RE: Procedure for Filling Council Vacancy
The following information is provided in order to assist the Council in determining the process to
fill the vacancy in the Mayor's position. Minnesota Statutes § 412.02, subd. 2(a) sets forth the
method by which a council vacancy must be filled and provides as follows:
Vacancy. Except as otherwise provided in subdivision 2b, a vacancy in an office
shall be filled by council appointment until an election is held as provided in this
subdivision. In case of a tie vote in the council, the mayor shall make the
appointment. If the vacancy occurs before the first day to file affidavits of
candidacy for the next regular city election and more than two years remain in the
unexpired term, a special election shall be held at or before the next regular city
election and the appointed person shall serve until the qualification of a successor
elected at a special election to fill the unexpired portion of the term. If the
vacancy occurs on or after the first day to file affidavits of candidacy for the
regular city election or when less than two years remain in the unexpired term,
there need not be a special election to fill the vacancy and the appointed person
shall serve until the qualification of a successor. The council must specify by
ordinance under what circumstances it will hold a special election to fill a
vacancy other than a special election held at the same time as the regular city
election.
Mayor's Vacancy
A vacancy in the Mayor's office must be filled by the Council. The statute is mandatory
and has been interpreted as such by the Attorney General. The Council may not elect to have the
Acting Mayor .perform.the duties of the Mayor for the remainder of the unexpired term of Mayor
Harris. This section applies to both a vacancy in the Mayor's position as well as any Council
Member's position. In the case of the Mayor's position, since Mayor Harris's unexpired term
was less than two years, the Council must do either of the following: (i) appoint a person to serve
the remainder of Mayor Harris's term or (ii) appoint a person to serve until the Mayor's position
is filled by a special election. If a special election is chosen, the Council must: (i) specify by an
ordinance under what circumstances it will hold a special election to fill a vacancy other than a
special election held at the same time as the regular city election and (ii) appoint an individual to
serve as Mayor until an individual is elected pursuant to the special election. If a special election
is held, the City Clerk must give no less than 49 days prior notice to the County Auditor which
includes the date of the election, the office or offices to be voted upon and the title and language
for each ballot question to be voted on in the election.

Please consider our request for appointment of the Eden Prairie News as the official newspaper for the City of
Eden Prairie in 2002.
Legal notices published in the Eden Prairie during this time period will be billed at the rate of $10.23 per column
inch for the first insertion and $7.67 per column inch per subsequent insertions.
The city can take advantage of a lower rate if it submits legal notice copy electronically via e-mail. Publication
copy must be submitted in a generic text format and readable by our IBM compatible word processors. This
system allows for a substantial labor savings if the Eden Prairie News staff does not have to retype the notices
prior to them being published in the newspaper. E-mailed legals should be sent to: legal@swpub.com . The rate
for the materials submitted in this manner would be $8.18 per column inch, reflecting a 20% cost savings to the
City of Eden Prairie.
Most standard legal notices (those without maps, graphics or special tabular information) submitted by the city
will be posted on our newspaper website, www.edenprairienews.com , free of charge.
Our legal notice deadline is at 4 p.m. on Thursday, preceding the following week's publication date; during
holiday weeks the deadline may be advanced.
In accordance with Minnesota Statute 331A.02, the Eden Prairie News has met certain qualifications in order to
become a legal newspaper to better serve the community. Some of the qualifications we must meet to become a
legal newspaper include: distribution of the paper at least once a week for 50 weeks out of the year; be circulated
in the local public corporation which it purports to serve, and either have at least 500 copies regularly delivered
to paying subscribers, or have at least 500 copies regularly distributed without charge to local residents; have its
known office of issue established either in the county in which is lies in whole or in part, the local public
corporation which the newspaper purports to serve, or in an adjoining county; file a copy of each issue immedi-
ately with the state historical society; etc. These are just a few of the stringent guidelines a newspaper must fulfill
in order to become a certified legal newspaper. It is our goal to serve you as your legal newspaper for the coming
year.
