Change Order for Community Center
On September 1, 1981, the Eden Prairie City Council approved a change
order covering the fire protection package for the Eden Prairie Community
Center. Part of that package was a sprinkling system within the ice arena.
This also called for removal of a plaster ceiling over the seating area,
thus exposing the joists in the ceiling.
Attached to this memo is a letter from Magney Construction requesting a
Change order for $697 for the cost of painting those bar joists that were
originally concealed by the plaster ceiling.
Staff recommends approval of this change order in an amount not to exceed
$697.

Section 8.1B changes the procedure for computing the system
access charges made by the City. It substitutes a formula
based on square footage to the system used by Metro Waste
which approximates usage.

THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE DOES ORDAIN AS FOLLOWS:
Ordinance No. 280 is amended as follows:
Section 8.1A
Delete the present 8.1A and substitute a new
B.IA as follows:
8.1A For Sanitary Sewer: as established by the
Metropolitan Waste Control Commission and
as agreed by the City Council at its
November 17, 1981 meeting.
Section 8.18
Delete the present 8.18 and substitute a new
8.12 as follows:

Section 8.2 is amended as follows:
A. Sanitary Sewer - $.95 per 1,000 gallons subject to
a minimum of 8,000 gallons per quarter per R.E.C.
B. Water - $.71 per 1,000 gallons subject to a
minimum of 14,000 gallons per quarter per R.E.C.
C. The minimum monthly use charge for uses other
than residential shall be the same as 1 R.E.C.
D. A residential equivalent connection (R.E.C)
is one dwelling unit.
E. In addition to the charges in A,B,C, and D each
R.E.C. will be billed $6.46 each three months.
F. Unmetered residential sewer only use charges are
$14.57 per quarter and a $3.23 additional charge.
The ordinance was first read on November 17,1981. The City Council had
a second reading on , 1981.

NATURE OF THE CHANGE:
Remove and dispose of stockpile of organic clay material. Disposal
site will be the Flying Cloud landfill. Arrangements have been
made with landfill to accept material at no cost for disposal.
JUSTIFICATION:
This material was removed from beneath the existing pavement of
Franlo Road. It was removed because it is unsuitable subgrade
material. The contract assumes a disposal area adjacent to the
project. No disposal area adjacent the site is presently available.
Additional payment for removal and disposal off-site is appropriate.

RE: FRANLO ROAD UTILITY CONSTRUCTION

Dear Mr. Maheck:
The purpose of this letter is to advise you of a pending
additional cost to be incurred for street construction on the
above referenced project. The additional cost will be for the
removal of a stockpile of organic clay from the project area
and disposal of this material.
The material was excavated from the subgrade of Franlo Road
because it was unsuitable for subgrade construction. It was
originally planned that this material would be disposed of
on property adjacent to this area of Franlo Road and the bid
documents were based on this assumption.
A disposal area adjacent to the project has not been found. We
have disposed of a portion of this material by allowing other
contractors to remove it for use on other projects. The remaining
material is temporarily stockpiled on a lot adjacent to the project.
It is now mandatory that we proceed with disposal of the remaining
material before the stockpile freezes or extremely cold weather
results in the material freezing in unheated truck boxes during
the haul.
We have negotiated a price of $2.75 per cubic yard for disposal
of the material at another site. We estimate approximately 2500
cubic yards remaining in the stockpile. We propose to add by
change order $6,875.00 to the present construction contract for
this work. A copy of the proposed change order is enclosed. This
additional cost will be added to the final construction costs for
the purpose of computing final assessments.
We have estimated that this change order will increase the assess-
ment to the twelve acre parcel on the north side of Franlo Road
by approximately $4,475.00. This change order will be acted on
by the Eden Prairie City Council at their regular meeting on
December 1, 1981. If you have questions regarding this project

During construction of the sanitary sewer for this.project, two major
difficulties were encountered. Item one increases the contract by
$3,250 to compensate the contractor for demolition of a cattle pass
that was discovered during construction as well as a modification in
alignment to reduce the amount of the demolition costs.
The final item of the change order is the result of very wet conditions
encountered during the construction of the sanitary sewer. The sewer
was approximately 23 feet deep and wet soils were found at approximately
14 feet.
Although the change order is high compared to the total project costs,
I have reviewed the costs with the inspector and they appear to be
reasonable. I therefore recommend that this change order be approved.

