ACCEPT DONATION FROM BLAKE BIDWELL EAGLE SCOUT PROJECT FOR BLEACHER COVERS AT EDEN LAKE PARK (Resolution) Synopsis: Boy Scout Blake Bidwell recently completed his Eagle Scout project of installing shade structures over the dugouts at one of the Eden Lake baseball fields. As part of this project, Blake exceeded his fundraising goal of $13,000 to pay for the purchase of the shade structures and installation materials. As part of the project guidelines, any funds left over after the project is completed are to be donated to the beneficiary of the project. MOTION: Move to adopt the Resolution accepting the donation in the amount of $113.03 for Park Maintenance. B. ACCEPT CONTRIBUTION FOR HARVEST TO HALLOWEEN FROM HUMANA (Resolution) Synopsis: Each October the Parks and Recreation Department coordinates a fall themed city event. This year the Harvest to Halloween event will be held on Saturday, October 15 at Riley-Jacques Barn. This free event features a variety of family activities, with a free pumpkin decorating station among the most popular for youth of all ages. STRATEGIC PLAN FOR COMMUNITY DEVELOPMENT Klima presented on the Community Development Strategic Plan. The Strategic Plan takes a phased approach in comparison to Aspire 2040, a 10-year plan. The Strategic Plan spans five years. The 2023-2027 Strategic Plan has a handful of priorities, including the Race Equity Report. Since the Council recently spent a workshop on this, there won’t be a large amount of detail at this meeting. Stanley presented on Housing priorities. Housing programs include the Housing Rehab and First Time Homebuyer Loans, senior home maintenance programs, Community Land Trust Partnership with the West Hennepin Affordable Housing Land Trust (WHAHLT) homes in Eden Prairie, Housing Improvement Areas (HIAs), and Property Managers Collaborative. There were 17 housing rehab loans and three first time homebuyer loans in 2021. Case inquired what is typical of numbers. Stanley replied due to a backlog of projects with supply chain issues, in 2023 there will likely be about 30 home rehab loans and 10 first time homebuyer loans. Stanley stated Community Development Block Grant (CDBG) funds and general fund dollars are given to Senior Community Services HOME Program to assist with projects including basic home maintenance, shoveling services, and sprucing up of properties. There were three senior City grants given in 2021, up to $5,000 each, for home maintenance such as replacing a furnace. This is one service Staff would like to advertise more. The Community Land Trust Partnership with WHAHLT assisted with 18 homes. Staff continue to find it difficult to fund with CDBG as there are parameters of assisting up to 50 percent of area median income (AMI). AMI in 2022 was $118,200. At 50 percent AMI for a household of four is earning $16,000. Housing Improvement Areas (HIAs) is also offered but it requires City Council Workshop Minutes September 20, 2022 Page 2 a supermajority to agree on being specially assessed for an improvement. This is for common interest communities or townhome developments. Another initiative Staff have spent some time on recently is the property managers collaborative. Staff has had a variety of meetings to work on establishing good relationships. Staff are working on putting together a more professional newsletter to send out communications on a less frequent basis. There would be quarterly meetings. Stanley stated the inclusionary housing ordinance has been going well. When using tax increment financing (TIF), Staff have been able to have an offering of 20 percent of units at or below 50 percent (AMI) with a mandated five percent at or below 80 percent AMI. The 80 percent AMI or below is in perpetuity. When the TIF expires, those units will continue to be affordable. There are a handful of affordable housing opportunity sites: a parcel on Venture Lane, transit-oriented development (TOD) opportunity sites, parcels on the northeast corner of Flying Cloud Drive and College View Drive, and possible church sites. The Metropolitan Council has an expectation of number of affordable units produced based on the regional allocation of affordable housing. By 2030, Metropolitan Council’s hope is for Eden Prairie to produce 1,408 affordable units. Since 2019, there have been 391 affordable units produced. About 24 percent of housing development has been affordable since 2019. The bulk of the need is at 30 percent AMI. It is extremely challenging to produce. 57 percent of the housing need, according to Metropolitan Council, is at or below 30 percent. Currently about seven percent of units being produced are at or below 30 percent AMI. The 50 percent AMI units have been achieved almost exclusively by TIF. Some have been negotiated outside of TIF such as Eden Prairie Senior Living and Prairie Bluffs Senior Living. 