I. ROLL CALL
Absent were: Councilman George Tangen and Commission member Stephen James.
II. CALL MEETING TO ORDER
The meeting was called to order by Mayor Wolfgang H. Penzel.
III, DISCUSSION ON GENERAL DUTIES AND ACTIVITIES OF THE HUMAN RIGHTS & SERVICES COMMISSION
Commission Chairman Simenson opened up the discussion with a review of what had
come before the Human Rights and Services Commission during the past year.
Marcia Lockman told about the Human Service Needs Board and the Data Bank Task Force
and Support Group Task Force which have been formed.
Simenson spoke about the No-Fault Grievance Procedure and the work the group is doing
in Eden Prairie.
Discussion centered on the role the Council and the Commission should have in dealing
with the South Hennepin Human Services Council. The consensus was that Jan Flynn
would be the Staff liaison and receive and distribute all matters to the Human Rights
and Services Commission from South Hennepin. Matters requiring Council action/atten-
tion would be channeled through the Human Rights and Services Commission which would
act in an advisory capacity as outlined in Resolution No. B1-14.
It was agreed that it would be helpful, both from the standpoint of the Council as
well as the Commission, if occasional updates on Commission activities were given
before the Council under the "Reports of Officers, Boards & Commissions" portion of
the Council meeting.
IV. ADJOURNMENT
The meeting was adjourned at 7:28 p.m.

plan. It indicates that our projections were accurate. The
Council may move to accept the revised by-laws of the Eden Prairie
Firemen's Relief Association which will put in place the new

• Torjesen moved, Sutliff seconded, to recommend to the City Council
approval of the Edenvale Industrial Park 6th Addition as per the
April 4, 1982 plat and the May 6, 1982 staff report with the provision
that the site plan return for Commission approval prior to the issuance
of a building permit. Motion carried 5:1:1 (8earman voted nay and

WHEREAS, the plat of Edenvale Industrial Park 6th Addition has been sub-
mitted in the manner required for platting land .m der the Eden Prairie Ordinance
Code and under Chapter 462 of the Minnesota Statutes and all proceedings have been
duly had thereunder; and
WHEREAS, said plat is in all respects consistent with the City plan and
the regulations and requirements of the laws of the State of Minnesota and ordin-
ances .of the City of Eden Prairie.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY CDUNCIL OF THE CITY OF
EDEN PRAIRIE:
• A. Plat Approval Request for Edenvale Industrial Park 6th Addition is approved
upon compliance with the recommendation of the City Engineer's
Report on this plat dated May 12, 1982.
B. That the City Clerk is hereby directed to file a certified copy of
this resolution in the office of the Register of Deed and/or Regis- •

SUBJECT: EDENVALE INDUSTRIAL PARK 6th ADDITION
PROPOSAL:
The developer, Richard W. Anderson, Inc., is requesting City Council
approval of Edenvale Industrial Park 6th Addition. The site consists
of 5.9 acres and is a combination of Lot 4, Block 2, Edenvale
Industrial Park (2.8 acres) and Lot 8, Block 1, Edenvale Industrial
Park 4th Addition. The developer proposes to build a 90,800 sq. ft.
office/warehouse building on the combined lot. This plat is located
northeasterly of Commerce Way in the south : of Section 9.
HISTORY:
Zoning to I-2 Park was finally read and approved by the City Council
on August 8, 1972, per Ordinance #179.
Detailed site plan review is scheduled for Planning Commission
consideration on May 19, 1982 to review some aesthetic concerns
evaluated at the May 10, 1982, meeting. This review process was
not intended to delay Council approval of the plat.
A Developer's Agreement will not be necessary for this plat.
VARIANCES:
All variance requests must be processed through the Board of Appeals.
UTILITIES AND STREETS:
Municipal utilities and streets necessary to serve the property have
been installed and further extension is not necessary.
PARK DEDICATION:
Park dedication requirements for this plat have been satisfied
through approval of the Edenvale PUD. Therefore, a cash contribution
will not be required. This is consistant with other Edenvale
Industrial Park Plat approvals.

BONOING:

therefore, bonding will not be required.
RECOMMENDATION:

WHEREAS, a report has been given by the City Engineer to the City

Engineering Division is presently trying to discover if any need exists for
the easement and will have that information available for the hearing that is
being set for June 15, 1982.

HISTORY:
The preliminary plat was approved by the City Council on November 17,

on December 15, 1981, per Ordinance #81-27.
The Developer's Agreement referred to within this report was
executed on December 15, 1981.
VARIANCES:
Variances to be allowed are described in the.Developer's Agreement.

UTILITIES AND STREETS: •
All utilities and roadways proposed for this site will be privately
owned and maintained. Review and inspection of these facilities will

Enclosed is a 100% petition for local improvement for
Lorence 1st and 2nd additions in Eden Prairie. Also
enclosed is a development plan showing a portion of
Lorence 1st addition outlined in red which we propose to
construct early this summer with private funds. We request
that the city initiate a development contract for sewer,
water, storm sewer and streets for the remainder of Lorence
1st additions and for all of Lorence 2nd addition.
•
Regarding schedule for these improvements we propose to
privately develop that portion of Lorence 1st addition out-
lined in red in order to expedite that construction and ask
the city to construct the improvements for the remainder of
Lorence 1st addition in 1983 with the cost of that construc-
tion assessed on a unit basis against the 36 units located
on lots 3 and 4 Block 1 and Lots 2, 3 and 4 Block 2 of Lorence
1st addition. We also request the city to initiate an improve-
ment project for all the utilities and streets on Lorence Way,
Park Place and Chandler Curve in Lorence 2nd addition as well
as the asphalt trail from Hames Way easterly into the city park.
We request this construction to be commenced as early as possi-
ble in 1982 so that some construction can proceed this year.
We request that the street and utility construction and black
top walk be assessed against all 46 lots in Block 1 thru 6 of
Lorence 1st addition.
We hereby agreed that in the event the 2nd reading of the zoning
and platting ordinances are not completed so that the subdivi-
sion is not completed we will pay any costs incurred by the City
for engineering or other items incurred by the City.

RESOLUTION NO. 82- 116
RESOLUTION FOR VACATION OF DRAINAGE AND UTILITY EASEMENT
WHEREAS, the plat of Cardinal Creek contained, as one of its lots, Lot
4, Block 2, Cardinal Creek, which contained along the Easterly line of said Lot
a five foot easement for utilities and drainage; and
WHEREAS, said Lot 4, Block 2, Cardinal Creek has been reptatted as por-
tions of Lots 1 and 2, Block 1, Cardinal Creek 2nd Addition; and
WHEREAS, during the course of the proceeding of the platting of
Cardinal Creek 2nd Addition, the easement located along the eastmost five feet
of the former Lot 4, Block 2, Cardinal Creek was not vacated; and
WHEREAS, the City Engineer and the City of Eden Prairie have received a
request to vacate said easement as it presently bisects the newly-created Lots 1
and 2, Block 1, Cardinal Creek 2nd Addition as it serves no purpose or function;
and
WHEREAS, it has been determined to be in the best interests of the
public and of the owners of Lots 1 and 2, Block 1, Cardinal Creek 2nd Addition,
to vacate such easements.
WHEREAS, a notice of hearing on said petition was published in the
official legal newspaper of the City of Eden Prairie on the

March , 1982, and on the 25 day of March 1982,
posted as required by law; and
WHEREAS, a hearing on said petition was held on 18 day of May
1982, at which time all persons for and against the granting of said petition
were heard.