WHEREAS, a resolution of the City Council adopted the 3rdday
of November fixed the 1st day of December 1981 as the date for a public
hearing on the following proposed improvements.
Water main, sanitary sewer, storm sewer and street improvements
for Westwood Industrial Park and adjacent properties.
WHEREAS, all property owners whose property is liable to be
assessed for the making of this improvement were given ten days published
notice of the Council hearing through two weekly publications of the
required notice and the hearing was held and property owners heard on the
1st day of December, 1981.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EDEN PRAIRIE:
1. The City Engineer is hereby designated as the Engineer for
this project and is hereby directed to prepare plans and
specifications for the making of such improvement, with

for the City of Eden Prairie.
BACKGROUND:
I have been in real estate for llk years, 7 of which as a broker. I
am currently Vice President of Bermel-Smaby, Realtors, managing an
office of 14 associates. I am also an instructor in real estate,
having taught at all levels since 1972. I am a resident of Eden Prairie
since 1972.
REASONS FOR APPLYING:
It interest in the continued growth of our community is long-standing.
I have a comprehensive understanding of the nature of community growth
and development, and an interested in being an active part of that
growth. I believe that community growth requires analyses of the prob-
lems inherent to that growth, and a comprehensive understanding of the

NOW THEREFORE, in consideration of the City adopting Ordinance No.
81-20, And Resolution Nos. 81-187, and 81-188, Owner covenants and agr

follows:
1. Owner shall plat and develop the property in conformance
with the material dated 9/9/81 reviewed and approved by
the City Council on 9/15/81 and attached hereto as Exhibit 8,
herein. Owner shall not develop, construct upon, or
maintain the property in any other respect or manner than
provided herein.
2. Owner covenants and agrees to the performance and obser-
vance by Owner at such times and in such manner as provided
therein of all of the terms, covenants, agreements, and
conditions set forth in Exhibit C, attached hereto and
made a part hereof.

9. Owner shall screen all mechanical equipment with material
integral to the materials of the buildings, and screen all
parking and loading areas according to City Ordinance.

11. Owner shall agree to accept 'fair share' assessments for the
western road, the right-of-way of which is required to be

I. Prior to release of final plat, Owner shall submit to the City
Engineer for approval two copies of a development plan (1"=100' scale)
showing existing and proposed contours, proposed streets and lot
arrangements and size, minimum floor elevations on each lot, preliminary
alignment and grades for sanitary sewer, watermain and storm sewer,
100 year flood plain contours, ponding areas, tributary areas to catch
basins, arrows showing direction of storm water flow on all lots,
location of walks, trails and any property to be deeded to the City.
Owner shall submit detailed construction and storm sewer
plans to the Nine Mile Creek
Watershed District for review and approval.
Owner shall follow all rules and recommendations of said
Watershed District.
( III. Owner shall pay cash park fees as to all of the property required
by any ordinance in effect as of the date of the issuance of each
building permit for construction on the property. Presently,
the amount of cash park fee applicable to the property is
$ 1,400per acre. The amount to be paid by Owner shall be increased
or decreased to the extent that City ordinances are amended or
supplemented to require a greater or lesser amount as of the date
of the issuance of any building permit for construction on the
property.
IV. Prior to the dedication, transfer or conveyance of any real
property or interest therein to the City as provided herein.
Owner shall deliver to the City an opinion addressed to the
City by an Attorney, and in a form • acceptable to City, as to
the condition of the title of such property or in lieu of a
title opinion, a title insurance policy insuring the condition
of the property or interest therein in the City. The condition of
the title of any real property or any interest therein to be
dedicated, transferred or conveyed as may be provided herein by
Owner to City shall vest in City good and marketable title,
therein free and clear of any mortgages, liens, encumbrances,
or assessments.