60 percent AMI units are also lower in number because it is the low-income housing tax credit threshold. Nelson inquired if there have been more perpetually affordable units with TIF. Stanley replied those units are expected to be in perpetuity. The Inclusionary Housing Policy gives options for how many units at a specific percentage of AMI. When using TIF, Staff are then asking for the additional five percent of units in perpetuity. There are approximately over 900 other income restricted units in Eden Prairie. The total number of affordable units in the City is around 1,200. Some additional housing initiatives are creating a naturally occurring affordable housing (NOAH) inventory list and action plan. The is interest in preserving affordable properties. Freiberg noted Saint Louis Park had a lot of affordable properties, and many of those have been rebuilt or flipped. Case inquired if NOAH properties are categorized at a higher rate after a 20 percent increase in assessed value. Stanley replied NOAH is defined differently here than it is throughout the region. Klima added Metropolitan Council will define NOAH, but the City could create their own definition for the purposes of the action plan to preserve additional properties. City Council Workshop Minutes September 20, 2022 Page 3 Nelson inquired if homes could be classified to maintain their affordability. Stanley replied there currently is not a working model for single family homes. The funding has been exclusively for multifamily homes to update and maintain affordability. Case added he believes Minnetonka has worked on a program and funding to keep people, specifically seniors, in their homes. Getschow noted many cities promote the WHAHLT land trust program for maintaining affordability of single-family homes. Klima added with newly acquired software Staff can more actively evaluate current rent levels and properties for sale that are affordable. Nelson noted large employers may have an interest in supplying housing opportunities for their employees. Case added Illinois is helping the Black community with contributions towards down payments. Narayanan added in California school districts are looking at managing and owning multifamily housing to rent it out to teachers. Stanley stated employer sponsored housing is promising. Polaris is an example in greater Minnesota. Narayanan added this is very common practice in India and China. Stanley stated there are three project-based section 8 properties in the City. Case inquired how many units. Stanley replied about 350. There are about 250 housing choice vouchers, and the remaining are project-based. Narayanan asked if there is data available on the rate of people who over time increase their income and no longer need a voucher. Stanley replied the data is not available. A voucher can be used on a market rate unit, but project-based has income restrictions. Usually once a property is project-based, it remains so. There are also a few low-income housing, tax credit properties. Those have a 30-year affordability term. A couple properties will likely be expiring soon, so a decision would need to be made on how to proceed. Toomey inquired how long of a term Edendale has left on their project-based section 8 status and if there is a possibility their status would change. Stanley replied to be project-based section 8 housing they enter into a housing assistance payment contract with housing and urban development (HUD). For a certain period of time, they will guarantee low-income housing. He believes Edendale has a five-year contract. Toomey inquired if there is anything the City can do to maintain those low income units. Klima responded part of the action plan would be to have a plan in place. Case noted it would be helpful to know which places accept vouchers. Nelson inquired if 30 percent AMI units do tend to be utilized by the workforce. Stanley replied yes. Case inquired if a voucher could be used towards an affordable unit at 80 percent AMI. Stanley replied yes. There are thresholds set for the maximum rent that can be paid with a voucher. City Council Workshop Minutes September 20, 2022 Page 4 Stanley stated another initiative Staff would like to work on is to promote tenant fair housing materials, a recommendation of the Housing Task Force. They also would like to develop a partnership with Habitat for Humanity. HUD announced funding for aging while in place to help seniors continue to live in their homes. New funds from the Metropolitan Council have become available for affordable single-family housing in high-cost communities. There are hopes to put more funds towards community land