NOW, THEREFORE, on its own motion, be It resolved by the Eden Prairie
City Council that:
1. The easement for utilities and drainage located along the
eastmost five feet of former Lot 4, Block 2, Cardinal Creek,
now located over a portion of Lots 1 and 2, Block 1,
Cardinal Creek 2nd Addition, and legally described
es follows:
See attached exhibit
is hereby vacated.
2. The Council does hereby authorize the City Clerk of the
City of Eden Prairie to prepare a Notice of Completion
of the proceedings to vacate the above-described
easement and to present such notice to the County
Auditor and to file the Notice with the office of
the Hennepin County Registrar of Titles.

SUBJECT: Cardinal Creek 4th Addition
( Replat of Cardinal Creek)
BACKGROUND:
Cardinal Creek was zoned R1-13.5 and platted in 1979.(Plat attached
as fig. 1.) Homes have been constructed on some of the lots but not
the lots within the replot request. •
REQUEST:
-Repldt Lot 4, Block's, and outlot B into one lot and creation of a new
easterly utility easements.
-Repldt Lot 3, Block 2 to create a new outlot B as pathway location
along its easterly side.
-Vacate the eastern utility easements on Lot 4, Block 3.
-Vacate the eastern utility easement on Lot 4, Block 2. (lot 4 was replatted
as part of the 2nd addition and the utility easement was never vacated)
Outlot B (future asphalt path location) was conveyed to the City as per
the requirement within the Developer's Agreement. Prior to the combining
of Lot 4, Block 3, and Outlot B, the City will have to convey Outlot B
to Cardinal Creek Associates. This combination will produce a wider lot
desired by the builders.
The pathway originally designated to be constructed upon Outlot B is
proposed by the developer to be moved to Lot 3, Block 2. This is an acceptable
change and the City will install the pathway when the creek path is installed.
All these requests, lot combination and vacation of utility easements,
are consistent with Ord. 135 and the executed Developer's Agreement on
Cardinal Creek.
The Staff would recommend approval of Cardinal Creek 4th Addition,

Pursuant to the submission requirements for zoning and platting
requests as set forth in the Preliminary Plat Summary and Eden Prairie Ordinance
No. 93, Cardinal Creek Associates hereby submits the following:
A. PRELIMINARY PLAT
1. The proposed plat is attached hereto as Exhibit A.
B. SPECIFIC PLAN REQUIREMENTS
1. The property to be developed is legally described as Outlot B
and Lot 4, Block 3, Cardinal Creek, is located in the City of
Eden Prairie, County of Hennepin, State of Minnesota, is owned
in fee simple title by Cardinal Creek Associates (Lot 4, Block 3,
Cardinal Creek) and the City of Eden Prairie (Outlot B).
2. Developer. Development of the project will be carried out by
Cardinal Creek Associates, pursuant to the overall plan of
development of Cardinal Creok.
3. Fiscal and Economic Development. Not Applicable.
4. Development Method. The land will be developed pursuant to the
Development Plan of Cardinal Creek.
5. Identify Boundaries and Boundary Conditions. The proposed plat
will be a replat of Lots in the Cardinal Creek Subdivision.
6. Existing Land Use and Occupancy. The property is presently zoned
residential and is vacant land.
7. City Guide Plan Framework. Single Family Residential.

8. Additional General Project Information.
A. The appiicant has requested the City to vacate the ease—
ments for utilities and drainage along the easterly five
(5) feet of Lot 4,.Block 3, excepting from the vacation the
southmost ten (10) feet and the northerly five (5) feet of
the easterly five (5) feet of Lot 4, Block 3, Cardinal
Creek.
B. The City will convey by Quit Claim Deed Outlot B to the
applicant, reserving and creating easements for utilities
and drainage along the easterly five (5) feet and southerly
ten (10) feet of Dutlot B, Cardinal Creek.
C. The applicant will convey by Warranty Deed the Northeasterly
ten (10) feet of Lot 3, Block 2, Cardinal Creek. This land
is to be conveyed to the City in exchange for Outlot B. The
Development Plan of Cardinal Creek contemplated that a bike
path be constructed over Outlot B, but as of this time the
pathway has not been required to be constructed over Out lot B
and has not been laid out. The Plan contemplates allowing
a pathway in the event it was ever constructed.
It is now the plan to construct the path over the northeasterly
ten (10) feet of Lot 3, Block 2, Cardinal Creek. This alter—
native route will provide the necessary access to Outlot A,
as contemplated by the Development Plan of Cardinal Creek.
D. The topography of Lot 4, Block 3, Cardinal Creek, without the
additional land augmented by Outlot B, will not allow for the
construction of a home of the quality and type contemplated by
the Cardinal Creek Development Plan, thereby diminishing the
value of the land, both to the Developer and the City's tax
base.
C. SITE AREA ANALYSIS
1. Development Objectives. It Is the objective of the applicant to
develop the site with a single family residential improvement
pursuant to the Development Plan of Cardinal Creek.
2. Site Plan. Not applicable.
3. Grading. Not applicable.
4. Utility Plans. See attached proposed plat.
5. Preliminary Architectural Drawings. Not applicable.
6. Legal Instruments for Plan Implementation. Not yet applicable

BACKGROUNO:
Cardinal Creek 2nd Addition (attached as fig.l) was rezoned to R1-13.5
• and platted in 1979. Homes have been constructed upon the lots and a
home does exist upon Lot 10 .
REQUEST:
-Replat the common lot line of Lots 10 and 11, Block 2, giving approx.
1300 sq. ft. to lot 10.
-Vacate the east side lot line utility easement of Lot 11, Block 2.
-Vacate the west side lot line utility easement of Lot 10, Block 2.
The structure on Lot 10 is setback 22 feet from the original side lot
line. Changing the lot line will produce a setback of approximately
10 feet.
The lot line change between Lots 10 & 11 does not create any incon-
sistencies with the zoning ordinance or the executed Oeveloper's
Agreement for Cardinal Creek 2nd Addition.
Planning Staff would recommend approval of the change in side lot lines
and the vacation of easements as proposed in Cardinal Creek 5th Addition,
(fig. 2).

Pursuant to the submission requirements for platting requests as set
forth In the Preliminary Plat Summary and Eden Prairie Ordinance No. 93,
Gregory D. Gustafson hereby submits the following:
A. PRELIMINARY PLAT
1. The proposed plat is attached hereto as Exhibit A.
B. SPECIFIC PLAN REQUIREMENTS •
1. The property to be developed is legally described on Exhibit B, is
located in the City of Eden Prairie, County of Hennepin, State of
4 Minnesota, is owned in fee simple title by Gregory 0. Gustafson
and Jeanne S. Gustafson, husband and wife.
. 2. Developer. Development of the replatted project will be carried out
by the applicant in conformity with the overall plan of Cardinal
Creek 2nd Addition.

A. The applicant has requested the City to vacate the easement for
utilities and drainage now located along the easterly five (5)
feet of Lot 11 and the westerly five (5) feet of Lot 10, Block 2,
Cardinal Creek 2nd Addition, excepting from the vacation the
southmost five (5) feet of the easements and the northmost ten (10)
feet of the easements.