V. A. All sanitary sewer, watermain and storm sewer facilities, concret

curb, gutters, sidewalks and other public utilities ("improvements")
to be made and constructed on or within the property and dedicated
to the City shall be designed in compliance with City standards by
a registered professional engineer and submitted to the City Engin-
eer for approval. All of the improvements shall be completed by
Owner & acceptable to the City Engineer and shall be free and clear
of any lien, claim, charge or encumbrance, including any for work,
labor or services rendered in connection therewith or material or
equipment supplied therefore on or before the later of, 2 years
from the date hereof or , 19 . Upon com-
pletion and acceptance, Owner warrants and guarantees the improve-
ments against any defect in materials or workmanship for a period
of two (2) years following said completion and acceptance. In
the event of any defect in materials or workmanship within said
2 year period warranty and guarantee shall be for a period of three
(3) years following said completion and acceptance. Defects in
material or workmanship shall be determined by the City Engineer.
Acceptance of improvements by the City Engineer ney be subject to
such conditions as he may impose at the time of acceptance. Owner,
through his engineer, shall provide for competent daily inspection
during the construction of all improvements. As-built drawings
with service and valve ties on reproduceable mylar shall be deliver-
ed to the City Engineer within 60 days of completion thereof to-
gether with a written statement from a registered engineer that all
improvements have been completed, inspected and tested in accordance
with City-approved plans and specifications. Prior to final plat
approval, or issuance of any building permit, if no final plat is
required, Owner shall:
Submit a bond or letter of credit which guarantees com-
pletion of all improvements within the times provided,
upon the conditions, and in accordance with the terms
of this subparagraph V. A., including but not limited
to, a guarantee against defects in materials or work-
manship for a period of two (2) years following com-
pletion and acceptance of the improvements by the City
Engineer. The amount of the bond or letter of credit
shall be 125% of the estimated construction cost of
said improvements, subject to reduction thereof to an
amount equal to 25% of the cost of the improvements
after acceptance thereof by the City Engineer, and re-
ceipt of as-built drawings. The bond or letter of
credit shall be in such form and contain such other
provisions and terms as may be required by the City
Engineer. The Owner's registered engineer shall make
and submit for approval to the City Engineer a written
estimate of the costs of the improvements.
B. In lieu of the obligation imposed by subparagraph V.A. above, Owner
may submit a 100% petitien signed by all owners of the property, re-
questing the City to install the improvements. Upon approval by the
City Council, the City may cause said improvements to be made and
special assessments for all costs for said improvements will be
levied on the property, except any property which is or shall be ded-

VIII. Provisions of this Agreement shall be binding upon and enforceable against
Owner, its successors, and assigns of the property herein described.
IX. Owner represents and warrants it owns fee title to the property free
and clear of mortgages, liens, and other encumbrances, except:

Re: Edenvale Apartments Housing Revenue Bonds-$7,765,000
Mr. Bader and Mr. Baratz propose to construct a 174 unit apartment
building with 35 units available for rent subsidies under the Section 8
Housing Assistance Program. This process is somewhat different than
MIDB's in that the public hearing required is a "planning" type hearing.
The process:
1. City may approve Resolution 81-240 which grants preliminary
approval to the financing and grants authority to proceed.
2. Hold a public hearing on a Housing Plan (The City's Guide
Plan) and a Housing Program (which will be a statement as
to how this project fulfills the objectives of the Housing
Plan i.e. the Guide Plan.
3. Hearing is held.
4. Review by the Met Council.
5. Review by the Minnesota Housing and Finance Agency.
Please refer to the letter by Russell Prince of Juran and Moody dated
November 4, 1981 which explains the security behind the bond issue.

EDENVALE APARTMENT'S conformance to City's
Housing Assistance Plan
Back during the Guide Plan Update drafting, 1975-1976, Eden Prairie was
assigned a housing goal of 1,338 subsidized units for the ten year
period of 1980-1990. The breakdown was 60% family and 40% elderly.
In 1978, the Metro Council revised housing allocations to reflect fund-
able number of units. Eden Prairie was assigned 34 units/year for the
3 years of 1978-1981. A range of units for the City to strive for over
this period would be 18-54 family units/year.
The Edenvale Apartment project of 175 units with 34 being subsidized, is
in conformance with Eden Prairie's Housing Assistance Plan and Comprehensive
Guide Plan, and will directly conform and contribute to the City attaiming
a portion of its allocated subsidized housing units.