trust homes. David Lindahl, Economic Development Manager, reviewed economic development programs. Locally there is the Realtor’s Forum, Eden Prairie High School (EPHS)/Eden Prairie Chamber Student Career Expo, I-494 Corridor Commission, and business communications and meet and greets. Regionally the City is part of Open to Business, a business advisory program the City shares cost with Hennepin County. Elevate Business is fairly new and has more of a focus with Black, Indigenous, and people of color (BIPOC). Narayanan noted the business town hall was successful and is something that should happen regularly. Lindahl stated another initiative, started by the Mayor, is the Innovation Sandbox partnering with the schools. This would be located at EPHS, partnering with the Chamber and 1Million Cups, and would focus on entrepreneurship with youth and community members. Staff continue to support streetscape/pedestrian/light rail transit (LRT) improvements as they encourage economic development. Economic development will help finance some of the Town Center Flying Red Horse monument project as it supports wayfinding and branding. Klima presented on redevelopment in the City and transit oriented development (TOD). Focusing on TOD by the City West Station the Optum parcel Shady Oak Center are guided TOD in Aspire 2040. It is anticipated there would be some sort of mixed-use development. The American Investors Office has had inquires for redevelopment. There could be potential for multifamily. The Golden Triangle Station has a recently approved development, GTS Housing. The TAGS property and two properties north of GTS Housing are guided TOD in Aspire 2040. Staff anticipate ground floor retail with residential above on the TAGS property. The northern properties are expected to be geared towards TOD employment. In regard to Town Center Station, Emerson is guided for TOD. The remainder of the surrounding area are guided town center. There could be redevelopment with ground floor retail and residential above. This would take advantage of some of the lake views. Toomey inquired what is currently on the site. Klima replied it is largely vacant. Emerson has a pavilion. Some of the area would be utilized as park and open space. SouthWest Station TOD already exists at Elevate. Other properties could request TOD guiding. Lindahl stated the Town Center Plan emerged from the Major Center Area (MCA) study in 2006. Staff are still committed to the downtown, main street concept. Staff have had conversations with Bowlero about selling their air rights to build upright. The owner of Petco and Champps is interested in redevelopment. City Council Workshop Minutes September 20, 2022 Page 5 Narayanan inquired about the business community and if they have recovered from COVID. Lindahl replied the City has experienced less impacts overall compared to other cities. Many of the restaurants are still open. Narayanan inquired about commercial properties and office space with people working from home. Lindahl replied the City is generally doing very well with minimal vacancies. Klima stated in regard to Mixed Use, Staff is working on drafting a new guiding code in amended areas and to bring it to Council in early 2023. Eden Prairie Center is looking into long term uses, consistent with Aspire 2040. In regard to infill sites, these properties are expected to develop more quickly. Marshall Farm is guided for low density residential. The southern corner will have little to no development due to the bluffs. There have not been any development inquiries. Case asked if Staff get proactive with these possible development sites. Klima responded Staff have responded to questions from the owners. Conversations will be ongoing as inquiries come in. Authorize Agreement with WSB for Design and Construction Documents for Flying Red Horse Monument. Case noted the original gas station and then the donated Flying Red Horse Monument has been a symbol of entering Eden Prairie for many years. Lotthammer confirmed the donation was received in the 1930s. There has been differing opinions about the restoration and new location, and the proposed location is very close to the original one. It is meant to be a display rather than an advertisement for Mobil. The item is meant to enter into an agreement with an architecture company to ensure everything is structurally sound. Narayanan asked if the monument will have a plaque with a description of the history. Lotthammer noted there will be wayfinding and two interpretive signs as part of the plaza. He added there has been some media traction where the story can also be shared. Case commended the Staff for their work in restoring the monument while also making fiscally conservative decisions. Lotthammer