MOTION 1
Torjesen moved to close the public hearing. Retterath seconded, motion carried
5-0-2. Marhula and Hallett abstained. Marhula abstained because he works for
the firm representing Equitable Life, and Hallett abstained because he arrived
late.
MOTION 2
Torjesen moved to deny the request so that the developer can address the problems
as listed in the staff report dated 4/22/82. Retterath seconded; motion carried
Marhula and Hallett abstained.
D. CARDINAL CREEK 3RD ADDITION, by Gustafson & Associates. Request
for approval of a preliminary plat and rezoning from Rural to
RM 6.5 of the property which is part of Cardinal Creek PUD 72-01.
Included in the public hearing on the proposed rezoning will be
the consideration of granting of variances pursuant to Sec. 11,
Ord. 135 from the provision of said Ordinance applicable to the
RM 6.5 District. 16 acres located east of Cardinal Creek 2nd
Addition and Nine Mile Creek and west of 1-494. A public hearing.
The Planner stated that Mr. Ron Kruger, representing Greg and Jeff Gustafson,
was present to give a presentation.
Kruger stated they are requesting 18 double family lots. Jeff Gustafson will
be the developer and the doubles will be high quality. Severe grading will
have to be done in the center of the site. As many trees will be saved as
possible.
The Planner reviewed the staff report dated 4/21/82. He stated that the City
Forester has visited the site and stated he was concerned that as many trees
be retained as possible. He felt that the 25' front. yard setback is reasonable.
Recommended that a minimum of 1D feet be allowed on one side which would allow
20' on the other side of the unit. Detailed landscaping plan inventory should
be done. He suggested that this be the last development on this road before
Cardinal Creek Road is made a through road.
Marhula asked if the lots conform to the Shoreland Management Ordinance. The
Planner stated that Lot 1, Block 1, and Lot 17, Block 2 are within 100' of the
normal ordinary high water mark.
Marhula asked where the excess dirt will go. Kruger replied in the first
addition along Cardinal Creek Road adjacent to Baker which will remedy seven
lots to make them buildable.
Greg Gustafson stated that no floodplain was filled in Cardinal Creek First
and Second Addition except for the road crossing which was approved by the
Nine Mile Creek Watershed District.
The Planner stated that there is a large oak tree in the way of the road and
suggested that a median be placed around the tree to preserve it because of its
age.
Torjesen asked if the duplexes will be custom duplexes. Jeff Gustafson replied
that each lot will be analyzed on a lot by lot basis. He stated that there will
be approximately 10 to 15 different types.

Bearman asked when Cardinal Creek Road will be completed and expressed concern
that it is a long cul-de-sac at present. The Manner replied that there is no
time schedule.
Bearman asked the length of the cul-de-sac. Kruger replied 800'.

Marhula moved to close the public hearing on Cardinal Creek 3rd Addition. Sutliff
seconded, motion carried 7-0.
MOTION 2
Mar-hula moved to recommend to the City Council approval of the rezoning from
Rural to RM 6.5 as per the plans dated 3/22/82 and the staff report dated
4/21/82 with the following changes and/or additions: add to #3, ONR review
and approval also be obtained.
13. That the plan conform to the Shoreland Management Ordinance prior to
City Council review.
14. The floor area ratio should not exceed Ordinance requirements.
Sutliff seconded.
DISCUSSION
Bearman asked that the City Forester spot trees that should be saved prior to
any construction of the road. Marhula and Sutliff agreed.
Motion carried 6-1. Gartner voted no because she opposed the long cul-de-sac.

Marhula moved to recommend to the City Council approval of the preliminary plat
dated 3/22/82 as per the staff report dated 4/21/82 with the same additions as
in motion 2. Sutliff seconded, motion carried 5-2. Gartner and Bearman voted
no because he also opposed the long cul-de-sac.

Marhula moved to recommend to the City Council approval of the variances requested.
Sutliff seconded, motion carried 5-2. Gartner and Bearman voted no.

Lambert reviewed the proposal; no one was present on behalf of the
developer.
The proponent, Gustafson $ Associates, is requesting PUD Development
Stage approval, rezoning from Rural to Rai 6.5 and preliminary
plat approval for 17 duplex lots and 1 triplex lot. The project
is located east of Cardinal Creek 2nd Addition.
Lambert noted 3 issues of concern to this Commission:
1) Pathway to connect trails
2) Move lot lines out of floodplain
3) Preserve oaks
Lambert added that :' Planning Commission has included the above
issues in their recc-- 71dation (Staff Report of 4/21/82).

Natural Resources Commission -2- May 3, 1982
Mderson asked if a passive trail could be developed around the
marsh area of this site so the public could walk around and enjoy
it. He noted that the City has shown a trail in this area for
a long time.
Lambert responded that because of the marshy, boggy soil conditions
• it would be very expensive and difficult to put a trail in.
MOTION: Kingrey moved to recommend approval of Cardinal Creek 3rd
motion per Staff recommendations. Breitenstein seconded the
motion and it carried. Anderson opposed.

DISCUSSION: Anderson commented that he does not like to see a
development come in to an area this pristeen without a great
attempt to preserve the existing trees. He feels at least one
large clump of trees should be preserved for residents.
2. Trails Map
Lambert presented the finished map to Commission members. lie
noted it is a little premature for distribution of this trails
map to the public. However, by mid 1933 this should be the status
of the Eden Prairie Trails System and hopefully the Eden Prairie
Park System.
• Staff is requesting the Commission review the map and be ready
to discuss concerns regarding future trail construction projects
at the May 3, 1982 meeting.
Kingrey asked what the status is for a connection from Forest
Hills area across freeway to Bryant Lake?
•
Lambert said a connection is planned and described the route
along Valley View Road to Flying Cloud Drive.to Shady Oak Road
to Bryant Lake. There is also a trail planned north on Baker
Road up to Townline Road which will connect across and down Beach
Road from the west.
Anderson asked if there could be a connection through the Haynes
property to give access to Bryant Lake Park.
Lambert said the City cannot speed up that connection due to the
economy.
Anderson pointed out that the City should look at trail projects
which could get state funds rather than City money such as
County Road 1.
Jessen asked why the map is called 'Trails Map". He also suggested
that a key would be helpful.

BACKGROUND
The City's Guide Plan illustrates the site as medium density residential.
The original PUD, 72-PUD-01 (137 acres), depicted this area as townhouses.
The number of units and specific site plan were to be reviewed at time of
zoning applications.
Todate Gustafson & Associates have zoned, platted, and developed Cardinal
Creek and Cardinal Creek 2nd Additions, (see figure 1), as large lot upper
bracket single family. About 1/3 of these homes are built or under con-
struction.
EXISTING SITE CHARACTER
The 16 acre piece is oblong in shape and contains a wooded moraine: The
morraine has slopes of 15-50% down to the Nine Mile Creek flocdplain. It
is an isolated land feature because on its east, south, and west sides it
As surrounded by floodplain. The only land connection is to the north.
The woods on the southern 2/3 is mature burr and white oak trees and cor-
1 responding underbrush.
. I-494 is 600 feet to the east and freeway noise will affect lots on the
east side of the proposed street.