RE: EDENVALE APARTMENTS PROPOSED FINANCING
Dear Mr. Frane:
This letter is to further expand on the security of and structure for
the proposed bond issue which Edenvale Apartments is requesting. I
have discussed this matter with Catherine Bartlett, bond counsel with
the Dorsey law firm, in order to provide you with a more detailed
understanding of the process.
It is important to understand there are two simultaneous loan
transactions occuring at once:
1. The HUD insured mortgage loan, and
2. The Housing Revenue Bond issue secured by:
a. the HUD insured mortgage loan,
b. a contribution from the developers, and
c. the debt service reserve fund.
The developers have applied for and received a commitment from HUD to
insure a mortgage loan on the Edenvale Apartments project in an
amount up to $6,736,000. HUD will issue mortgage insurance equal to
99% of the amount of the mortgage note. The developer will secure
the remaining 1% with cash, letter of credit or other security
acceptable to HUD, Standard and Poor's and the Trustee.
The bond issue will be in an amount equal to the size of the mortgage
note plus a debt service reserve fund. The debt service reserve fund
Is equal to one year's maximum debt service on the bond issue.
The HUD insured mortgage loan and the bond issue are cross-
collateralized. In the event a payment on the mortgage loan is
missed, the mortgage loan is in default and the Trustee must do three
things:
1. The Trustee must give notice of the default to HUD as
soon as there is a default,
2. The Trustee must file the "Election to Assign" normally
within thirty days, and
3. The Trustee must then record the Assignment of Mortgage
to HUD.

After the Trustee has filed the Election to Assign, the Trustee m

then use the funds held in the debt service reserve fund to pay deb

service on the mortgage loan. The reason that he may now use these
funds is that after the election to assign has been completed, HUD is
obligated to repay the used portion of those funds less one month's
Interest. In other words, if any of the debt service reserve funds
were ever used, HUD would reimburse the Trustee for those funds used
less one month's interest, as well as the 99% insured portion of the
principal.
The total exposure to a risk of loss is now reduced to one month's
Interest on the loan. This amount is covered by requiring the
borrower, in addition to putting up 1% of the principal amount of the
mortgage loan, to ALSO put up an amount equal to the one month's
interest not reimbursed by HUD in the form of cash or a letter of
credit. In this way, under the worst possible circumstances, the
investors are protected from any risk of loss due to a default on th
e
payments.
Structured in this manner, the public bond issue can obtain a trippl
e
A rating from Standard and Poor's, the highest rating possible
signifying this is the safest, most secure possible type of
investment. We will be happy to discuss this or any other matters i

regard to this issue hopefully at the November 17, 1981, Counci
l
Meeting.

This morning Mr. Rosow called to ask me to send additional
information to you and to him concerning the Edenvale Apartments
developer's ability to manage a large scale multifamily apartment
project.
The partners of the applicant, Edenvale Apartments, are Mr. Sid Bader
and Mr. Zollie Baratz. They formed Z & S Management Company in
1968. At that time they managed 1,000 units. Over the years they
have acquired and built new units to the point where they now own,
manage or control over 4,000 units in the metropolitan area. These
include units in Minneapolis, St. Paul, East St. Paul, West St. Paul',
Brooklyn Park, New Hope, Shoreview, St. Louis Park, Blaine and their
newest project, Duckwood Park in Eagan. In addition, they manage 500
units of rental apartments in Omaha, Nebraska.
Z & S Management Company is a full service property management
company. They employ their own maintenance crews and building
managers. The partners and their employers have been very active
with the Minnesota Multihousing Association and recently
Steve Schachtman with Z & S has been elected the 1982 president of
that organization.
We are sure you will agree with us that the applicants have an
excellent and successful background in the area of property
management and are fully qualified to successfully manage the
Edenvale Apartments.

RESOLUTION RELATING TO THE ISSUANCE OF REVENUE
BONDS PURSUANT TO CHAPTER 462C, MINNESOTA
STATUTES, FOR THE PURPOSE OF FINANCING A
MULTI-FAMILY HOUSING DEVELOPMENT; GIVING
PRELIMINARY APPROVAL TO THE DEVELOPMENT,
AUTHORIZING A PUBLIC HEARING ON THE HOUSING PLAN
AND THE PREPARATION OF A PROGRAM AND AUTHORIZING
SUBMISSION OF THE HOUSING PLAN AND PROGRAM FOR
REVIEW
BE IT RESOLVED by the City Council of the City of
Eden Prairie, Minnesota (the City), as follows:
Section 1. Recitals.
1.01. By the provisions of Minnesota Statutes,
Chapter 462C, as amended (the Act), the City is authorized
to plan, administer, issue and sell revenue bonds or
obligations to make or purchase loans to finance one or
more multifamily housing developments within its
boundaries which revenue bonds or obligations shall be
payable solely from the revenues of the development.
1.02. The Act provides that, prior to issuing
revenue bonds or obligations to finace a multifamily
housing development, the City must develop a housing plan
and, after holding a public hearing thereon after notice
published at least thirty days prior thereto, submit the
housing plan for review to the regional development
commission.
1.03. The Act further provides that the City may
plan, administer and make or purchase a loan or loans to
finance one or more developments of the kinds described in
Subdivisions 2,3,4 and 7 of Section 462C.05 of the Act
upon adoption of a program setting forth the information
required by Subdivision 6 of Section 462C.05 of the Act
after a public hearing thereon and upon approval by the
Minnesota Housing Finance Agency as provided by Section
462C.01 of the Act on the basis of the considerations
stated in Section 462C.04 of the Act.

