson, and Howard Kaerwer, all in Topview Acres, felt that the amendment was not fair to the owner of five to eight acres of land. Mr. Miller charged that the amendment could force people to develop their land, also added that apartment dwellers should have to pay the full REC charge. The Village Manager expressed the Council's concern for the owner of several acres who came to the Village in hooes of having land around them and did not plan to subdivide. He further stated that because of development and land costs, the Village has no real alternative but to assess on possible eventual use. He stressed that the policy actually shifts the burden from the single REC to future development. Council Meeting September 25, 1972 Page Two Mrs. Arthur Rogers appeared on behalf of her mother, Mrs. Julia A. Richer, 16817 West 52nd Street, Eden Prairie, who is the owner of parcel #2400 and #3220 in Section 5. She stated that she felt no deter- mination of benefit to these properties had been made and that it should be eliminated from the assessment at this time. The Mayor stated that he felt she was making an unwise request but that the Council ,vould take it into consideration at the time of their decision. Joseph Dolejsi requested how many housing starts the Village has had, the Manager replied that there had been less than 100 per year and that there would have to be 2,5)0 annually to finance the utilities. A King's Forest resident asked what ,..would happen if the Village didn't get the 2,500 REC' s as projected. The Manager replied that the user fees would be raised or by mill levy. Dave Osterholt ased about ways of financing utilities other than trunk charges. Finance Director, John Frane, stated that there were n any ways of financing, system access charges was one but that any of them were risky other than assessment. He stated that he felt that the Village was taking the middle course. Mrs. Russell Lawrence, Sunnybrook Road, stated that she felt the Village was doing a good job of planning, not like the surrounding suburbs which have grown hodge podge. File stated that population growth was moving towards Eden Prairie and that there were few areas left that could plan as Eden Prairie has done. She further stated that the area must have sewer and water to avoid pollution. Don Peterson, President of Edenvale Corp., stated that the home owners were not subsidizing the multiple dwelling and that the developers would be frontending all trunk charges. There being no further comments from the floor, Mr. Cosmano made a motion to continue the hearing on trunk sewer and water assessment until the regular October 10th Council meeting. Project S71-1-17 and 571-7-17 and W71-2-17 and W71-8-17. The Manager revie ,red and presented the lateral sewer and water assess- ment project in the Duck Lake area. The Manager read a letter received from Mrs. Arthur Rogers requesting deletion of her mother's property. Mr. McCulloch asked what this deletion would do to the cost of the project. The Village Engineering Assistant stated that they would have to constructs force main. John Frane commented that by excluding this portion would add $10 more per REC. A representative of the King of Glory Lutheran Church on Duck Lake Trail questioned ho v many REC's were assigned to this property. Ken Chambers replied that there were two. Dave Jensen, residing in Coachlight Manor, asked when he could connect. The Manager replied that it would be sometime in the middle of November this year. Dave Husby, Rieke Carroll & Muller Associates, was asked what the estimated cost difference would be in putting in a lift station on :Vest 168th Avenue by deleting Mrs. Julia lcucher's property in Lection 5. He felt that this could be assessed in the trunk lateral. A resident in sterling Field questioned when the streets would be black- topped, when a resident could hook up on Duck Lake Trail, and whether the pipe was large enough on Duck Lake Trail to handle the ne w developments that are being proposed. Mr. Husby replied that the first mat would be completed this fall, they could hook up on Duck Lake Trail by November 15th and that the 10 pipe was large enough to accommodate the Duck Lake area. Another resident questioned why the cost was more in the Duck Lake area, he was told that it is a very difficult area to serve plus less SEC's. Don Rogers, Duck Lake Trail, questioned vhy the streets were not all blacktopped when the utility work was finished. The Manager stated that the policy was set to restore to the original condition of the streets. Mrs. Meyers asked what difference there would be in the plans if the Kucher property /ere deleted and ,ghat maintenance cost there would be. Mr. Husby stated that there would have to be a lift station to push to Duck Lake Trail and that only pump service would be required. Holmgren, Clerk On September 25, 1972 the Eden Prairie Park and Recreation Commission voted unanimously to strongly urge that the Park boundary along Purgatory Creek and Evenvale's 5th Addition be expanded to the natural boundary represented by the present tree line and that every effort be made to retain the natural character of the creekway by limiting the number of trees removed in the development process. The reason for this recommendation is as follows: 1. The change from multiple to single family dwellings. 2. A natural physical line will not be as arbitrary. 3. To avoid incompatible uses such as garbage cans, dog houses, wood piles and fences: 4. To retain the aesthetic value and visual impact of the area. 5. Larger areas allow for better park planning.