The soils are Heyder and Salida, well drained, and suitable for building
on slopes less than 12%. The slopes of 15-50% will require extreme care
in grading and restoration in order to prevent erosion.
ORDINANCE REQUIREMENTS

The developer has not submitted platting of the lots along the proposed .
common wall areas. Their reasoning being as follows: some lot owners/
buyers will retain ownership of both units, the unit designs are unknown
at this time, and the site's topography and trees will be better preserved
if units are fit onto a lot instead of requiring placement of all units
directly on the lot's centerline. The lots are of sufficient size to
allow unit placement off a lot's centerline without losing the required
6,500 sq. ft. lot size minimum/unit, i.e., a duplex unit on an 18,000
sq. ft. lot could have 1 unit on 10,000 sq. ft. and the other unit on
8,006 sq. ft.
The setback variances requested, 10' either side, may be abused by con-
structing too large of units upon lots and utilizing the 10' setback
upon each side. This would not meet the intent of granting the setbacks
to preserve trees and could exceed the maximum floor area ratio allowed.
Therefore, care must be taken so that units submitted for building permits
do not exceed the maximum floor area ratio of .2forlstory/.4 multiple story.
The Staff recommends a 10' minimum sideyard setback with combined side
setbacks to be no less than 30 feet;and whenever possible and to save trees,
units should be clustered to achieve tree preservation. An illustration of
the side and front yard setback variances are shown in figure 2.
The Shoreland Ordinance requires a building setback of 100 feet from the
high water mark - 860 elevation.
The floodplain elevation is 864. The lot lines encroach into the flood-
plain by 5-30 feet. The lot lines should be removed from the floodplain
and the area incorporated into Outlots A and C.
The crossing of Nine Mile Creek and the fill proposed in Lots 17, Block
2, and Lot 1, Block 1, will be subject to review and approval of the
Watershed District.

SITE PLAN
• Grading:
Block 1, Lot 1, is the location of the lone proposed triplex. This building
encroaches into the floodplain. If the unit cannot be shifted out of
the floodplain, the staff would recommend it be redesigned as a duplex. All
units must be a minimum of 2' above the floodplain elevation of 864.
Grading of the street through the top of the morraine shows cuts of 4-20 •
feet. The street and grading will entail removal of oak trees located on ton
of the morraine. The street right-of-way is 50' and the surface is 28'.
• The approximate 800' cul-de-sac exceeds City Ordinance maximum of 500
feet. Connection southward, westward, or eastward, is not proposed
because of the expanse of floodplain to cross (300'+) and the side slopes
of the moraine.
UTILITIES
AA 6" watermain follows the approximate BOO' cul-de-sac to its terminous
No looping of this watermain is shown. Looping should be investigated
by the developer and final plans subject to approval of the City Engineer
so that adequate water pressure and flow is provided.

The Staff will require inclusion of additional water hydrants as per the
specifications of the Fire Marshall.
Storm water is shown as being discharged in two separate locations. One
location, between Lots 15 and 14, is discharged at an elevation which
corresponds to the 860 high water mark; and the other at the Creek crossing
has a•discharge point 15 feet from the high water mark. These plans will
be subject to review and approval by the City Engineering Department and
the Watershed District.

SUPPORTIVE MATERIALS FOR THE
LAND DEVELOPMENT APPLICATION FOR
CARDINAL CREEK 3RD ADDITION
• Pursuant to the submission requirements for zoning and platting
requests as set forth in the Zoning Summary and Eden Prairie Zoning Ordinance
No. 135, as amended, and as set forth in the Preliminary Plat Summary and Eden
Prairie Ordinance No. 93, Gustafson & Associates, Inc. hereby submits the
following:
A. PRELIMINARY PLAT
•
1. The proposed preliminary plat is attached hereto as Exhibit A and
11- sets forth the overall plot plan for the development of Cardinal
Creek 3rd Addition.
B. SPECIFIC PLAN REQUIREMENTS
1.. The property to be developed legally described on Exhibit B, is
located in the City of Eden Prairie, County of Hennepin, State of
Minnesota, is owned in fee simple title by Russell C. Marsh
and Helen E. Marsh, husband and wife, and is presently under
the control of Gustafson & Associates, Inc., the developer, with
a mailing address of 4015 West 65th Street, Edina, Minnesota 55435.
2. Developer. Development of the project will be carried out by
Gustafson & Associates, Inc. The President of Gustafson &
Associates, Inc., Mr. Jeffrey P. Gustafson, has a considerable
amount of experience as a developer and builder of residential
projects, both single family and multi-family, in the Twin
City area, some of which are located in the City of Eden Prairie.
Gustafson intends to develop the project which would include
construction of the homes on the various lots within the
subdivison and will maintain a very active role in the overall
scheme of development, not only with Cardinal Creek 3rd
Addition but any other development in this immediate vicinity.
3. Fiscal and Economic Development. Funds for development will be
• supplied internally or from interim loans from local lenders
in regard to work performed by the developer. This application,
as proposed, contemplates that the developer will install sewer
and water, street, curb and gutter utilities .within the subdivision.
4. Development Method. The land will be developed into 17 two-family
and one three-family residential lots. It is the intention of
the developer to construct upon the lots the residential units.
5. Identify Boundaries and Boundary Conditions. Cardinai Creek 3rd
Addition is bounded on ti..e north by the lands controlled by
Gustafson & Associates, Inc., which is presently undeveloped and
which is contemplated to be developed into a subdivision which would
contain multiple residential units, which plan is congruous with the
Comprehensive Guide Plan of the City of Eden Prairie. The easterly
boundary is the Nine Mile Creek flood plain and Interstate 494. The
southerly boundary is the Nine Mile Creek flood plain and the westerly
boundary is the Nine Mile Creek flood plain and Cardinal Creek 2nd
Addition. (See attached materials submitted in application.)
6. Acreage. The project site contains epproximatley 16.36 acres and
Iles immeuiatley adjacent to the west boundary of Cardinal Creek 2nd
/ Addition.
7. Regional Relationships. The project site is located within a develop-
ment area known as the Cardinal Creek Subdivisions and is slated for
development as an important component of This overall development.
The use of the land as multiple family residential units, at least to
the extent that the units are two-family and three-family, is con-
templated by the Comprehensive Guide Plan of the City of Eden Prairie.
The primary access is provided over Cardinal Creek Road through
Cardinal Creek Subdivision and Cardinal Creek 2nd Addition. Cardinal
Creek Road leads to Baker Road. In addition, it is contemplated
that when the land to the north of the proposed site is developed,
a continuation of the major access thoroughfare through Cardinal
Creek 3rd Addition will link with Baker Road on the north. This
is in conformity with informal discussions with representatives
of the Eden Prairie Department of Engineering and the Planning
Department.

B. Existing Land Use and Occupancy. The property is presently zoned
rural and is undeveloped.
9. Existing Transportation Systems. None.
10. Existing Zonings. The property is presently zoned rural but is In-
cluded as long development as a PUD under the Comprehensive Guide
Plan of the City of Eden Prairie.