Section 2. Approvals; Authorization and Hearing.
2.01. It is hereby found and determined that it
would be in the best interests of the City to issue the
Bonds under the provisions of the Act to finance the cost
of the Project in an amount currently estimated to be
$7,765, 00.
2.02. The Project is hereby given preliminary
approval by the City and the issuance of the Bonds for
such purpose approved, subject to conditions on such
approval as may be required as a result of the public
hearing called pursuant to Section 2.04 hereof. The Bonds
shall not be issued until the housing plan and the
multifamily housing program described below have been
reviewed and approved as provided by the Act and until the
City, the Partnership and the Underwriter have agreed upon
the details of the Bonds and the provisions for their
payment. The principal of, premium, if any, and interest
on each Bond, when, as and if issued, shall be payable
solely from the revenues of the Project and the property
pledged to the payment thereof and shall not constitute a
debt of the City. The City Attorney and other officers of
the City are authorized in cooperation with Dorsey,
Windhorst, Hannaford, Whitney & Halladay, as bond counsel,
to initiate preparation of such documents as may be
appropriate to the financing of the Project setting forth
the detailed terms of the Bonds, the security therefor and
provisions for payment of the principal, premium, if any,
and interest thereon in compliance with state and federal
statutes and regulations.
2.03. The Eden Prairie Guide Plan Update, a
report prepared by the City of Eden Prairie and Brauer &
Associates, Inc., sets forth, inter alia, information
relating to the housing needs of the City and data
demonstrating those needs, the plan of the City to meet
identified housing needs and specific methods to be used
to carry out the plan; the Eden Prairie Guide Plan Update
therefore contains in pertinent part the information
required by Subdivision 1 of Section 462C.03 of the Act.
The Planning Department of the City is hereby authorized
to prepare a program for a multifamily housing development
pursuant to the requirements of Subdivision 5 of Section
462C.05 of the Act (the Program). After preparation
thereof, the City Clerk is hereby authorized to cause
notice of public hearing (in substantially the form of
Exhibit A hereto) to be published in the Minneapolis
Star/Tribune and in the Eden Prairie News at least thirty

days before the date on which a public hearing on the Eden
Prairie Guide Plan Update as it relates to the housing
needs of the City and the Program will be held by this
Council. The City Clerk and the City Manager are
authorized to establish the date of such public hearing.
Subsequent to the public hearing, the Mayor, City Manager,
City Clerk and other officers and employees of the City
are hereby authorized to submit the Eden Prairie Guide
Plan Update to Metropolitan Council for review and comment
pursuant to Subdivision 1 of Section 462C.04 of the Act
and to prepare and execute the required certifications and
submit the Program to the Minnesota Housing Finance Agency
for review and approval in accordance with Subdivision 5
of Section 462C.05 and Subdivision 2 of Section 462.04 of
the Act.
2.04. Pursuant to Subdivision 1 of Section
462C.07 of the Act, in the making of the loan to finance
acquisition, construction and equipment of the Project and
in the issuance of the Bonds or other obligations of the
City, the City may exercise, within its corporate limits,
any of the powers the Minnesota Housing Finance Agency may
exercise under Chapter 462A, Minnesota Statutes, without
limitation under the provisions of Chapter 475, Minnesota
Statutes.
2.05. The Developer has agreed to pay directly
or through the City any and all costs incurred by the City
in connection with the Project whether or not the Project
is approved by the Minnesota Housing Finance Agency;
whether or not the Project is carried to completion; and
whether or not the Bonds and all operative instruments are
executed.
2.06. The adoption of this resolution does not
constitute a guarantee or a firm commitment that the City
will issue the Bonds as requested by the Developer. The
City retains the right in its sole discretion to withdraw
from participation and accordingly not issue the Bonds
should the City at any time prior to the issuance thereof
determine that it is in the best interest of the City not
to issue the Bonds or should the City, the Developer and
any other parties to the transaction be unable to reach
agreement as to the terms and conditions of any of the
documents required for the transaction.
2.07. All commitments of the City expressed
herein are subject to the condition that within twelve
months of the date of adoption of this Resolution the City
and the Developer shall have agreed to mutually acceptable