added the item is meant to be a step forward in the design process. MOTION: Nelson moved, seconded by Toomey, to approve Items A-M on the Consent Calendar. Motion carried 5-0. IX. PUBLIC HEARINGS / MEETINGS A. CODE AMENDMENT FOR TEMPORARY SALES EVENTS by City of Eden Prairie. First Reading of Ordinance to Amend City Code Chapter 11 Relating to Temporary Sales Events (Ordinance) Klima stated temporary sales events provides retail businesses an additional special event option. Each retail parcel gets four events per year with up to four days per event. The size is based on the floor area of the business. The change was requested by the business community. CITY COUNCIL MINUTES September 20, 2022 Page 4 Klima explained the temporary sales events impose no restrictions on the parking impact. It would be required the business only sell what is available in the store. Multi-tenant sites will need to manage events. With its six parcels, an event can be held at the Eden Prairie Center for 24 weekends each year. Klima noted special events can be a slipper slope, but there is a desire to balance opportunity for businesses without detracting from the City’s high commercial standards. The Planning Commission voted 6-1 (nay vote by Sherwood) to recommend the City Code amendment related to temporary sales events at the August 22, 2022 meeting. Freiberg asked what the rationale for the four percent restriction is. Klima stated Staff researched other regional communities and their standards. Currently, the outdoor space is limited to two percent, but this is a more limited time frame proposed. Staff identified several businesses and determined the impact of a temporary sales event based on the four percent rule would have minimal impact on parking. Freiberg asked how many square feet Scheel’s is. Klima stated it is 250,000 square feet. Freiberg noted it would be 10,000 square feet of outdoor space. Klima added Scheel’s was the requesting business for the change, and it would be more in line with what its other locations can do. Case stated if there was a festival or event at Eden Prairie Center, it would take up a majority of the parking. He asked if the mall could handle that. Klima confirmed Staff considered the potential of multiple events occurring at one time at the mall. There are six separate parcels at the mall, so there would be enough space to have multiple events. Narayanan asked if the same scenario would work for a strip mall. Klima showed a slide with photos depicting the potential of four percent of the business’s square footage and its impact on parking. Narayanan stated if multiple stores had an event at one time in a strip mall, it would impact parking. Klima stated each parcel can have only four events per year, and they would be limited to four percent of the building’s square footage. The City would work with the businesses to ensure there is no negative impact on other businesses or parking. Nelson asked if the Code includes philanthropic events such as a blood drive. Klima stated the Code doesn’t address philanthropic event, but Staff would CITY COUNCIL MINUTES September 20, 2022 Page 5 consider it as an option if it were to come up. If there were several requests received, then an additional Code amendment would be considered. Case noted the Code should promote and allow for flexibility with philanthropic efforts such as a blood drive. Freiberg noted he has seen blood drive trucks and the like, but it may not be in line with Code. Getschow confirmed there have been philanthropic requests, and it has been channeled through certain business and sales Codes. It is more common for a blood-mobile to be in a business park or office area than in a retail space. Case added the Code should be flexible enough to support philanthropic efforts without being abused. There were no comments from the audience. MOTION: Freiberg moved, seconded by Narayanan, to close the public hearing, and to approve the 1st reading of the ordinance to amend City Code Chapter 11 relating to Temporary Sales Events. Motion carried 5-0. B. CODE AMENDMENT FOR SIGN CODE by City of Eden Prairie. First Reading of Ordinance to Amend City Code Chapter 11 Relating to Sign Code (Ordinance) Case noted the flowers by Klima are for Katie O’Conner who has a new role with the County, and will be leaving her job with Eden Prairie. Klima explained the proposed sign Code amendments are part f a larger phased project to update the City’s sign code and make it clearer and more user- friendly. The content neutral sign component was approved in February. Currently, Staff is working to update the Office and RM-2.5 sign allowances and establish Town Center and Transit-Oriented Development (TOD) sign allowances. Later on, some of the