11. City Guide Plan Framework. Planned Unit Development (PUD).
12. Critical Public Decisions. Critical public decisions which will be
necessary in regard to this project include City approval of the
plat of Cardinal Creek 3rd Addition, rezoning the property Into
R-M (6.5 - Residential Multiple Family); variances for setbacks,
both and front and side, and approval and inspection of all
improvements.
13. Additional General Project Information.
A. The developer will be requesting 25 foot front yard setback
variances. This is required because of the desire of the
developer to save trees and the fact that the overall
topography of the land requires this setback to allow for
the highest and best use of the land. In addition, a 50
foot street is contemplated by the City Planning Department.
B. Disposition of the Outlots. It is contemplated by the
developer that Outlots A and C will be either retained
by the developer and subjected to open space easements
or conveyed or dedicated to the City for open space
purposes. With respect to Outlot B, it is contemplated
that the developer will retain control over Out lot B
and develop a tennis court on the site which would be
developed for the benefit of all residents of the
Cardinal Creek 3rd Addition or, if so required by the City,
open to other residents pursuant to some type of rules and
regulations which would govern use and maintenance of the
tennis facilities. It has not been decided as yet how
Outlot B will be owned.
C. Road Connection to Baker Road and Interstate 494 to the North.
It is contemplated that the ro.d as it will be developed
through Cardinal Creek 3rd Addition will link to a continu-
ation of this road as to be developed through the land
directly to the north of Cardinal Creek 3rd Addition which
is under the control presently of'Gustafson & Associates, Inc.
There is no sketch of the proposed road at the present time to
include with this package; however, it is not anticipated,
after informal discussions with the Engineering Department
and Planning Department of the City of Eden Prairie, that
there would be substantial grading necessary to complete the
link to Baker Road.
D. The developer is requesting side yard variances of ten feet
on each side because of the topography of the land which will
be developed and because of the contemplated construction of
zero lot line duplex units on the properties.

E. A front yard setback variance of 25 feet will be requested of
the City Council because of the concern the developer has In
saving trees and because of the overall topography of the
land.
C. SITE AREA ANALYSIS
1. Doveloornent Objectives. It is the objective of the applicant and
developer to develop the site as an R-M (6.5 - Residential Multiple
Family) residential project with 17 two-family and one three-family
zero lot line units.

at the time of development, and which will support the highest and

We are requesting a zoning change from rural to R-M (6.5 Residential
Multiple Family). We are requesting variances from the City of Eden
Prairie for a 25 foot front yard setback and a 10 foot side yard
setback on each side of the dwelling units which will be constructed
upon the lots within the Subdivision.
9. Additional Information. In conformance with the requirements of
the Preliminary Plat Procedure and Zoning Submission Requirements,
this letter shall serve as the developer's authorization to the
City of Eden Prairie for the construction by the City upon the
slte one or more "land development" signs and such authorization
is hereby granted.

We were retained by b!r. Bruce Knutson, Architect acting
in behalf of Cardinal Creek Company, to conduct a soils
investigation for this project. The purposes of our work were t:'
determine the general soil and ground water conditions within
the proposed roadway, and to prepare a -report of our findings.
PROCEDURE
A total of four (4) soil test holes were drilled within
the proposed roadway, at locations designated by the Architect.
The field work was performed on January 27, 1982 using a truck-I
( counted CME-55 drill unit. Snow plowing was required in order I
to provide access for the drill rig to the test hole locations.
• The test holes were advanced 'with 34"i.d. x 7"o.d. continuous
flight, hollow stem augers which act as a temporary casing to
prevent collapse of the sides of the holes. Standard penetrati:
tests were performed in advance of the casing tip at 1k to 5
foot intervals of depth, in accordance with procedures designa-
• ted in A.S.T.M. D-1586. Periodic observations for ground water.

locations in relation to the proposed roadway and lotting
arrangement. Detailed soil descriptions along with a plot of
the standard penetration test blows per foot are given on the
Borehole Log sheet, Drawing No. 2. Following the regular writ'
soil descriptions are capital letters in parentheses, which
represent the appropriate group symbols of the Unified Soil
Classification System. A chart explaining this system is
appended.
All elevations in this report are to geodetic datum, an..'
were obtained using the bench mark noted on the site plan.
SITE AND GEOLOGY
The site under present study is located within the
Nine Mile Creek Drainage Basin. A tributary of the creek flo
along the west side of Cardinal Creek 3rd Addition and crosses
the proposed roadway at the northwest end. The ground surface
it within this proposed development slopes from the crest of a
small hill at the south end of the site .'own toward the east
and west. There is a maximum difference in elevation of about
50 feet between the crest of the small hill and the edge of
flood plain.

Natural inorganic soils at the site include clayey sand
and sandy clay glacial till and glacial outwash sand deposits.
During post-glacial times surface layers of topsoil and
fluvially deposited silt and clay soils have formed. Some fill.
. has already been placed at the westerly end of the'proposed
roadway, probably during previous development of the surrounds:
area. •
According to information published by the United States
Geological Survey, the uppermost bedrock stratum under this
area is believed to be St. Peter sandstone.
SOIL CONDITIONS
Four basic soil types were encountered in our investiga-
tion. These are: fill; surface topsoil, silt and clay layers;
glacial outwash sand; and clayey and sandy glacial till.
Fitt
Surface strata of mixed fill occur at Test Holes 1 and
2, along the westerly portion of the roadway, where it crosses
the creek. The fill includes brown sandy silt, and silty and
clayey sand, becoming mixed with black mildly organic sandy
• silt in the lower portions of Test Hole 1. Because the fill
mixed with the topsoil, it is difficult to delineate its exact
thickness, but we have estimated it to range from 4.1' to 5' at
• these two test hole locations.
Surface Soils
Underlying the fill at Boreholes 1 and 2, and occurring
directly at ground surface at Boreholes 3 and 4, are upper
layers of topsoil and stream-deposited silt and clay soils.'

sandy clay and clayey sand, brown-black mildly organic clayey
silt, and brown to green silty clay and clayey silt. They are
in a soft condition, with standard penetration test values •

Glacial Outwash Sand
Underlying the topsoil at Boreholes 3 and 4 is a depose
it of sand. This soil grades with depth at Borehole 4, from
silty fine sand and fine sandy silt to fine to medium sand. I
the area of Borehole 3 this soil is mainly a fine to coarse
sand. Standard penetration test values within the sands rang
from 9 to 23 blows per foot, discounting values which hit
gravel. The upper surface of the sand is loose at Borehole
4, hut it is generally in a medium dense condition at depth.
The glacial outwash sands have low to moderate load-bearing
capacity and very low compressibility, and are good foundatio .
subsoils. However the upper silty fine sand and fine sandy
silt zone is frost susceptible.
Des Moines Glacial Till
Commencing at depths of 5.5' to 8.9' below present
ground surface, and extending beyond the terminal depths of
Borcholes 1, 2 and 3, is a major stratum of glacial till. Thu :
soil is a brown to grey sandy clay and clayey tine to medium
sand, with traces of fine gravel.

Seams of sandy clay are also interlayered with the
sands below the 18.depth of Borehole 4. Standard penetration
test values within the glacial till soils vary from 6 to 17
blows per foot. The upper surface of the sandy clay at Boreho` '
1 is stiff, but these soils are generally in a tough or medium
dense condition.
The glacial till soils have low to moderate load-bearing
capacity and low compressibility, and are suitable foundation I
subsoils.
GROUND WATER CONDITIONS
Free ground water was observed in Boreholes 1 and 2,
at final depths of 6' and 4' below present ground surface,
:
corresponding to elevations of 852.3' and 853.1'. The ice leve'
of the creek where it crosses the roadway was at elevation
853.7' . The glacial till soils are relatively impervious. Had
the period of observation for water levels at Borehole 3 been
longer, it is likely that the ground water level would have
risen at this location, to a level matching that at the other
boreholes.
The flood plain of the creek appears to extend approximat'
ly up to the 860-foot contour. Some seasonal fluctuations in th
ground water levels, both upward and downward, should be expect.