terms and conditions of the Bonds, the operative documents
and of the other instruments and proceedings relating to
the Bonds and their issuance and sale. If the events set
forth hereindo not take place within the time set forth
above, or any extension thereof, and the Bonds are not
sold within such time, this Resolution shall expire and be
of no further effect.

City of Eden Prairie this day of 1981.

NOTICE IS HEREBY GIVEN by the City Council of the

Prairie, Minnesota, on the day of

The Municipal Housing Bond Act provides that

data demonstrating those needs, recommendations for
housing policies, goals and specific objectives for the

approximately 174 rental units, parking and related
facilities. Revenues of the development will be pledged
to the payment of the bonds or obligations issued to
finance the development; such obligations will be payable
solely from the revenues of the development and shall not
constitute a debt of the City. The Program describes the
need for the development and the method of financing
proposed and states that the development is to be
constructed pursuant to Section 462C.05, Subdivision 2, of
the Municipal Housing Bond Act.
A copy of the Eden Prairie Guide Plan Update and
a copy of the Program are on file and available for
Inspection in the office of the City Manager at City Hall.

MEMORANDUM
We would suggest to the Council that an appropriate response to the attached
correspondence of November 18 from Commissioner Robb should include the following
considerations:
1. We are anticipating receipt in the near future of an application
by Browning Ferris Industries for a permit to amend their PUD
Concept Plan to allow expansion of the Flying Cloud Landfill.
The City's review of this application will most likely address
many •f the concerns the City may also have regarding resource
recovery and transfer stations.
2. We are not opposed to such facilities per se, but we do have
concerns related to traffic safety, fire safety, noise and odor
control, potential for groundwater pollution, responsibility
for overall licensing, inspection and control, tax exempt status,
etc. If these areas of concern were properly addressed the
City could be supportive of such facilities.
It is recommended that the Council direct staff to respond by letter to
Commissioner Robb conveying these general comments and any other thoughts the
Council may have.

Subject: Solid Waste System (Reply requested)
A solid waste system* must objectively deal with 1) reduction of initial
materials 2) collection 3) treatment 4) disposal.
In "collection" we move from the garbage can, a one man operation, to a
conveyance vehicle, a truck. Where does that truck go? How much does it carry
by weight and volume? How big is the truck, how maneuverable, how heavy, how
far must it travel. Who pays for it and its personnel. Where does it unload? .
Small trucks able to negotiate densely populated, tightly configured res-
idential and commercial, initial collection sites are not "long haul" vehicles
in a cost/energy-effective sense. To maximize their role, they must be able
to "dump" proximate to their collection points. Their dumping must be at trans-
fer stations, resource recovery centers, or landfills which studies have shown
are necessary in Hennepin County. Distance travelled is important at this
stage.
Key questions to municipalities are: 1) "Is your city prepared to accept
a "landfill" for disposal of solid waste?" 2) "Is your city prepared to accept
a "resource recovery" treatment plant to absorb some of the solid waste stream?"
3) "Is your city prepared to accept "transfer stations" to shift solid waste
from small vehicles, short haul, to larger vehicles,longer haul, perhaps with
more densely compacted materials, to aid in the disposal of solid waste in
Hennepin County?" (If your answer to any of these questions is "yes", my next
question to you will be, "Where?")
We are all generators of solid waste and we cannot expect our neighbors to
accept our "dumpings".
As the Hennepin County Board addresses the "landfill" problem, mandated
by the state legislature, it must anticipate municipal reactions to the above
three key questions. I respectfully request that you and your governing body
address these three questions promptly, forthrightly, and objectively. I will
appreciate your answers.