Code will be reorganized for clarity and ease of use. Klima stated the proposed amendment increases freestanding sign allowance from 50 square feet to 80 square feet with one street frontage. Additional street frontages continue to be allowed 36 square feet of signage. The increase provides consistency with freestanding signs in commercial and industrial zoning districts. Klima noted the proposed amendment allows for sliding scale of signage based on size of wall area and provides a maximum sign are. The total square footage allowed can be divided between multiple signs, as long as the total square footage does not exceed the maximum sign area allowed. CITY COUNCIL MINUTES September 20, 2022 Page 6 Klima stated the current RM-2.5 Code allows for permanent signage for one six square foot sign per building. The proposed amendment would increase the allowed signage up to 25 square feet, which would allow for better visibility and flexibility. Klima added the Town Center and TOD areas have unique aspects and are lacking sign Codes. The proposed change would maintain current commercial allowances with additional options. The awning signs would count towards the building’s total wall sign allowance. Projecting signs would also project towards the building’s total wall sign allowance. The projecting sign could be no more than 10 square feet and have other restrictions for size and brightness. Klima stated for residential sign usage, when located at the ground floor, the maximum size allowed would be 25 square feet. An additional sign is allowed about the ground floor and the size is calculated o a sliding scale, allowing for additional sign size based on the location of the sign on the building. His includes a maximum sign size of 50 square feet. Klima noted Staff is proposing additional freestanding signage allowance. One sandwich board sign would be allowed per tenant with 12 square feet per side, which is fairly standard. There must also be clear path for pedestrians. It is proposed to be expanded to all non-resident zoning districts as current Code does not allow for freestanding signs. The Planning Commission voted 7-0 to recommend the City Code amendment related to sign code at the August 22, 2022 meeting. Nelson asked if the offices could have a sign only on one side but have an extra-large sign with the proposed amendments. She asked if there is a single maximum size. Eden Prairie has always stayed away from large signs. Klima stated the proposed office wall signage does have a maximum signage restriction, which is close to 150 square feet total. There were no comments from the audience. MOTION: Toomey moved, seconded by Narayanan, to close the public hearing, and to approve the 1st Reading of the Ordinance to Amended City Code Chapter 11 relating to the Sign Code. Motion carried 5-0. X. PAYMENT OF CLAIMS MOTION: Narayanan moved, seconded by Nelson, to approve the payment of claims as submitted. Motion was approved on a roll call vote, with Freiberg, CITY COUNCIL MINUTES September 20, 2022 Page 7 Narayanan, Nelson, Toomey, and Case voting “aye.” XI. ORDINANCES AND RESOLUTIONS A. ADOPT NEW SECTION IN CITY CODE, 5.78, RELATED TO SALT STORAGE (Ordinance) Ellis explained the City of Eden Prairie is required to obtain a Phase II NPDES Municipal Separate Storm Sewer System (MS4) Permit from the Minnesota Pollution Control Agency (MPCA) every five years. The City’s current permit requires controls on salt storage and transfer to be in place by October 22, 2022. Several other cities are going through the same process. This ordinance is based on a model ordinance provided by the MPCA and brings City Code into compliance with state and federal requirements. In short, if salt must be stored outdoors, there must be some impervious cover. MOTION: Narayanan moved, seconded by Freiberg, to approve First Reading of an Ordinance Adding City Code Section 5.78 relating to Storage of Deicing Materials. Motion carried 5-0. XII. City Code Chapter 11, Section 11.03, Subdivision 3, Subsection J, Item 2(a)(3) is amended by deleting “a private sidewalk at least five (5) feet wide” and replacing it with “any designated pedestrian pathway”. City Code Chapter 11, Section 11.03, Subdivision 3, Subsection J, Item 2(a)(5) is amended by deleting the item in its entirety and replacing it with the following: (5) Is not located in the required parking area unless in accordance with the following: a. Not more than one-half of one percent (0.005) of the required parking stalls may be utilized for the temporary outdoor display area. b. Any impact to drive aisles is subject to approval by the Fire Chief. 