Twenty-eight twin homes are proposed for this develop-
ment. These will be masonry wall-bearing structures up to
first floor level, with wood frame construction above. Structu-
loads on the footings of such buildings are relatively light.
Proposed roadway grades will involve the placement of
approximately 7 to 8 feet of fill above present grade at Test
Holes 1 and 2, and 41 to 3 feet of fill above present grade
at Boreholes 3 and 4. The southerly end of the cul-de-sac
will be in a 10' to 12' cut section.
ANALYSIS AND RECOMMENDATIONS
No highly organic soils were encountered in our investic:
tion. Fill already exists in the vicinity of Test Holes 1 and,
2, and the topsoil at these locations is buried. Removal of U.
buried topsoil and soft silt soils may not be warranted for
roadway installation in this area, if the risk of a small
amount of future settlement is acceptable, and if some
additional future maintenance of the pavement is anticipated.
The existing fill surface should however be thoroughly rolled
and compacted prior to the additional fill placement. In the
shallower fill areas, at Boreholes 3 and 4, the surface topsoi:
and vegetation should be stripped and removed prior to fill
placement.
. All buried topsoil and any overlying fill should however
be subcut from below underground utility lines and the culvert,
and replaced with approved compacted inorganic fill.

The lower portions of these excavations near the creek
crossing will likely extend below the ground water level,
( and pumping to control the ground water during construction
should be anticipated. The silt soils underlying the buried
topsoil at Borehole 2 may tend to soften if they are exposed
at the base of the excavation, and this would require that
they also have to be removed. The first portion of fill used
in these excavations should be a relatively clean well-gradedi
sand, with less than 10% silt and clay content, since this
material will be in contact with water. Some of the natural
sands found at depth within Test Holes 3 and 4 could be used
for this purpose. Compaction operations need not commence
until the fill level exceeds the water level by at least 2
feet. Fill placed above this level should be spread in 6 to
8-inch maximum loose lifts, and should be compacted to achiev-
at least 95% Maximum Modified Proctor Dry Density, A.S.T.M.

The glacial till subsoils and upper silty fine sand
and fine sandy silt soils at Borehole 4 would be suitable for
use within a controlled compacted fill above the ground water
level. It would be undesireable to use frost-susceptible
fine-grained silt soils as till within the uppermost 211 feet
below pavuue,it level.
Conventional flexible pavement designs may then be
used above properly graded roadway areas.

Supplementary soil borings are recommended at the
downslope sides of several of the proposed house areas.
GENERAL
The soil conditions have been established at our test
hole locations only. There are likely to be variations in
conditions between and around the borings and interpolation
or extrapolation of the results is not warranted.
During construction, all excavations, earthwork, fill
placement and compaction should be monitored and tested by a
qualified soil engineer. We would be pleased to provide the
necessary field engineering observation and testing services.
The recommendations contained in this report are
intended solely tor the proposed roadway installation. In the
event that any changes in the nature, design or location of
the proposed roadway are planned, the recommendations and
conclusions contained in this report shall not be considered
valid unless the changes are reviewed and the recommendations
and conclusions of this report are modified or verified in
writing.

• — Residential development is a very noise sensitive land use. Present
noise levels in this area are below State and Federal standards and it
appears that there will be no problem in regard to noise levels.
However, if lots are platted within 400 feet of the southbound lanes,
there may be a problem with the noise levels. The City and the
developer should be aware that Mn/DOT will not provide any type of
noise abatement for new development adjacent to the existing highways.

ESTABLISHING THE FLYING CLOUD AIRPORT ADVISORY
COMMISSION OF EDEN PRAIRIE
As requested by the City Council, the Flying Cloud Airport Advisory
Commission reviewed the member composition of the ordinance. This
review occurred at 3 monthly meetings with a recommendation being
drafted at the May 5, I982 meeting. The Commission desires to retain
the term ' Airport Businessmen's Association; and suggested a change.
The change is inserted in the below paragraph of Ord. 78-36:
SECTION 1. SUBD.1. There is hereby created the Flying Cloud
• Airport Advisory Commission for the City of Eden Prairie,
Minnesota consisting of seven members to be appointed as
follows: Three members to be appointed for a term of three
years; two members for a term of two years and two members for
a term of one year, to consist of at least one member to
represent the Metropolitan Airports Commission, no less than
two members representing the Flying Cloud Airport Businessmen's i
Association to be appointed by the Mayor with the approval of

ORDINANCE ESTABLISHING THE FLYING CLOUD AIRPORT ADVISORY COMMISSION OF
EDEN PRAIRIE
Section 1. Subdivision 1. There is hereby created the Flying Cloud Airport
Advisory Commission for the City of Eden Prairie, Minnesota consisting of seven members
to be'appointed as follows: Three members to be appointed for a term of three
years; two members for a term of two years and two members for a term of one year,
to consist of at least one member to represent the Metropolitan Airports Commission
to be appointed by the Chairman of the Metropolitan Airports Commission, no less than
two members representing the Flying Cloud Airport Businessmen's Association to be
appointed by the Mayor with the approval of the City Council, and four members to be. qa
?ointed by the Mayor with the approval of the City Council. Subsequent appointments #
shall be made for three year terms. Terms shall continue until successors are appointed
and qualified.

Subdivision 2_ The purpose of this Commission is to improve the communications
between the Metropolitan Airports Commission and the City and to discuss Flying
Cloud operations as it affects the City. 3
Subdivision 3. Members of the Commission shall serve without compensation and
their respective terms of office shall expire at the end of February of the year
to which they are appointed.
Subdivision 4. Immediately following appointment of, and acceptance of such
appointment by all members of the original Commission, it shall meet and organize
by electing such officers as may be necessary, and adopt such rules, by-laws and
-egulations for the conduct of its work as it deems necessary and advisable. The
Commission shall meet at least once a quarter. Four members present at a regular or '•t'
special meeting of the conmission shall constitute a quorum.