Proximity to "Fairway" and Nursery Stock Area
The proximity of the trail to these sensitive areas on your site should be
controlled by your location of the trail. As Mr. Ilirritan indicated, you
might have to consider fencing these areas.
Areas Which are Low or Soft and the Affect on the Trail
City staff has had a great deal of experience in developire hard surface
trails over various types of terrain over the last three years. When your
staff locates the trail alignment, we will review the alignment and the soils
and design trail standards to take soil conditions into consideration.
Obviously, the hard surfaced trail cannot be built on a marsh or in soils .that
are too soft. However, we have walked the site and feel satisificd that a
hard surface trail can be developed in that area.
Two Trails Rather Than Three
Mr. Sullivan indicated that your staff would prefer to two trails rather than
the three proposed. The two trails being a hard surface trail and a mowed
surface. It should be noted that if an equestrian trail is developed around
Staring Lake it would be a year-round use and is not compatible with either
a cross country ski trail or a hard surface trail for pedestrian and bicycle
use. Therefore, if two trail locations must be a condition of the lease,
the City would probably eliminate the equestrian trail.
Aggregate as a Final Surface
City staff are familiar with aggregate surfaced trails. These trails are
satisfactory on areas such as old railroad beds where they are generally on the
highest terrain. However, when it is necessary to provide drainage across
that type of a trail the surface stays soft and mushy and is not satisfactory
for bicycle use. We feel an aggregate trail in this location would be an
unsatisfactory surface.
Horses Staying on the Trail
The City presently doesn't have any equestrian trails within the park system
and quite frankly has had many problems keeping horses off of freshly seeded
ballficlds and out of parks where they arc not allowed. Due to the year-round
use of horses, we may have a difficult time keeping horses on the trail.
Bridge Location
City staff and Hennepin County Vo-Tcch staff will have to agree on the location
of the crossing of the creek at both locations. City staff have a general
idea of the approximate location and seem to be in agreement with the sites
chosen by your staff.

EASEMENT AGREEMENT
This is an easement agreement Made this day of 1981,
between 3oint independent School District No. 287 (Hennepin County Area
Vocational-Technical Schools), a Minnesota independent school district ('ye-Tech"),
and the City of Eden Prairie, a Minnesota municipal corporation ("City").
RECITALS
1. Vo-Tech is the owner In fee simple of the real property legally
described in Exhibit A, which is attached hereto and incorporated herein by this
reference (the "easement area"). • •
2. Vo-Tech and City wish to enter Into an easement agreement which
will grant to City an easement with respect to the easement area.
AGREEMENTS
The parties agree as follows:
I. Grant of Easement. yo-Tech hereby grants, bargains, sells, and
conveys to City and its successors and assigns on all of the terms and conditions of
this agreement an easement on, over, under, and across the easement area, and
City hereby accepts the easement.
2. Duration of Easement. The easement is perpetual.
3. Purpose of Easement. The easement is granted for the purposes of
allowing City to construct and maintain and City's licensees to use a walkway, a ski

Description of Pathways. The pathways shall be constructed within a
corridor of land which is twenty feet wide and which runs approximately Parallel to
the shoreline of Staring Lake. The precise location of the pathway corridor within
the easement area shall be as reasonably selected by City. City may construct the
pathway surfaces from any materials it reasonably deems appropriate, including but

SUBJECT: Kiosk Information Center
As the development of Round Lake Park is completed, staff is recommending
construction of a kiosk information center. This small structure would
be located between the parking lot and the beach approximately halfway
between the two park shelters.
This four sided structure would have a roof designed similar to the two
existing park shelters. It would be a four sided structure that would
have the following uses on each side:
Side one a public pay telephone.
Side two a relief map of the park so people could see where
picnic areas are located, where various trails lead
to, the location of ballfields by number, etc.
Side three - bulletin board to provide information on athletic
teams use of Round Lake Park, for example: softball
game schedules, team standings, scheduled use of all
facilities, ballfields, tennis courts, etc. by the
school and for City programs, etc.
Side four - A bulletin board providing information on park use, for
example: advertising for the Lions Club Corn Feed,
Schooner Days, etc. and other public events, as well
as reservation schedules on the buildings, rules of the
park, etc.
Attached is copy of a concept design for this structure. The preliminary
cost estimate is $1,500. On November 16, 1981, the Parks, Recreation and
Natural Resources Commission recommended approval of the construction of this
information center.
KIOSK (Webster's definition for all of your wondering:)
1. In Turkey and Persia, a summer house or pavilion of open
construction.
2. A somewhat similar small structure open and one or more
sides used as a newsstand, bandstand, entrance to a subway, etc.
3. In Eden Prairie - a small four sided structure used as an information