2 Section 6. Outdoor display area limits may encompass an area no greater than seven percent (7%) of the base area of the completely enclosed building. Section 8. City Code Chapter 11, Section 11.03, Subdivision 3, Subsection J is further amended by adding the following new Item 5: 5. Temporary Outdoor Sales Events. Temporary outdoor sales events are permitted in any zoning district that permits retail use and only upon compliance with the following: (a) Permit Required. No temporary outdoor sales event may be held without first obtaining a permit from the City. Any person who operates a retail business in the principal building on a parcel or the owner of the parcel on which a retail business is located may apply for a temporary outdoor sales permit for the parcel. The applicant must complete an application form provided by the City and submit with the application a complete description of the temporary outdoor sales event and a sketch showing the size and location of the event on the parcel and any other information deemed necessary by the City to consider the application. If the applicant is not the owner of the parcel on which the event will be held, the applicant must provide evidence satisfactory to the City of the owner’s consent for the temporary outdoor sales event. The applicant must also submit at the time of the application the then-current permit fee set by Council ordinance or resolution. The City Manager or their designee will approve or deny the permit no more than thirty (30) days from the receipt of the complete application and payment of the applicable fee. Permits are subject to all requirements of this subsection J.5. Any event held within a tent must obtain a tent permit from the City. (b) Location. The temporary outdoor sales event may only be held in the location specified in the approved permit. Any impact to drive aisles is subject to approval by the Fire Chief. The temporary outdoor sales event may not obstruct designated pedestrian pathways. 3 (c) Products Sold. Only products regularly sold within the principal building may be sold at the temporary outdoor sales event. (d) Size. The temporary outdoor sales event may not encompass an area greater than four percent (4%) of the base area of an enclosed building located on the parcel on which the outdoor sales area is situated. In Industrial Districts and for parcels that include multi-tenant buildings, the outdoor sales area may not exceed four percent (4%) of the gross retail space of the industrial user or tenant for which the permit was issued. (d) Duration. No temporary outdoor sales event may last longer than four (4) days, including set-up and take-down. (e) Frequency. No parcel may be issued more than four (4) temporary outdoor sales event permits per calendar year. Section 10. City Code Chapter 11, Section 11.70, Subdivision 4, Subsection H is amended by adding the following new Item 4: 4. Where temporary outdoor sales events are permitted by Section 11.03, one (1) temporary on-premises sign not to exceed thirty-two (32) square feet in area and six (6) feet in height may be located on the same parcel as the temporary outdoor sales event area for the duration of the event. The sign may not appear before the set-up of the temporary outdoor sales event and must be removed concurrently with the take down of the temporary outdoor sales event. Section 11. City Code Chapter 1 entitled “General Provisions and Definitions Applicable to the Entire City Code Including Penalty for Violation” and Section 11.99 entitled “Violation a Misdemeanor” are hereby adopted in their entirety, by reference, as though repeated verbatim herein. Background Information The City’s Phase II NPDES MS4 Permit was approved in October 2021. The new permit requires several items to be part of the city’s regulatory mechanisms. This includes a provision for pet waste (Section 9.02), updated stormwater management rules (revisions to Section 11.55 forthcoming), and the regulation of salt application for commercial facilities, institutional facilities, and non-NPDES permitted industrial facilities (proposed herein). The Minnesota Pollution Control Agency (MPCA) provided MS4s with a model ordinance as a template for the new salt requirements. The attached ordinance meets the requirements of the MS4 permit while incorporating aspects of the model ordinance that give preference to indoor storage of salt and prohibits its storage in environmentally sensitive areas. THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE, MINNESOTA, ORDAINS: Section 1. Chapter 5 of the City Code is hereby amended by adding the following new section: SECTION 5.78. SALT STORAGE Subd. 1. Purpose. The purpose of this section is to establish practices for the storage of chloride-based deicing materials to control their entry into the Municipal Separate Storm Sewer System (MS4) in order