Section 2. The Commission shall advise the City Council and the Metropolitan
Airports Commission with regard to all matters affecting the Flying Cloud Airport,
the classification, rules and regulations supplied to the operation of that airport
and the development of lands adjacent to said airport.
Section 3. The commission shall cooperate with the Metropolitan Airports
Commission staff in reviewing for the benefit of the City Council matters affecting
the use and control of Flying Cloud Airport and shall make its recommendations to
the City Council and.the Metropolitan Airports Commission upon request with regard
to any proposal effecting the use or operation of Flying Cloud Airport.
FIRST READ at a regular meeting of the City Council of the City of Eden Prairie
this 5th day of July, 1978, and finally read, adopted and ordered published at
a regular meeting of the City Council of said City on the 18th day of July

• OEVELOPER'S AGREEMENT
•
THIS AGREEMENT, made and entered into as of , 1982
by and between ZACHMAN HOMES, INC., a Minnesota Corporation, hereinafter
referred to as "Owner" and the CITY OF EDEN PRAIRIE, a municipal corporation
hereinafter referred to as "City",
• WITNESSETH:
WHEREAS, Owner has applied to City to rezone from Rural to RM 6.5
approximately 8.7 acres, situated in Hennepin County, State of Minnesota,
more fully described as Outlot C, Lake Eden, hereafter referred to as "the
property", and
WHEREAS, Owner desires to develop the property for construction thereon
8 buildings containing an aggregate of 64 units.
NOW THEREFORE, in consideration of the City adopting Ordinance 82-06,
and Resolution 82-51, Owner covenants and ayrees to construction upon, develop-
• ment, and maintenance of said property as follows:
1.Owner shall plat and develop the property in conformance
with the material dated 4/20/82 reviewed and approved
by the City Council on April 20, 1982 and attached hereto
as Exhibit A, subject to such changes and modifications as
provided herein. Owner shall not develop, construct upon or
maintain the property in any other respect or manner than
provided herein.
2.Owner covenants and agrees to the performance and observance
by Owner at such times and in such manner as provided therein
of all of the terms, covenants, agreements, and conditions
• set forth in Exhibit B, attached hereto and made a part hereof.
•
3. Owner shall, prior to the issuance of any permit for building
upon the property, install snow fencing around the tree area
as depicted on Exhibit A according to the specifications of
the Planning Director. Owner shall not nor permit others to
disturb the area within the snow fencing during construction.

4. Owner shall, prior to final plat approval, submit detailed
utility plans for the property to the City Engineer and obtain
the City Engineer's approval thereof.
5. Owner shall concurrent with street and utility construction and
prior to the occupancy of the 4th building upon the property,
construct the following in accordance with the specifications
of the City Engineer:
5a. A 4 foot wide 5 inch thick concrete sidewalk within
the right of way and east of the driving surface of
. Darnel Road commencing at the property's northwestern
most point south to Anderson Lakes Parkway asphalt
path described in 5b below and as depicted in red on
. . Exhibit A.
5b. A 8 foot wide 4 inch thick deep strength asphalt pathway
within the right of way and north of the driving surface
of Anderson Lakes Parkway commencing at the underground
tunnel located south of the property northward to the
concrete sidewalk described in 5a above and as depicted
in black on Exhibit A.
6. In implementation of the PUD and as variances from certain requirements
imposed by Ordinance 135, as amended, City authorizes the following:
a. Use of wood as an exterior material.
b. 0 lot line setback between living units and 0 lot
line for garage placement on lot lines.
c. Platting of lots without frontage on a public street.
d. Construction of a private street as depicted on Exhibit A.
7. Owner shall, prior to the issuance of any permit for building upon
the property, submit to City a detailed landscaping plan and obtain
the City's approval thereof. Such plan shall include but not be
limited to: 6-8 foot high spruceRbarberry along the property's northern
boundary as depicted on Exhibit A, and screening of the parking •
areas from the public street and surrounding single family homes.
8. Owner shall, prior to the issuance of any permit upon the property,
submit homeowner association documents to the City Attorney and
receive the City Attorney's approval thereof. Such document shall
include but not he limited to: a Management Agreement providing that
no snow storage shall occur in any public road right of way.

I. Prior to release of final plat, Owner shall submit to the City
Engineer for approval two copies of a development plan (1"=100' scale)
showing existing and proposed contours, proposed streets and lot
arrangements and size, minimum floor elevations on each lot, preliminary
alignment and grades for saritary sewer, watennain and storm sewer,
100 year flood plain contours, ponding areas, tributary areas to catch
basins, arrows showing direction of storm water flow on all lots,
location of walks, trails and any property to be deeded to the City.
•II. Owner shall submit detailed construction and storm sewer
plans to the Riley Purgatory Creek
Watershed District for review and approval.
Owner shall follow all rules and recommendations of said
Watershed District.
III• Prior to the dedication, transfer or conveyance of any real
property or interest therein to the City as provided herein,
Owner shall deliver to the City an opinion addressed to the
City by an Attorney, and in a form , acceptable to City, as to
the condition of the title of such property or in lieu of a
title opinion, a title insurance policy insuring the condition
of the property or interest therein in the City. The condition of
•' the title of any real property or any interest therein to be
dedicated, transferred or conveyed as may be provided herein by
• Owner to City shall vest in City good and marketable title,
therein free and clear of any mortgages, liens, encumbrances,
or assessments.

IV. A. All sanitary sewer, watermain and storm sewer facilities, concrete curb,
gutters,sidewalks,streets and other public utilities ("improvements")
to be made and constructed on or within the property and dedicated
to•the City shall be designed in compliance with City standards by
a registered professional engineer and submitted to the City Engin-
• eer for approval. All of the improvements shall be completed by
•
Owner & acceptable to the City Engineer and shall be free and clear
of any lien, claim, charge or encumbrance, including any for work,
labor or services rendered in connection therewith or material or
equipment supplied therefore on or before the later of, 2 years
from the date hereof or _ . 19 . Upon com-
pletion and acceptance, Owner warrants and guarantees the improve-
ments against any defect in materials or workmanship for a period
of two (2) years following said completion and acceptance. In
' the event of any defect in materials or workmanship within said
'2 year period warranty and guarantee shall be for a period of three
(3) years following said completion and'acceptance. Defects in
material or workmanship shall be determined by the City Engineer.
Acceptance of improvements by the City Engineer may be subject to
such conditions as he may impose at the time of acceptance. Owner,
through his engineer, shall provide for competent daily inspection
during the construction of all improvements. As-built drawings
with service and valve ties on reproduceable mylar shall be deliver-
ed to the City Engineer within 60 days of completion thereof to-
( gether with a written statement from a registered engineer that all
improvements have been completed, inspected and tested in accordance
with City-approved plans and specifications. Prior to final plat
approval, or issuance of any building permit, if no final plat is
• required, Owner shall:
Submit a bond or letter of credit which guarantees com-
pletion of all improvements within the times provided,
• upon the conditions, and in accordance with the terms
of this siihparagraphIV. A., including but not limited .
to, a guarantee against defects in materials or work-
manship for a period of two (2) years following com-
• pletion and acceptance of the improvements by the City
Engineer. The amount of the bond or letter of credit
shall be 125% of the estimated construction cost of
said improvements, subject to reduction thereof to an
amount equal to 25% of the cost of the improvements
after acceptance thereof by the City Engineer, and re-
ceipt of as-built drawings. The bond or letter of
credit shall be in such form and contain such other
provisions and terms as may he required by the City
Engineer. The Owner's registered engineer shall make
• and submit for approval to the City Engineer a written
•
estimate of the costs of the improvements.
II, In lieu of the obligation imposed by subparagraph V.A, above, Owner
may suhmit a 100% petition signed by all owners of the property, re-
questing the City to install the improvements. Upon approval by the
City Council, the City may cause said improvements to be made and
special assessments for all costs for said improvements will be
levied on the property, except any property which is or shall be ded-

icated to the public, over a five year period. Prior to the award
of any contract by the City for the construction of any improve-
ments, Owner shall have entered into a contract for rough grading
of streets included in the improvements to a finished subgrade
elevation. Contractor's obligation with respect to the rough
grading work shall he secured by a bond or letter of credit which
• shall guarantee completion, and payment for all labor and mater-
ials expended in connection with the rough grading. The amount

C. Prior to release of final plat, Owner shall pay to City fees for
first 3 year street lighting (public streets) engineering re-
view and street signs.
V . A. Owner shall remove all soil, and debris from, and clean, all streets
within, the property at least every two months, (or within one week
from the date of any request by City), during the period commencing
May 1 and ending October 31, of each year, until such time as such
streets and improvements therein are accepted for ownership and
maintenance by City.