Neighborhood Park Shelter Program
In October of 1981, the Eden Prairie City Council approved hiring Schwartz/
Weber Associates as the architectural firm to design a neighborhood park
shelter with four model variations to be used in various neighborhood parks
throughout Eden Prairie. The following program lists the program requirements
for this structure as approved by the Parks, Recreation and Natural Resources
Commission on November 16, 1981. Staff requests the City Council to review
and approve these program requirements in order to give the architect a good
definition of our final product.
1. Meeting room space - 400 sq. ft.
2. Storage room space (could be within the mechanical room) - 400 sq. ft.
3. Restrooms - access from interior and exterior.
4. Heating - initial phase electrical space heaters, final phase
gas forced air, investigate maximum use of passive solar heating.
S. Water - drinking fountain interior and exterior. Fountain to
drain automatically below frost level to eliminate requirement
of heating buildings year-round.
6. Sanitary Sewer - Buildings should plan for either existing or
future connections for sanitary sewer. Most neighborhood park
shelters will not require sanitary sewer hookups at this time
due to the distance of sanitary sewer in relation to the building
locations and present use of the these facilities.
7. All doors shall be steel and insulated. All door and window frames
. shall be steel. All doors should have flush key deadbolt locks with
no exterior doorknobs.
8. Windows - Double glazed tempered glass with wire mesh vandal proof
screen on the exterior.
9. Interior walls shall be either of concrete block or one-half inch
plywood. Ceilings to be one-half inch plywood.

10. Floors - concrete with deduct alternate of rubberized flooring.
11. Exterior siding of wood or decorative concrete block or both.
12. Lighting - all exterior lighting in the public areas should be
flush with the ceiling with a vandal proof covering.
13. Telephone - public pay telephone should be mounted on the exterior of
all the buildings or located near the building and provisions
made for a telephone for staff use in the storage room.
14. Mechanical Room - electrical panel for all park lighting will
include hockey lights, building lights, ski area lights and
parking lot lights. Recommended minimum size 200 amps service.
15. Preliminary estimated cost for each building is approximately
$40,000 for 800-900 sq. ft. •
It should be noted that the present use of our park shelters in neighborhood
parks is limited to approximately 9-10 weeks in the winter for use as a warmi

house and approximately 6 weeks in the summer for use by the neighborhood
park recreation programs. Staff feels that in 10-20 years the function of
these shelters may change as more neighborhood identity develops as neighborh

age. The transit population will decrease and people will begin to identify

with being a resident within a certain neighborhood. The average age of the
neighborhood resident will increase and in time most neighborhoods will also
increase in population as the City continues to develop. Staff believes
that the various athletic associations will ultimately form neighborhood
teams of each age group that would compete with other neighborhood teams wit

the comaunity. These neighborhood teams would use the local neighborhood par

as their practice fields. Games on Saturdays would probably still be played
at the Community parks and ballfields. As more use of the neighborhood park
occurs, the neighborhood park shelter will require an expanded program. Sta

would suggest that the architect design a building that would serve to mee

todays function but will expand to meet future needs, for example, the initi

phase of the building may include an enclosed warming house space of approxi

400 sq. ft. that perhaps might have a drinking fountain but no restrooms and
would be heated with electrical space heaters. At the same time, the footi

and the roof could be constructed for the second phase of the building that
would include the mechanical room and restrooms. In the meantime, this spa

could be used as an open sided park shelter. This would reduce the cost of
t
h
e
first phase building and would made it very easy to add the second phase wh
e
n
the program or use of the building justifies it.
At this time, staff would only recommend constructing park shelters where t
h
e
City builds a hockey rink. Staff would estimate that a park shelter would

constructed at Red Rock Park in 1982 and possibly at Homeward Hills in 1982

Future neighborhood park sites with a park shelter of the magnitude would be
the Franlo Road Park, Edenvale East Park and the two neighborhood parks th

will eventually serve the Cedar Hills area and the Crestwood area. Eventua