to comply with the requirements of the National Pollutant Discharge Elimination System (NPDES) permit process. Subd. 2. Definitions. For purposes of this section, the following terms have the meanings stated below. Salt means any chloride-based substance used to melt snow and ice or otherwise used for its anti-icing effects. Impervious Surface means a constructed hard surface that either prevents or retards the entry of water into the soil and causes water to run off the surface in greater quantities and at an increased rate of flow than prior to installation of the hard surface. Examples include rooftops, sidewalks, patios, driveways, parking lots, and concrete, asphalt, or gravel roads. Institutional Facilities means churches, schools, and government buildings. The definitions contained in Section 5.75 govern other terms used in this section but not defined in this subdivision 2. Subd. 3. Application. The requirements of this section apply to all commercial facilities, institutional facilities, and non-NPDES permitted industrial facilities that store salt. Subd. 4. Requirements, Conditions, and Restrictions. A. Salt must be stored indoors whenever possible in order to prevent such materials from being affected by rain, snow, wind, and melt water. B. Salt may be stored outdoors only when indoor storage is not possible, subject to the following conditions, restrictions, and requirements: 1. Salt must be covered at all times. 2. A cover that is waterproof and impermeable must be placed over all salt piles. The cover must prevent runoff and leachate of salt from being generated from the piles. The cover must be secured at all times to prevent removal by wind or other weather events. Salt piles and covers must comply with all requirements of Chapter 11. 3. Any damage to the cover during the winter must be temporarily repaired to reduce the entrance of precipitation. 4. All salt must be stored on an impervious surface. Salt may not be stored on pervious surfaces. 5. Surfaces on which salt is stored must be swept immediately upon seasonal removal of salt. 6. Salt may not be stored within designated floodplains, on top of stormwater facilities, or down-gradient from snow storage areas. C. Sweeping, diversions, and containment measures must be implemented to reduce exposure of salt when transferring material in designated salt storage areas. Subd. 5. Violation; Public Nuisance. Violation of this section is a misdemeanor as provided in Section 5.99. In addition, any condition caused or permitted to exist in violation of this section is a threat to public health, safety, and welfare, and is declared and deemed a public nuisance, and may be summarily abated or restored by the City at the violator’s expense, and/or the City may institute a civil action to abate, enjoin, or otherwise compel the cessation of such nuisance. The violator will be liable for the cost of abatement, including administrative costs and legal fees. If an invoice for abatement costs remains unpaid for thirty (30) days after mailing by the City, the City may specially assess the costs against the property from which the violation arose. Section 2. The Contractor started the bridge work earlier in the year and is planning to be substantially complete by the end of October. In order to meet the inspection needs through completion of the project, the consultant is requesting an amendment to the original agreement. Background Information As a reminder, the Duck Lake Road Reconstruction Project includes the following significant components: • Reconstruction of the collector street which was in poor condition (originally constructed in 1973). The existing section of street was narrow and did not have curb and gutter, • The addition of a storm water management system, • The addition of pedestrian facilities on both sides of Duck Lake Road, • And a 235’ bridge spanning a portion of Duck Lake. Financial Implications The original Professional Services Agreement with Bolton & Menk has an estimated cost of $358,432. The amendment would bring the total not to exceed fee to $420,532 (an increase of $62,100). The construction bid total is approximately $4.47 million dollars. Primary funding for the project will be from Municipal State Aid funds as well as $1.175 million dollars from RPBCWD for the bridge and related water quality and habitat benefits. Attachment Professional Services Agreement Amendment Amendment to the Standard Agreement for Professional Services This Amendment to the Standard Agreement for Professional Services (Amendment) is made on the 4th day of October, 2022, between the City of Eden Prairie, Minnesota (hereinafter “City”) whose business address is 8080 Mitchell Road, Eden Prairie, MN 55344, and Bolton & Menk, Inc.