Prior to City accepting streets and improvements, Owner shall have
restored all boulevards according to the obligations contained
within paragraph VI B.
B. Within 20 days of installation of utilities and street curb in any
portion of the property (if said time occurs between May 1 and
October 31 of any year) Owner shall sod (secured with a minimum of
2 stakes per roll of sod) that part of the property lying between
said curb and a line 18+ inches measured perpendicular with the
curb or in lieu of said sod, place a fiber blanket with seed ap-
proved by the City (secured with stakes a maximum of 6 feet apart).
Either sod or fiber must be placed upon a minimum of 4 inches of
topsoil. The topsoil shall be level with the top of the curb at the
curb line and rise ;;" for each foot from the curb line.
Owner shall maintain the sod, fiber blanket, topsoil, and grade
until such time as the streets and improvements in the property are
accepted for ownership and maintenance by City.
Owner shall also sod all drainage swales serving each 1.5 acres a
minimum distance of 6 feet on either side of the center of the
swale.
C. The bond or letter of credit provided in paragraph V A. hereof
shall also guarantee the performance of Owner's obligations under
this paragraph VI.
VI . If Owner fails to proceed it accordance with this Agreement within 24
months of the date hereof, Owner for itself, its successors, and assigns
shall not oppose rezoning of said property to Rural.

VII . Provisions of this Agreement shall be binding upon and enforceable against
Owner, its successors, and assigns of the property herein described.
VIII. Owner represents and warrants it owns fee title to the property free •
• and clear of mortgages, liens, and other encumbrances, except:
IX. In the event there are or will be constructed on the property, 2 or more
streets, and if permanent street signs have not been installed, Owner
shall install temporary street signs in accordance with recommendations
of the City Building Department, prior to the issuance of any permit to
build upon the property.
X . All improvements including grading, seeding, planting, landscaping,
•equipirig, and constructing of any structure to or upon any of the
property or other lands to be conveyed or dedicated to the City or
for which an easement is to be given to the City for park or other
• recreational purposes, shall be completed by Owner and acceptance to
• the Director of Community Services and shall be free and clear of any
lien, claim, change, or encumbrance, including any for work, labor, or
services rendered in connection therewith or material or equipment sup-
plied therefore on or before the later of, 2 years from the date hereof
or , 19 . Upon completion and acceptance Owner
warrants and guarantees the improvements against any defect in materials
or workmanship for a period of two (2) years following said completion
and acceptance. In the event of any defect in materials or workmanship
within said 2 year period the warranty and guarantee shall be for a
period of three (3) years following said completion and acceptance.
• Defects in materials or workmanship shall be determined by the Director
of Community Services. Acceptance of improvements by the Director of
Community Services may be subject to such obligations as he may impose
at the time of acceptance. Owner, through his engineer shall provide
for competent daily inspection during the construction of all improve-
ments. Prior to final plat approval, or issuance of any building permit,
if no final plat is required, Owner shall:

• Submit a bond or letter of credit which guarantees com-.
pletion of all improvements within the times provided, •
upon the conditions, and in accordance with the terms
of this Paragraph X ., including but not limited
to, a guarantee against defects in materials or workman-
ship for a period of two (2) years following comple-
tion and the extension of the period to three (3) years •
in the event of any defect during said 2 year period,
and acceptance of the improvements by the Director of
Community Services shall be 125% of the estimated con-
struction cost of said improvements, subject to reduction
thereof to an amount equal to 25% of the cost of the
improvements after acceptance thereof by the Director•
of Community Services. The bond or letter of credit
shall be in such form and contain such other provisions
and terms as may be required by the Director of Com-
munity Services. The Owner's registered engineer shall
make and submit for approval to the Director of Commun-
ity Services a written estimate of the costs of the
improvements.

XI . Owner acknowledges that the rights of City to performance of obligations
of owner contemplated in this agreement are special, unique and of an
extraordinary character; and that in the event that owner violates or
fails or refuses to perform any covenant, condition or provision made by 3
him herein, City may be without an adequate remedy at law. Owner agrees,
therefore, that in the event he violates, fails or refuses to perform any
covenant, condition or provision made herein, City may, at its option,
institute and prosecute an action to specifically enforce performance of
such covenant. No remedy conferred in this agreement is intended to be a

Section 1. Appendix A of Ordinance No. 135is amended as follows:
The property situated in the County of Hennepin, State of Minnesota,
described as Outlot C, Lake Eden shall be and hereby is removed from
the Rural District and shall be included hereafter in the RM 6.5 District.
Section 2. The above described property shall be subject to the
terms and conditions of that certain Oeveloper's Agreement dated as of

At the last meeting we feel that the Council Members aren't aware
as to what problems the Road will cause. We still believe it is unfair to have
the road come out by our driveway,since we were told that.there would not be any
by the City of E.P.
Mr Ryan shrugged it off that other courts come out like that. What he didn't
say was that just one unit would be more, that a court would be,and we will have
four units of eight using that street!
Also the Council was asked by one of your Council Member "Why" the street did not
come out on a court or existing street, at the first meeting but never heard
an answer! Also he stated how fine and improving it would be.
Our Homes in this area are selling in the $ 100,00.00 Group and Zachman Homes
*ants to put in a $ 50.000.00 Group. The way they plan to sell, it will be like
low rent property changing hands constantly.
The point is that we feel our property will decrease in value by at least $ 10,000.00
but then it won't cost Mr Ryan anything!He will be off somewhere else.
Also in the previous meeting Mr Ryan was giving some thougt,about a Cul-De-Sac
to come out in the next court,but this would have meant changing thgposition of
• the Buildings a bit. ,
We still feel that it should come out on Anderson Lakes Parkway only, then the Parkin
and the Snow t'emoval problem will stay in their own Complex!
It seems that E.P. should look ahead to the future & not be sorry about the
decisions they make today.
May we ask you & the Council Members to come out & see for yourself what this
Plan will do ?

Burdell Wessels Company, Corporate Risk Managers, provides
insurance services to their clients by acting as the insurance
department for them. They propose to charge $4,750 for this
service. The City is already provided with most of the items
proposed through its insurance agent and the Hennepin County 1
bids for group insurance. The areas where I feel we could benefit
from Mr. Wessel's knowledge are types of coverage, deductibles
and premiums charged. The Council could consider engaging
Corporate Risk Managers, at a cost not to exceed $1,000 to review
and make recommendations in the areas of coverages, deductibles

Annual Cost
Corporate Risk Managers, Inc. would manage the insurance functions for the
City of Eden Prairie for one (1) year at a cost of $4,750. While not anticipated,
any travel and board expenses outside of Minnesota would be additional. The
fee would be payable at a rate of $955 the first month and the balance in eleven
(11) monthly payments of $345 each over the remaining months of the contract.
