HomeMy WebLinkAboutResolution - 2020-10 - Declare Public Right-of-Way on West 70th Street - 01/07/2020CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2020-10 RESOLUTION AUTHORIZING THE CITY OF EDEN PRAIRIE TO RECEIVE AND DECLARE PUBLIC RIGHT OF WAY WHEREAS, the City of Eden Prairie is a political subdivision, organized and existing under the laws of the State of Minnesota (the "City"); and WHEREAS, the City has been a partner in planning for the Southwest Light Rail Transit project (the "Project"); and WHEREAS, the Project will extend the METRO Green Line from downtown Minneapolis through the communities of St. Louis Park, Hopkins, Minnetonka and the City; and WHEREAS, the City reviewed the Project layout and provided Municipal Consent on the 15th day of September 2015; and WHEREAS, the Metropolitan Council has acquired the real property needed for the Project; and WHEREAS, the Metropolitan Council has acquired real property known as Parel 302 in fee for the construction and operation of Golden Triangle Station located on West 70th Street in the City; and WHEREAS, after Project construction, a portion of Parcel 302, as described on the attached Exhibit A and as shown on the attached Exhibit B (the "Property") will be used as road right of way; and WHEREAS, that upon Project completion, the Metropolitan Council desires to transfer the Property to the City at no cost. NOW, THEREFORE, BE IT RESOLVED, that upon tender ofa deed to the Property from the Metropolitan Council, the City Council approves acceptance of the Property and hereby declares the Property shall be used as public right of way by the City in perpetuity for road right-of-way purposes subject to amendment, modification or termination by written agreement of the parties. NOW, THEREFORE, BE IT FURTHER RESOLVED, that as part of the transfer of the Property, the Council requires that the Metropolitan Council enter into an agreement with the City, to be approved by the Council regarding the use, operation and maintenance of the Property. NOW, THEREFORE, BE IT FURTHER RESOLVED, that pursuant to Minnesota Statutes Section 462.365 the Council finds that this proposed acquisition has no relationship to the Municipal Comprehensive Plan and as a result it does not require review and findings by the Planning Commission.
